Brief background: Moved from one state to another for a job, which was lost. Income has dropped to about 50% of what it was. We’ve gone through our savings to try and pay things. Bring home pay now covers ONLY new house payment, utilities, groceries, life insurance, and government student loan. Have previously surrendered 2nd vehicle, (1st vehicle is paid in full). Old house in old state foreclosed on and being sold tomorrow. Credit cards remaining unpaid and sent for collections, etc.

My question is this: should bankruptcy proceedings begin or should we continue as is? What, if anything, can our creditors do to us (other than trash our credit – which has already happened). We live in Texas. I would appreciate any suggestions. However please refrain from replies such as "get a job", because we are both working full time jobs and have cut ALL unnecessary spending. We dread the thought of bankruptcy, but see no other alternative.
We’ve done the credit counseling, etc., and the funds are simply not there.

Can they garnish wages for debt in Texas?

The one vehicle we have is paid in full and is a 1999 Ford Ranger – not new. Excellent comments everyone – thanks!

I need to buy some time to get an attorney for my Chapter 13 Bankruptcy. How do I file an extension to put off my meeting of creditors and the schedules and plan? I am in the state of Nebraska.
Please HELP! We have had some really bad hardships in past 2 years…Murder of our daughter after 12 years she had been missing, I, the co-borrow have been told by my doctor that I can not work. I am about 2 months from SS disability and approx. the same time frame for a military disability rating for military sexual trauma. Thank you for any information..God Bless your knowledge!

He was only a few months into his chapter 13 bankruptcy and he had all of the attorneys fees to pay yet too. Can any of his attorneys or the IRS take our life insurance benefit

Our first mortgage is 225,000 and the second is 133,000 from a private lender. But the house is worth 180,000. What will happen when we do the bankruptcy? Wouldn’t a portion of our mortgage be considered unsecured?

I am going to go to a debt management program/credit counseling, it was the best alternative to avoid bankruptcy.
What are the best companies that charge a low fee and that can get the best lower monthly payment?

I pay my home mortgage to American Home Mortgage and I just saw online today that they are filing for bankruptcy.

i found out online my apartment complex owners filed a Chapter 13 bankruptcy in March 2009. The story online says all their assets will be sold at auction to pay creditors. I have not been informed of this by my landlord but we did get a notice of an inspection in 2 days.
Is their a chance I could get evicyed because of the place beng sold because of bankruptcy ? Do the new owners have to legally honor my lease ?

I was unable to reach my attorney to get my balance and there was a discrepancy about the balance . I don’t owe very much more and now i’ve been dismissed and the attorney wants five hundred dollars to reinstate it for me to pay it off that’s crazy

For my business class, we were given the assignment to find various bankruptcy court records using only online means. Since this is my first business class in years, I am not familiar with searching up such things on the internet. Can anyone tell me of how I go about finding bankruptcy court records?

Bought a brand new car 6 mo’s ago. Had 2 g’s in negative equity in previous car which obviously rolled over to this one. Have a 600 beacon so got high interest rate on new car. Just made 6th payment and owe about 7 g’s more on it than what Kelly blue book says its worth on trade. With the credit market the way it is I don’t see a way out of this vehicle. The payment is too high on it for me now because I lost my job and have been unable to find a similar paying job for past 3 months, and I can’t get unemployment. Haven’t missed a payment or been late on this car or the previous one I had for just over a year. I only have about 0 in credit card debt, but am maxed out basically. Have other various debt from years back. At this point I don’t see how I’ll be able to come up with car payment and rent at the end of December, so I need to figure something before then.Is there anything I can do?

Someone I know is filing for bankruptcy. I was wondering if there were any effects that bankruptcy would have on her as far as credit. Does bankruptcy go on any kind of personal record? I’m just wondering if she’ll always have to worry that filing bankruptcy will effect her credit permanently or any other issues throughout her life?

I am wondering if you are in a active chapter 13 bankruptcy with a mortgage, and your mortgage payments are made through the trustee. How will your mortgage payments be reported on your credit report? Should your payments be reported as pay as agreed through wager earner plan or will they be reported as late payments?

Will on time payments of your mortgage increase your credit score while you are in chapter 13?

I just came from a bankruptcy lawyer in california and she wants 1799 up front total including everything for a chapter 7 bankruptcy. I am moving to prescott valley arizona in three weeks and wonder if it will cost less if I move there and wait the 90 days and file there. Can anyone help?

I am thinking about it seriously, lots of issues with divorce. What can I do after filing bankruptcy. Will anyone have anything to do with me and how long do I have to wait to start building credit again? Ex has trailer in my name……….I am not living in it. His medical bills are in my name….now they are coming after me. I am already paying on all my stuff…………and after 1yr sense divorce I am still paying for him. I feel it is my only alternative.

I need an answer? I have been looking and looking online for hours. Now Bankruptcy has taken my refund for 2007 tax season. So I am wondering if they will take the stimulus check to? can some one please help me answer this?

Ok, i am getting sued by another person as result of a car accident. I was under the impression my insurance was still current but turns out, it had expired, so i had no insurance to cover thier accident. I have 3 questions regarding this 1) when you have insurance, aren’t you covered agaisnt uninsured moterists? 2) if i declare bankruptcy will it eliminate the money they sue me for if they end up going through with everything? and 3) do i possible have any options or alternatives? PLEASE HELP

I have never been late on my payments on any of my debts.
I’ve been told (by some friends and colleagues) to just let them all go late and use the extra $$ to get set up in an apartment (since I am surrendering my home due to it being worth less than I owe on it)
I mean, my credit is going to be crap anyway and it will take me a few months to get the bankrupty filed and the hearing held. Also, I will need some $$ to pay the up-front Attorney fees.
I don’t like the idea of doing this, but I don’t have any other way to come up with the $$ I need.
Please don’t lecture me about the whys and hows of how I got to where I am today… I have 2 worthless ex-husbands to thank for that. At least I am doing something positive to give myself a fresh start. Also, any advice as to how the Chapter 13 went for you would be appreciated.
BTW; I earn a salary that is above the median income for my state, so I know I won’t qualify for a Chapter 7.
