I am currently in a Chapter 13 plan (since 4/05). I live in CA and have been a homeowner from 1998 till right before filing my Chapter 13 due to an expensive & litigious Divorce. Unfortunately, I am unable to afford a home based on real estate prices in California. I have restablished credit (below the 00 threshold allowed) & my credit score is 600 which I’ve been told is very good for an active BK. In regards to taxes, I can no longer claim my kids and I’ve lost the homeowner’s deduction, I would like to purchase an RV as a permanent residence. I have checked with an attorney and a tax advisor who both advise this is a smart move based on my income and tax bracket. The attorney advises that the Chapter 13 Trustee will, most likely, approve this purchase. My challenge is finding a lender that will lend me the money for the purchase that reports interest paid to the IRS. I am looking at a 000 purchase including tax and fees. I have access to 401k funds for a 30% downpayment on a collateralized loan on a used RV. According to my tax advisor, interest paid on a primary residence (yes, even an RV) has no real limit, so I would be willing to pay up to 25% APR based on my finances and credit history. Any suggestions on lenders, alternative means of financing or am I just plain crazy…
In addition I have a free place to park. Includes all utilities free. Does anyone know any ‘alternative’ finance companies that report interest to the IRS? APR does not matter up to 25%. Based on my income and tax bracket this the best situation for me.

My ex-wife just told me that she is filing chapter 13. From the research I’ve done online, it looks like I have to prepare for the debt that she was assigned in the divorce decree to come back to me. Q1) Is this how it works? Q2) What kind of lawyer do I need to hire to challenge this? Q3) What are my rights and obligations? It’s hard to find information about bankruptcy if you’re on the receiving end. Where can I get more information???

I figured I’m only working to get by, but in prison they take care of all the necessities. I’m kind of sick of work and wouldn’t mind taking a 5-10 year break.

I don’t want to hurt anyone and I don’t want to go for life. Just enough for this bankruptcy to roll off my credit report.

Any ideas?
Just so you guys know, I’d also be using this as street cred for my rap career. I plan on going into the music industry when I get out, not the corporate world.

I filed for Chpt. 13 bankruptcy a couple of years ago and would like to find out how much I currently owe. I’ve heard there are websites where you can find this info, but havn’t been able to find them through searches. Any ideas??

I’m interested in hearing from people that have actually been through it… How bad is it trying to live a normal life after declaring bankruptcy? I’ll never be able to pay all this debt off through regular payments. Is it better to just see which creditors will actually sue and then try to settle with them at some point?

I’ve talked to people who have said that it was a very positive thing for them, but I want to hear from some other people who have "been there, done that".

I have large debts and a very low income (due to various things that have went wrong in my life in the past year) and I have no money to file bankruptcy. I hear it costs 500 dollars which is what my rent costs and I have to choose rent over legal fees. I have nothing to sell to make money and work a job with a different schedule every week and also a very strict emloyer who goes on firing sprees all the time. It is not a bad job in the sense that I do make more than minimum wage so I can’t afford to lose it. I have limited transportation which limits where I can get to as many businesses in my city are in areas with no bus service and I can’t take off or be late for work under any circumstances. Is there any place to get free assistance and that useless credit counseling thing that is required? I know it is required although I do not believe in conselours of any type.

I am in chapter 13 bankruptcy that was confirmed in February. I have made all the required payments to my trustee since I filed last September. She has NOT made a payment to my mortgage company since March and now they want to forclose on my property. I gave my attorney all the payment receipts to prove I made them. Are there any repercussions to the trustee for not making the payments? She has over ,000 of mine that she hasn’t paid to my mortgage company. What can we do?

My court hearing for meeting the creditors/trustee is on July 10th for Chapter 7 bankruptcy in Florida. I was wonder since my household only have 1 car. I really need to have a extra car for me to use for work instead of using my spouse car. I’m planning to pay cash for a cheap used car but I need to know will it be a problem once after I do my court hearing?
Well I guess I have to wait for the letter of discharge right?? How long does that usually take?

A ‘For-Profit’ COmpany based in Texas, helping people with financial debt consolidation. I’ve heard, that its a great alternative to filing bankruptcy. Looking to manage/consolidate debt, and NOT have to file for bankruptcy–which can ruin my credit

I had to file Chapter 7 bankruptcy about 1 year ago due to a business loss. The bankruptcy has been discharged and I currently earn ~6,000 /yr now. My wife earns ,000/yr. My daughter is attempting to get student loans, when applying on line, it is being denied when we try to apply with us as co-signers. Any recommendations as to how to get her assistance?

i am thinking to file. examples that include your income and expenses versus how much the court orders you to pay would be good. also, what percentage of the debt do you have to pay under ch.13 to creditors. thanks for help!

my house notes are behind however prior to my conversion I contacted my mortgage company several times to ask for a letter of intent to pay past due payments. Instead of them sending me the form to fill out, they turned my account over for forclosure. Has anyone ever experience this type of situation or does anyone know what I can do? My lawyer states she will contact the attorney whose handling the case by letter to ask for the total amount due and to ask if my mortgage company will reinstate.

This is a question related to last week’s question kindly answered by helpful person…"is not paying unsecured credit card debt an alternative to bankruptcy [?] ". The answer included info that my wages could not be garnished in TX. I now need to know about NM & AZ.
Considering I can’t do debt consol and would very much like to avoid bankruptcy….I am trying to put my life back together after ex husband in TX surprised me by divorcing me after 14 yrs. and then filed bankruptcy himself instead of filing as a couple (which he had told me he would do-as a couple) and in doing so dumped debts on me. Collectors who can’t collect from him are now calling me. THANKS GREATLY FOR YOUR HELP.

if i was to work extra days at my job, or get a second job, would that factor into the bankruptcy after i filed it? i know the trustee draws up a payment plan with the income submitted at the time of filing, but how long after i file will he keep factoring any extra income? thanks
