Hi Yahoo people..I plan to file a chapter 7 bankruptcy, but before I do that, I need some information about chapter 7.
1. I have Garnish on my wages right now..can chapter 7 stop or erase any of garnishment against me??
2. Can I do this online or file it myself, or higher a bankruptcy lawyer..??
3. How long does the process take??

I am a single mom and I have fallen way behind. I am trying to get caught up but this is not working. I know that I have no choice but to file. I have called a few attorney and they want so much . I live in the san Gabriel valley

ok this is what happened,
my dad took all my moms credit cards and charged them all at a store he knew and sent it all away to his country, and we are broke, my dad is ruining our lives. All the bills are coming in and it is clear that my dad will pack up and just disappear one day. My dad did this before about 9 years ago, and if he does leave, we dont want this bills coming down on us, can we end it?

the judge might dismiss it because i didn’t send the first payment in on time because of confusion on the deadline for it. if it does get dismissed, how soon can i file again? i live in oregon. thanks for any helpful advice

I have Series 7, 63, 65 and AZ Life & Health licenses. I am facing foreclosure on my home. I don’t want to file for bankruptcy, but if my lender successfully gets a deficiency judgment for the balance of the loan that’s not covered by the sale of the house, I might have to go for bankruptcy.

I want to keep working in the financial industry, and eventually to get a CFP. Can you tell me what effect, if any, foreclosure and bankruptcy would have on my current licenses and on abilitiy to obtain/renew future licenses?

Yes, I definitely decided to give up the home and short sale will not alleviate the issue (or at least I don’t see how it would), I’m way to upside down on the house.

I may be filing bankruptcy in the near future. As such, the lawyer is asking to see my tax returns. I have made some charitable contributions, but don’t have all of the receipts. Will the court/lawyer attempt to verify the contributions? Thank you.

If a person has a lot of unsecured debt that has been charged off by the lenders and the person is not eligible for Chapter 7, should they file Chapter 13? What are the benefits of filing Chapter 13 in this situation? Thanks!

I just opened a credit card bill & the interest has doubled…I make payments through my online checking account…somehow the payment made on the 10th wasn’t credited until the 12th which resulted in a late fee & default interest of 30%…but when I made a payment on the 22nd, it was credited on the 22nd.

Anyway, they won’t reverse the late fee or lower the APR

I was talking to my Mom, & she mentioned getting an attorney & filing (something that she couldn’t think of the name of, but supposedly not bankruptcy). She said there was something that could be filed to stop the high APR & interest & then just pay the balance on the credit cards…DOES ANYBODY KNOW what she is talking about??? I have never heard of just halting all interest on a credit card & paying the remaining balance over time — yet it wasn’t called bankruptcy & there was magically no negative impact on a person’s credit report???

Is it ok to surrender my car back to the bank before my Chapter 7 Bankruptcy is finalized? I’ve already attended the hearing, I am expecting a successful Chapter 7 release soon but not sure exactly what date, I have the car listed on my Debtors Statement of Intention as "Surrender", the next car payment is due this Saturday, I don’t have the money to pay it, will I jeapordize my Chapter 7 release by surrendering the car back to the bank now, should I wait until my release arrives in the mail, or does the timing of this not really make a difference?

Yet multinational millionaire corporations file bankruptcy under Chapter 11 – Reorganization and get to keep all the debt and start a whole new corporations with unlimited liability.

Not to mention individuals AFTER filing bankruptcy have to pay exorbitant interest rates. Corporations after Chapter 11 have the same low interest.

THIS IS EXACTLY WHY progressive taxrates are not so unfair when you factor interest costs into the individual.

My husband I are going to be in the process of filing chapter 7 tomorrow when I drop off our payment but had a question.. How will they tell which creditors to notify of us filing bankruptcy when we dont receive actual statements since most of our accounts were on paperless pay online type of things and when i log on they disable the accounts and ask to call them, and I cut up all the credit cards.. can they do a credit check and notify my creditors that way? I’ve never gone thru this before and curious how they would do that since we have sooo many creditors and hard to keep track of who we get statements from and who we dont thanks

I just filed for a chapter 13 and my attorney suggested I get an appraisal in case its less than what I owe between first and second mortgage. He said it could affect whether I am still required to pay the second mortgage. Does anyone know if it will also affect my first mortgage? I just got the appraisal back and it is considerably less than even whats left on the first mortgage.

I am confused about how the means test works for a chapter 7 bankruptcy. I make more than the median income in my area, however my debts are pretty large. My last 6 month’s income was about 29K, but my fixed monthly debts are around 4K. That is before food, gas, and all the other random expenses. In the past, I was making well above and beyond my monthly liabilities…but that number has gone down significantly due to circumstances out of my control. I am looking to file chapter 7 bankruptcy and have not been able to find helpful answers online so far. I am out of money and not able to pay my bills. Any help would be much appreciated!!!

how does it affect your life, your job? We don’t have a house payment [only rent] electricty, propane, and phone. We don’t even have a car payment, but we have 40,000 in credit card debt!!!! HELP ME!!!!

just wondering what happens when you go bankrupt like honustly. cause i got tould if you file for bankruptcy its 3years you cant apply for anything and it stays on your file for up to 7years. is it possible to repair your credit like no jokes or hoaxes. i looked online but they all full of shit and i just wondered if anyone knows if you can repair or fix your credit rating. i always get knocked back when i apply for a loan or credit card or even a phone. and i wanted to know what i have to do to get everything back on top again even if i have to pay more interest or whatever. anyway possible or do i have to wait 3-7years before i can get a credit card, loan, or house loan. there must be a way, anyone?, also is it really 7 years or is it longer or does it still stay on file. whats the deal. anyone know

My Husband and I filed Chapter 13. However, we have decided it is not a good move for us. So, we have our Creditor Meeting with the Trustee this week and want to know what will happen if we decide not to go through with this? Mainly, does this go on our credit report anyhow?
I wanted to add that we are using a Bankruptcy Attorney and we are just looking for more info to make our decision before we talk to her about it. Thanks for all of your help in advance

I filed a chapter 7 bankruptcy case in kentucky. I did it all by myself because i couldn’t afford a lawyer. The reason it was dismissed is because i failed to take the credit counseling course within the time frame. (I didn’t know you had to wait 180 days after taking the test to file). Anyway, my question is how long do i wait to refile. do i have to wait 6 months from the time i filed or 6 months from the time it was dismissed? Seriously need help!

I have been in debt for quite some time five years. I am working full time. I have no assets. But I also cannot afford an attorney since I am living in a hotel and have 2 child support obligations. I have seen many online prep services but I do not know if they would work or not. I also will be having most of these debts off my credit report in about 3-5 years. I am wondering should I just wait it out and let those debts fall of my report and then try to build my credit back up with secured cards or just file for bankruptcy and have hopes in it getting discharged.
