If I include my house in Chapter 13 does it go into foreclosure or would it be bank owned? Is it the same thing? I was told with foreclosure you could be responsible for the difference of the amount of the loan & what it sold for, but with the house in bankruptcy you will not be responsible for the difference. It would be dismissed.

I am about to take a state licensing exam, and for some pathetic reason I need to provide proof that I filed and that all debt has been discharged. I have no CLUE how to get this – do I request it from the court? Can I get it online? (it IS public record isn’t it?) My a$#@*hole attorney isnt returning my calls so Im on my own. Someone please help!

I have filed bankruptcy thinking i could keep my house and my car. But now have to let house and car go back because some things in my life have changed. I really do not want to rent. I have an opportunity to get a house on a land contract. For a good price. It would be for 7 1/2 years. My worry is in 7 1/2 years will i be able to get a loan to pay it off. I will get house for 100,000. Worth now around 120000 to 130000. Needs a little TLC. Built in 2005. Would this be a good idea or bad idea?? will i be able to get loan to pay it off in 7 1/2 years???

My husband filed a chapter 13 in 2002, confirmed in July 2002. He got his statement the end of June and it shows he still owes 00, meaning his bankruptcy will be running 7 months past the 5 year limit. Is this possible? What happens if his 5 years expires with this balance? He did miss 5 payments when he moved up here after we got married, because the trustee and his lawyer failed to file new payroll orders even after being asked several times. He mailed several payments when it was obvious they hadn’t put in the order. The payroll with holding amount was supposed to be increased slightly to make up the missed payments, but again the trustee and his lawyer didn;t file the paperwork and we finally stopped calling and bugging after several months. Are we now going to become responsible for that unpaid balance or will his bk be extended past 5 years???
not trying to get out of anything- if we were he would have filed a chapter 7 and not paid at all… don’t be so judgemental.
didn’t mean to be rude, just if we have to come up with 00 in one lump it will be tough to do and would be nice to know ahead a little.
also, even with the 5 payments he missed it would have only amounted to about 0, not the 00 still due here at the end

I applied for an Orchard Bank card online on April 17th. I took a week and a half to get my welcome email and credit limit, and I still haven’t got my card yet. I’m going out of town in a week and was hoping to have this card when I leave in case of emergencies. It’s my first card since my bankruptcy and looking forward to using it wisely to rebuild credit — if I get ever get it!!!!

I am going to file a chapter 7 bankruptcy, and I will surrender my cars. I am up to date with both payments, but will not make March 1st payments on them. When should I expect to surrender them to the banks?

My husband has been making payments to the Trustee on our chapter 13 bankruptcy, we are seperated and he has handled the payments which are 0 mo. He recently within the last year is receiving his Social Security Disability plus a small pension is this going to dismiss our case?

My case was dismissed because I could manage to make the payments. I paid 20K during a year period. What happens to that money? What happens to the debt that was part of the plan now that it has been dismissed? What happens to my credit?

i filed and was discharged for a ch 7 in july 2005. can i file for a ch 13 ? also, i did the online means test and the overall amount is negative, what does this mean ? thanks

Right before I came back from Iraq there was a lot of pressure on me to reenlist, so I did.

I had a hard time readjusting to life after Iraq, and I ended up getting discharged.

I am living in Texas and just filed for Chapter 13 bankruptcy. I wanted to know can I keep my checking account or will they take my money? My pay check is direct deposited into the account every two weeks in which I pay bills, daycare, and food. I don’t want to be stuck without out any money. My pay check is all I have and I can’t afford to lose anymore than what I already have to pay the courts. Can someone tell me how this works?

Now that they’re going broke, I want to snag bargains but the site shows a page saying how they’re bankrupt. Does this mean I can’t order online and I have to run down to the store to find what I want?

So sad that they’re going bankrupt…if I had the money I’d buy them. How is the economy able to make so many stores bankrupt? when will the economy get better? When it does, will Circuit City be back?

I will be filing Chapter 7 bankruptcy soon, and am trying to figure out if the ,000 I owe my University will be discharged. None of the balance is from student loans, or any other type of Financial Aid. It is from past tuition, bookstore charges, room & board, as well some other irresponsible charges to my Bursar bill. Thank you in advance.
To answer the answers below, I am actually in the process of choosing my bankruptcy attorney, but the last one I spoke with wanted to charge me 0 to look up that information, and would not include it in his normal bankruptcy rate.
As for the answer regarding student loans, NONE of the University debt includes any type of loan or other type of financial aid. Thank you for such quick responses though!

I file for bankruptcy a couple of years ago. Since I need to travel (inside the country) soon, someone offered to authorize me on their credit card account so that I can book online. Does anyone know if I will have a problem with this?

We are currently in a Chpt 13 bankruptcy and I am contemplating divorce. What would happen to our payments? Would the courts split it evenly? What happens if the other person defaults on their payment? Would it affect both?
Look . . .I am trying to keep MY commitments. Its the husband that thinks he needs new cars, new cell phones, new everything, and can’t be happy with what we have and what we can afford.

I am trying to stay together for the kids sake, but at the same time it might be better for them also if we just move on.

But this question is not about that, it is about what happens to the bankruptcy payments.
