I’ve heard that chapter 7 is a "liquidation of assets" and chapter 13 is a "reorganization of debt".

I don’t own anything except a computer, two old TVs. Can they take that?

Have lots of debt. Would like to file chapter 7. Can I or will they make me file chapter 13? What are the QUALIFICATIONS or REQUIREMENTS?

with Sallie Mae and my understanding was that it wasn’t dis chargeable. Since that meeting I haven’t made a payment to my student loan and usually when I am a day late i get harassed by them with phone calls to my house, cell and work. I have not been contacted and on my credit report Sallie Mae posted that it was included in bankruptcy. My petition included Sallie Mae so is there a chance that I have slipped through the cracks and my loans could be discharged? I also try to log into my account online to see my balance and it is no longer available and it gives me a number to call. I call and can never speak with anyone. any help on the subject is greatly appreciated.

I’ve just found out today that I am likely to have to file for bankruptcy. I have a chronic medical condition that has required multiple hospitalizations in the past 15 years (cerebral vasculitis), and I’ve just been informed that I’ve hit my lifetime maximum (0K) with my particular private insurance policy, and they will no longer cover my healthcare expenses.

For the previous 5 years, I’ve paid a total of ,000 in premiums to my insurance company. My remaining medical bills total over 0K.

I make too much to qualify for Medicare. My principle professions are per diem nursing and exotic dancing. Neither of these jobs offer group health plans.

I’ve come to a point where I just do not know what to do. I am planning to file for bankruptcy to have my medical bills discharged, but it is not as if my medical condition will go away. I’ve been a per diem nurse, because this particular professional configuration allows me to work when I am well, and does not punish me for multiple absences when I am going through a particularly bad spell of seizures. The same is true with my particular exotic dancing job.

After this – bankruptcy, plus meeting my lifetime maximum in medical expenditures – I will never be eligible for private health insurance again, unless it is associated with a group plan.

So I’m in a quandry. I could potentially quit the dancing career that I love and try to find a full-time nursing job in order to get group health insurance… but this will be something that I find completely unfulfilling personally, and when my health gets particularly bad, I’ll probably be wearing the patience of my colleagues and bosses.

Or I could quit both of my jobs, file for disability and live off of the government and your tax dollars for the rest of my life. The second choice is, of course, easier… and probably the route I am going to go. But I’m wondering if any of you have any experience in this and have better advice?
Palin Power!: You’re right. I do make more than enough money to pay for my anti-seizure meds and steroids. What I don’t make enough money to pay for are the 6 brain surgeries and extended post surgical recovery periods I have had in the past 15 years.
FBH: Thanks. I do speak Spanish. And as a nurse, I can tell you that what you think illegal immigrants are getting away with in terms of healthcare is not true. Hospitals often dump their indigent and illegal immigrant patients, if they don’t have staff that call ICE on them while they’re in the hospital.
No2McCain!P: Don’t worry. I’m voting for Obama, and I registered 67 people to vote this week too. Every single one of them said they were voting for Obama. He may not get us closer to better healthcare, but I do trust his ability to get us in a better place financially and diplomatically as a country. Too bad things are so bad for so many people right now.

Apparently it started out as a bankruptcy chapter 13 however the final paperwork is a chapter 7. Any difference? on the credit report it states dismissed. What is the difference between discharged and dismissed?
** As some answers have suggested that it was bad that I don’t know my own court stuff… first of all, it isn’t mine. LOL… so No i do not know all the specifics with the case. Thanks for everyones help though.

corporation and then do the same thing all over again?

I knew a wealthy family growing up. The father bought the son a small business, and he incorporated it.

He then bought nice cars and other luxuries with the corporations credit. He filed bankruptcy on his corporation bought the stuff from his corporation for a very low cost, and then started a new corporation so he could do the same thing all over again.

Isn’t corporate America a wonderful thing.

I’m from Mass how do I get a copy of my chapter 7 Bankruptcy Discharge paper work. I have all my other papers. The only one I cant find is the One piece of paper that states I was discharge. It was back in 2004 I know that.

Okay. My dad is a selfish manic depressive ass who occasionally takes all the money and flies to Manila to be with an online girlfriend. He does this, and somehow gets away with it, despite being in bankruptcy and under court order not to leave the country. In any case, he has been a financial problem, and other kinds of problems, for Mom, and my family, all my life. IF he comes back this time, I don’t want Mom to pick him up from the airport and play along with him till the bankruptcy is paid off. The lawyer "discovered" 8k additional in debt!! when they thought they were done by this coming December. I live near them to watch over them, but not close enough to have panic attacks all the time over worrying for their violence and whatnot. My brother has moved FAR away coz he wants to kill Dad. My sister is a top scholar at a great university and doesn’t need this junk. I put off my dreams to put her in a good spot, but I don’t know how many more years…coz I want MY dreams now… BUT
But part of achieving them is knowing my mom is in good shape and not in danger from him, and that he is in good shape, not in danger from her. I think, since he is an untreated bipolar, he could go to an institution for rehabilitation or evaluation and help for a little while, but he would prolly charm everyone there and not get helped, coz that is what he does to people, he charms them. Mom and my sister will put him in jail if he does anything "off", but I want him to go to "help" when he gets home, if he comes back this time. Am I being unsensible? Also, should I go ahead and get that extra job….
Or stay out of it and just do what I want. Mom thinks I should worry about getting raises and going up at the work I have now, and forget her.
I’ve tried to get her to move out. She says she won’t coz then she will lose lots of money, that she has to stay on that property till the bankruptcy is paid off and then file for divorce. I don’t know why she is being so stupid about it, when she is smart, when she should just "cut her losses" and move away.

My student loan was listed as a creditor in the chapter 13 plan, so I think that they must have recieved some money from the trustee, (actually I thought that they were fully paid, like the IRS)…now this collection agent is after me for 5,000 which is probably the total amount. Is there some way to find out if they recieved money that I paid throught the trustee??

How long till I can be approved?Hello I filed chapter 7 last year was discharged in August. I recently checked mine and my wifes scores they are both around 595. All the info I am reading online states that it is two years is this true or is it based on your score more than the time since filed. I live in an area where you can buy a fixer upper about 50 miles from the city for about 50,000. Does anyone with experience in this situation know what my options may be do I need to wait 2 years 10 years or could I begin trying to get financed once my credit scores are above 620? My bankruptcy was due to lay off and me being in the hospital for major depression. I was actually told to file for disability by my doctor but decided against it .
I did leave some info out I see . This all happened last year I have since been back to work and already have 2 secured credit cards and my car I am paying on. So 2 years with perfect credit from time of discharge and we will be good to go. My rent right now is actually more than my house payment would be.

I am currently going through Chapter 13 bankruptcy, but I cannot afford to make the monthly payments and continue to pay my other bills. Is it a good idea to switch over to Chapter 7? What is the process that I have to take to do so and how long will it take?

I have never done this before. I have been self sufficient my entire life up until this past year. I just can’t do it anymore. Nobody will hire me for anything. I am over-qualified & underskilled.
Starting fresh seems to be the best route. I will still be responsible for my student loan debt, but at least my credit card debt will be gone. My question is, how do I know who is trustworthy to deal with this. Everyone and their mother does debt consolidation and bankruptcies. Also, I know declaring bankruptcy isn’t free. What do they do if you can’t pay the fees associated with that? I don’t know what other option I have other than not doing anything and going to collections and being harassed over the phone, and that isn’t an option for me. I also have crappy luck, and would love to hear peoples experiences on how they got through difficult financial times after a bankruptcy when a credit card would normally handle that.
Thanks for the response: Just to clarify. My creditors won’t work with me unless I have sustainable income coming in. I could be working for .00 an hour and they would help me. Having nothing means they won’t help. Makes no sense because you can’t get blood from a stone. All I ever wanted from them was a lower payment.

My bankruptcy was discharged 2 years ago and my car loan was included. It was supposed to be reaffermed but the lawyer never sent the paperwork. I have been making my payment, but the company I have the loan through sold my loan to another company that refuses to send me any paperwork or loan info. I looked at this company online and found thousands of complaints. I am worried if I continue to make payment they will still come and take the car. I owe way more on the car than it’s worth, but cannot afford to get another car right now. Any advice?

I have no income, between 20-25k in debt, and no assets other than my car that is falling apart. I feel that it will take me forever to pay off the debt once i start working again. Is filing chapter 7 bankruptcy right for me?

One of my favorite online sources is Yahoo news; I located a story on Michael Vick the suspended Atlanta Falcons NFL quarterback. Michael Vick pleaded guilty to dog fighting charges and now is serving 23 months federal prison time; Vick owes creditors between and dollars (Michael Felberbaum, July 8, 2008, Michael Vick news story). He has since filed bankruptcy protection, to protect himself from creditors.

My personal observation of the Michael Vick case is disturbing to see someone participate in animal cruelty. I do have conflicts with the claims of Mr. Vick filing for Chapter 11 bankruptcy; in the court papers filed he owes estimated .8 million (Michael Felberbaum, July 8, 2008, Michael Vick news story). During his career, he had plenty of sponsors such as Nike and he lost the contract once he pleaded guilty (Michael Felberbaum, July 8, 2008, Michael Vick news story). He signed with the Atlanta Falcons and received a million signing on bonus. He was suspended indefinitely and without pay from the Atlanta Falcons once he pleaded guilty on dog fighting charges. I feel that he should be held responsible for paying his creditors regardless of his imprisonment. I think Michael Vick still has money and he is tying to save some of his assets until his release from jail.

My dad is in heavy debt; approx. k. He is considering about filing a bankruptcy. What happens before, during, and after he files a bankruptcy? If he hires a lawyer, what are the fees? How would this affect our lives? And we already live in an apartment, are they going to kick us out? Please keep it in simple terms. Thank you.

Ok for one of my social studies classes I have to write a debate to be pro healthcare im not really pro i dont know anything , here it is:

Pro Health Care Reform

There has been so much buzz about health care recently and as you may know Obama is the leader of it, we are here today to convince you to be pro health care
First we have two true stories about people who’s problems could have been fixed by health care:

The first is about a woman named Lori Hitchcock. Lori is currently self-employed and trying to start a business, but she has hepatitis C, she cannot find an insurance company that will cover her.
The second is about a man who lost his health coverage in the middle of chemotherapy because the insurance company discovered that he had gallstones, which he hadn’t known about when he applied for his policy. Because his treatment was delayed, he died.

This is happening to more and more people every day, so that is why we need to pass health care reform know.

There are four main ways the reform will provide more stability and security to every American.
1.If people don’t have health insurance, the reform will give them a choice of high-quality, affordable coverage for people and there families. This will be high quality coverage that will stay with users if they move, change jobs, or lose there job.
2.Reform will finally bring sky high healthcare cost under control, which means real savings for families, businesses and our government.
3.The reform will make Medicare more efficient, so the government will be able to ensure that more tax dollars go directly to caring for seniors, instead of just putting the money into the insurance’s pocketbooks.
4.The Health Care plan will also reduce the amount our seniors pay for their prescription drugs.

Some of the statistics of Health Insurance are:

1.nearly 50 million Americans don’t have health insurance
2.25 million are under insured
3.that number has grown nearly 60% over the past four years
4.the amount people pay for health insurance increased 30% from 2001 to 2005
5.the income only increased 3%

The health care reform will help lower prescription drug costs for people in the Medicare Part D coverage gap so they can better afford the drugs they need
The health care reform will also strengthen the financial status of the Medicare program
The president and congress have committed to producing legislation that will be paid for so it won’t saddle our children and grandchildren with debt
If we do nothing the share of your income spent on health care will nearly double in the seven years

In the end. When one in three Americans say someone in their family skipped pills, postponed or cut back on needed medical care due to the cost; when countless bankruptcies are related to medical expenses; when the number of uninsured approaches 50 million; when government spending on health programs rises so rapidly that it jeopardizes other priorities; and when employers struggle to pay for the cost of health care, the fact is we can’t afford not to fix health care.
