This is an individual filing. I have had debt counseling and told that I need Chapter 7 because negotiating won’t help.

I am currently a full time student and we are looking at filing a chapter 13 for other debts outside of my student loans. I am wondering what effect if any this will have on my ability to gain new students loans, just the stafford subsidized and unsubsidized? Also, I paid my lawyer 800 to retain him for this bankruptcy , can I back out and get a refund? I am in washington state if that makes a difference.

That ruined their credit record could avoid the same judgment that people often induce upon those with bad credit for other reasons than I.D. theft?

It seems after I filed Bankruptcy, my credit is still anything but good, and I often get judged according to that in the dating world. When women I date find out that I have filed Bankruptcy, and have bad credit, they instantly dismiss any possibility of being with me at all.

Should I accept the fact because of my ex, I will spend the rest of my life single?

I am thinking about buying season passes for SFGA, but all the horrible reviews online are giving me doubts. Everyone says the park is horribly crowded with 2hr+ waits for the major rides, has trash all over the place, rude employees and guests that resemble hooligans more than amusement park goers.
Six Flags Corporation is current in bankruptcy reorganization. I am sure that is further complicating management of the park. Has anyone been to SFGA recently. How bad is the place?
I would also like to know how long is the season pass valid for.

The park opens on select weekends in Nov. and around Halloween. Is the season pass good for these?
I live about 1:30 away from SFGA
2:20 away from SF:New England
and 3 hr away from Great Escape.

How can we convince employers to keep their production in our own country? Maybe a nation-wide boycott of a luxury product would help. By that I mean, toys, autos, electronic equipment, or whatever. I know it costs more to manufacture here, but the greed at the top is pretty extravagant. Middle and lower classes in the U.S. are struggling, while the rich get richer. I pity the thousands who can’t affdord the mortgages on their new homes. Bankruptcy is at an all-time high, according to the L.A.Times. I know, bad loans. Any ideas?
Hmmm….some very conflicting answers…I’m not advocating anything communistic…just jobs, for instance, for Detroiters who keep losing their jobs in auto factories…just an example!

I was told that one can do what is called a ‘cram down" when going through a chapter 13 bankruptcy.

What was told me, was that it is a means of driving down the price of what is owed as face value of a property when dealing with a lender.

What exactly is a cram down and how does it work?

Need a loan for around 1,200 within the next two weeks, need a legit online lender as I have already tried credit union and my own bank and was turned down by both. I had a bankruptcy 6 years ago.

I will try to make this as short as possible.
I had a baby at 17 years old (was cautious, and the condom broke). Come from an abusive family, my mom signed away her parental rights when I was younger, and my dad was and is an achoholic. Both were physically and emotionally abusive to me. I have a verbally abusive husband whom I have been fighting with sooo much lately. In my recent past, I have filed for bankruptcy, been struggling with money to provide for my son. I come from a huuuge family, and most of them are backstabbers!
I take medication for Severe anxiety, panic attacks, and chronic depression, and today my life gets even better….
After another fight with my husband, I went to pick up my son from school. On the way back, WHAM. I get sideswiped in my 2007 Toyota that I have to pay through the butt for now to get fixed. We are barely able to support our family (myself, my husband, and I). And now this! This wasn’t even my fault.
I just dont think i want to continue on with my life sometimes. I am only 28, and have been through all this stuff. I can’t handle any more. I keep trying to find the good in things, and I feel like I can no longer do this anymore. Whats the point?
I told my husband what happened and he is pissed because now this is another financial obstacle… I just dont think I can do this anymore..

I am in bankruptcy due to a divorce and job loss. The trustee has asked for a recent mortgage statement. I do not receive paper statements, but receive them via email. I went online to print out some statements and could not access them, so I called and was told that they could not send a copy of a statement because it would look like they were trying to collect a debt. (I am not behind on my mortgage). I am asking for May and June statements. The trustee is demanding the paper. Any suggestions?\

My apartment lease is up and thinking about moving to a cheaper place. Will that affect my disposable income and the trustee ultimately takes what’s left over?

I decided to walk a way from my house after filing chapter 13 a year a go. I no longer can pay the trustee neither my mortgage. i will conver to chapter 7 but I won’t because as some one told me that I can stay in my home longer if I wait on converssion. can any one tell me what I should do in order to stay longer in my house( I am unemployed by the way)

I get letters from creditors offering to settle my debts for a lower amount. I owe about ,000. Some debts have been charged off and I don’t know who to contact now. Doesn’t it still hurt your credit to pay off the debts anyways? Isn’t Chapter 7 just easier? Please help from anyone who has gone through Chapter 7. Thanks!

I’m from Texas where credit card companies (UNSECURED DEBT) can NOT put a lien on your home or sieze assets (unless purchased with said credit) so they don’t even bother getting a judgement against you. However, I know in NY credit card companies can actually put a lien on your home so they will definitely get a judgement against you.

We got way off track and have credit card bills that are way behind. Almost all are in collections. We believe we can get back on track, and don’t want to file bankruptcy yet. We’re moving to Hawaii for a job, but I’m wondering if anyone has any info or can help me find some online somewhere (I’m lost) about the creditors’ rights.

I know someone will tell me to contact an attorney in Hawaii, but it would be great if someone knew.

I live in Michigan. I filed Bankruptcy Chap.13 and was basicially denied, cause the monthly repayment plan would not leave me with much money to live off of. Now my house is going back into Foreclosure. My lawyer suggested that if I want to keep the house I could pay what I owe (about 13,000) and can keep making payments. Or I could surrender my home up to Chapter 13 stay here for about 8 months and save my money to put down on another house. What are my options at this point? Am I able to stay here and save some money for 8 months to a year, after foreclosure with out being kicked out? Are there any more options that I may be able to use? Thanks for your input.

I am considering filing chapter 7 bankruptcy. I have 3 major credit cards, all of which have been charged off and added up have a balance of roughly 20k with interest and attorney fees. I also have some other random bills which have gone to collection: cell phone, utility bills, medical bills, etc, that add up to about 3k. I also owe about 10k in back taxes to the IRS, which I’m not sure if this could be included in the bankruptcy? I have made some mistakes in the past, living beyond my means and am much more educated and mature now and would like to get my life and credit built back up.

1. Is bankruptcy a good idea for me?
2. Can taxes be included in a bankruptcy?
3. How long does it take to get my credit built up to say a 650-700 credit score after a BK and are banks willing to give you a loan if they see you have a bankruptcy, even if your credit score is good now?

I worked for a mortgage company in 2003 and we would give someone a loan the next day after a BK discharge. I know things have changed but any insight in today’s credit market and how a BK is viewed by creditors in 2009 would be very helpful. Thanks

My checking account with a bank is currently overdrawn by 0 because they paid a check my wife wrote at walmart. I don’t use this bank anymore and already have checking accounts at 2 other banks, and my wife and I just filed bankruptcy and I just don’t have the money to pay them back. I assumed when I found out she wrote said check that they would return it and then they would do whatever they do with a bad check. So what would happen with the bank deal would they just send it to collections, or would they actually sue for that little of an amount, and if so would I be given a final opportunity to pay it before they brought suit. Any advise would be appreciated, and please don’t give me answers about me being a deadbeat, I filed a chapter 13 bankruptcy and am actually trying to do right by the people I owe money to its just that my wife one day decided she would go write a bad check for stuff she didn’t need without telling me, and now I’m stuck with this with no way to pay it back. So i’m just trying to find out what would happen if I didn’t pay them.

Car accident, judgement and bankruptcy (florida state)?
QUESTION I WAS IN A CAR ACCIDENT LIKE TWO YEARS AGO IT WAS MY MOM’S CAR AND I WASN’T N THE INSURANCE… WELL THE ACCIDENT WASN’T BIG NO WRECK NOTHING HAPPEN TO THE OTHER DRIVER AND PASSENGER NOTHING HAPPENED TO THE NEITHER OF OUR CAR… I MOVE NOTHING BIG HAPPEND ALL OF THE SUDDEN I LOOK AT MY ANNUAL CREDIT REPORT AND I SEE THAT THEY ARE SUING ME FOR ,000 THOUSAND DOLLAR NOTHING HAPPEN TO ME OR THE PASSENGER THAT WAS WITH ME SO THAT’S WEIRD I KNOW FOR SURE THAT NOTHING HAPPEND BUT ANYWAYS THEY ARE SUING ME I NEVER RECEIVED A SUMMON SO I WENT ONLINE AND LOOK AT THE COURT CASE AFTER I SEEN IT ON MY CREDIT, THE PLAINTIFF WON BECAUSE I NEVER RESPONDED A SUMMON WHICH I NEVER GOT, I CALLED THEIR LAWYER AND THEY SAY THAT I’M LATE ALREADY, SOMEONE TOLD ME THAT I CAN TRY TO GO ON BANKRUPT BUT CAN THEY TAKE MY INCOME TAX RETURN EVEN IF I GO BANKRUPT TO PAY THE SUIT. AND ENSURE AFFORDABLE, ACCESSIBLE HEALTH COVERAGE FOR ALL
Health care costs are skyrocketing. Health insurance premiums have doubled in the last 8 years, rising 3.7
times faster than wages in the past 8 years, and increasing co-pays and deductibles threaten access to care.1
Many insurance plans cover only a limited number of doctors’ visits or hospital days, exposing families to
unlimited financial liability. Over half of all personal bankruptcies today are caused by medical bills.2 Lack of
affordable health care is compounded by serious flaws in our health care delivery system. About 100,000
Americans die from medical errors in hospitals every year.3 One-quarter of all medical spending goes to
administrative and overhead costs, and reliance on antiquated paper-based record and information systems
needlessly increases these costs.4
Tens of millions of Americans are uninsured because of rising costs. Over 45 million Americans5—
including over 8 million children6—lack health insurance. Eighty percent of the uninsured are in working
families.7 Even those with health coverage are struggling to cope with soaring medical costs. Skyrocketing
health care costs are making it increasingly difficult for employers, particularly small businesses, to provide
health insurance to their employees.
Underinvestment in prevention and public health. Too many Americans go without high-value preventive
services, such as cancer screening and immunizations to protect against flu or pneumonia. The nation faces
epidemics of obesity and chronic diseases as well as new threats of pandemic flu and bioterrorism. Yet despite
all of this less than 4 cents of every health care dollar is spent on prevention and public health.8 Our health care
system has become a disease care system, and the time for change is well overdue.
OBAMA-BIDEN PLAN TO PROVIDE AFFORDABLE, ACCESSIBLE HEALTH CARE TO ALL
Barack Obama and Joe Biden’s plan strengthens employer–based coverage, makes insurance companies
accountable and ensures patient choice of doctor and care without government interference. Under the plan, if
you like your current health insurance, nothing changes, except your costs will go down by as much as ,500
per year. If you don’t have health insurance, you will have a choice of new, affordable health insurance
options.
Inefficient and poor quality care costs the nation at least to 0 billion every year.9 Billions more are
wasted on administration and overhead because of inefficiencies in the health care system.10 And given current
trends, this problem will only get worse as health care spending is expected to double within the next decade.11
A growing body of research points to substantial opportunities to improve quality while reducing the costs of
care. Health care systems in many parts of the country deliver high quality care to the populations they serve at
half the cost of other equally renowned academic medical centers in other parts of the country.12 The key is to
provide information, incentives and support to help physicians and others work together to improve quality of
care while reducing costs.
Barack Obama and Joe Biden believe we must redesign our health system to reduce inefficiency and waste and
improve health care quality, which will drive down costs for families and individuals. The Obama-Biden plan
will improve efficiency and lower costs in the health care system by: (1) adopting state-of-the-art health
information technology systems; (2) ensuring that patients receive and providers deliver the best possible care,
including prevention and chronic disease management services; (3) reforming our market structure to increase
competition; and offering federal reinsurance to employers to help ensure that unexpected or catastrophic
illnesses do not make health insurance unaffordable or out of reach for businesses and their employees.

stored on paper, which makes them difficult to use to coordinate care, measure quality, or reduce medical errors.

Biden will invest billion a year over the next five years to move the U.S. health care system to broad
adoption of standards-based electronic health information systems, including electronic health records. They

I have mounds of credit card debt, a car that I owe more then I could sell it for, and a house that is in the same condition – and our income has taken a hit and I can no longer afford to make payments.

I am considering Bankruptcy. What would happen to all this debt? What are the major differences between Ch.11 and 13?

My boyfriend tried to apply for a credit card at capital one, and he got rejected. He tried taking out a loan for a home, and got rejected. He recently went online to annualcreditreport.com and pulled all of his reports off of there, only to find that his fathers debts were on his credit report because he and his father have the same name. We know his dad did not use his SSN or birthdate to create these debts under his name though, because he himself is going through bankruptcy trying to get these debts cleared off his name. So what were wondering is who do we hold responsible for it? The credit card company? the credit bureau? and what do we do about it?

We know that we can get this removed off his credit report, but were not sure of how to go about things.

& should we be compensated for the troubles he had to go through because of the times hes been denied.

If we decide to take this to court, should we get an attorney?
BTW Bruce, his FATHER is filing bankruptcy, not the son. I know he isn’t lying because I was present for all of it.
