My husband and I file for Chapter 7 Bankruptcy last week. Do we have to wait until the bankruptcy is discharged until we can file for divorce? If it’s possible to file for divorce before the bankruptcy is discharged, how long must we wait to file the divorce?

My fiance and I are getting married in less than 2 months. He was rear ended at a red light (the other person was texting on his phone and traveling 40 mph) and is currently being treated (and we have a lawyer). He’s in so much pain that he’s on oxycodone and is attempting to go to work when the pain is not so bad (since we have a mortgage to pay and all).

I am very afraid that the people that hit us have minimum insurance coverage (k). We’ve been doing medical liens for our doctor visits. We do have medical insurance but they won’t pay anything until we make a try to make a settlement with the person that hit him.

If we sue them, and they declare backrupcy, will we have medical debt collectors coming after us or will that go away with the other person’s bankruptcy? We are paying every cent to try to knock out our student loans at super high interest rates…I have no idea what I would do if we would have to pay the entire cost of his upcoming surgury and treatments.

We are trying to get debt free and live a respectable life. We do not want to get rich from a settlement…simply pay for our losses.

I live in Illinois and have been in Chapter 13 bankruptcy for over a year.
Cheryl G. – They said today this would be filed on 12-31-09. If I were to bring my account current before then, would they still be able to follow through?

I lost my job, that is how I got behind. I am now getting back on my feet and will be able to pay on time each month starting in January. The mortgage company was very mute when I asked these questions today.
Frak 1A12- I haven’t received the document, nor has it been filed yet, that was my reasoning for asking.

my husband and i own a house but we are 1 1/2 months behind, in the middle of filing chapter 13 bankruptcy, I recently just found out my husband has been lieing to me about money and that he has a problem with cocaine. He made an appointment for outpt counseling, but I feel like all my feeling for him are gone and want to separate. but here is the problem, We obviously are having a hard time keeping up with payments ourselves, I cant afford it by myself niether can he. He doesnt know how I feel about him. I cant afford a foreclosure and the market is bad so even if we sold the house we’d be in a bind because we wouldnt get close to what its worth. what do i do. im very unhappy.
I have a 3rd shift job and he threatens to get custody of our kid, my parents said that no one can move back in no matter what their circumstances are

i’ve asked this before and after making a decision was ridiculously displeased. it’s no secret blockbuster is near filing for bankruptcy, and their shelves show it. new games often get a copy or two in and games are often difficult to get. a large variety of games aren’t carried as well. after likely over a decade of renting through blockbuster (eventually getting their monthly plans,) i attempted blockbuster online. i got it a week ago and haven’t received a game yet! to add, new games take over three months to become available online. i rented a fairly unpopular game from nearly 2 years ago as well as a game from 6 years ago while waiting to cancel my service. they claim said game from 6 years ago is at my house, and that the game from 2 years ago has a ‘waiting period.’ all newer games had a longer waiting period and this means of renting games sounds like a huge rip-off. i’m switching now to gamefly, but i’m fairly pessimistic at this point, as i hear negative feedback about gamefly as well. so i have to wonder – what is the best way to rent video games at this point?! new games are necessary to have available, speed is a priority, willing to pay (give or take) around what blockbuster was charging (about 23$ per month.) provided the service is quality, two games out at a time would be ideal, one would be acceptable if the service was exceptionally speedy. i live about 3 hours from pittsburgh (which happens to be where most rentals are shipped out from. netflix, gamefly, etc.) i hear from there to here would take 3-5 days. also, the more consoles (including older ones) offered, the better, as i still use and have a variety of systems plugged in along-side the new ones.

and I owe around 66 on it. I am in the process of trying to buy another car. I understand I hv 2 find one under ,000 and the trustee has to approve it. My question is, does the new car go into the bankruptcy or will it be a totally different payment? Please answer only if you hv been in chapter 13 or are familiar with the legal issues. Thanks.

I am nearly 000 in credit card debt total and I am unable to pay my bills and I am looking at filing bankruptcy, but I don’t know if it is a good idea to do? I also wanted to know what company is the best for filing bankruptcy. I know that after I file I wouldn’t be able to get an apartment or a car or a job due to me being a bad risk of getting anything, but I wanted to know how much does it cost to file bankruptcy and is it a one time fee payment or is it per month? Please help me. I really would like to get a fresh start and have my life back again. Thanks so much.

Beware of mortgage servicing companies! They never paid the property taxes and have accelerated the loan and loaded it with misc. fees. I am considering Chapt. 7 bankruptcy and will surrender the house because there’s no way I can pay the current loan now (it has almost doubled). Will the deliquent taxes attach to the property after bankruptcy or will I still be responsible for them?

I let my bestfriend drive my car. He got in an accident and now I owe the other driver ,380. We decided to go outside of insurance due to the fact that this is my father’s car and I can not tell him what happened. My father is of an old background and very distrusting. He made me sign and have notorized a piece of paper saying I will not have anyone else drive this car. Well, because of the kind hearted ness I have for my bestfriend I let him drive while his car was in the shop. Bad move. Now I have no money and I need to pay this other driver. She has my insurance information. She’s been nice so far but i can not make a promise i can not keep. I can not tell my father because he will take his car back and not have any interaction with me again. I am not over exaggerating: my father has already not spoken to me for one year because I cosigned a car for a friend. The only reason my dad (along with the rest of the family) started talking to me again was because my grandma died. Can I tell the other driver to call her insurance company and tell her it was my fault and have them sue me individually…then add the bill to my chapter 13 bankruptcy? Or should I just strip or something to make the 2300 dollars. Please help.

Hi, I owned a business a few years ago and it went belly up. I was forced to close shop and was left with major debt to deal with. I settled some of my business credit cards, but my current situation is:
- I have a small business administration loan (SBA) for 0,000. They got a judgment against me and I’m trying to work out a payment arrangement with them
- I own four houses but they all have liens on them from the SBA
- I have 30-50k in credit card debt
- I owe k in taxes to uncle sam
- I owe about k in property taxes

So, all in all, everything is great. :) What I’m looking for is help on how to find a trustworthy person/company to work with to help me through my possible options, but bankruptcy to other measures. It’s so hard to find people online who aren’t trying to swindle you. Any help you can offer for finding the right people or even the right category of person would be greatly appreciated. Not sure whether I should be going to a lawyer or financial adviser or some combination.

Is there anyway as an Independent Student I can qualify for 0 efc. What is the AGI that I should shoot for (15k-20k)?

Less than 4k in income for the year, but I received 20k in a settlement, which is taxable. I will need to pay Uncle same over 3k of my settlement and most of it went to payoff car and personal debt for myself and my parents. My parents can not contribute to my education cost.

I’ve been going over my tax info and laws and I’m trying to get my AGI low to in turn get my EFC low or zero… Any thoughts?

My parents filed bankruptcy so they can not cosign for a student loan and I am aware of all the FFELP loan options. I’m mostly focus on my efc so I can increase my PELL and FSEOG eligibility.

my dumbass husband put us into chapter 13 bankruptcy because he was blowing all our money literally up his nose, he admitted this to me almost 2 years ago and had been keeping this coke habit a secret for years. well now he’s doing it again, money missing late on or mortgage again, and his sister actually told me today that he stopped by her house today and used her bathroom and was in there for a while and blew his nose befor he left, then she went in there and found a little tiny bit of white powder (shes been suspicious too) and her boyfriend tasted it and said it definately was coke. so now that i know for sure he is doing it again… his family is going to do an intervention and get him into a 90 day rehab. well i cant afford this house on my own we cant even afford it together. so what do i do? we have 2 kids and 2 dogs. it kills me to take my kids home away from them and what about my dogs? we love them. i hate my stupid husband im soo mad!!

What do you do to fix your life when you’ve had to file bankruptcy, a teen turns to heroine and steals everything (but is 26 now-living away)– too little too late now – all gone, you lose your home after cancer, you’re working very hard, you owe a lot of money to a lot of people, your cars keep breaking down, you owe the IRS, you have no health insurance, you lose your job (lay-off) and can’t pay car insurance, car insurance lapses and then you can’t get new insurance because it costs MORE because you "let it" lapse, you can’t get ahead because bad bad things keep happening – for years and years and years (not a new thing), you are feeling helpless and hopeless. There’s no help out there because of course you "make too much money" for assistance. No family to help (you don’t want to take from anyone anyway) and you are afraid to wake up every morning? Plus you have a wonderful teen who deserves the WORLD and he’s gone without for many years himself because of everything?

2. I am not the drug addict – my son was. There was a lot of advice about 12 step programs and don’t do drugs. THAT ISN’T MY PROBLEM. I’m NOT asking because I’m feeling sorry for myself. I’m explaining HOW THINGS GOT BAD and wondering how I can get out is all. "Twiddle your thumbs and feel bad for those without thumbs?" First of all, I’ve been one to give my last dollar to a hungry man on a street. The answers I was looking for were some positive real answers from possibly someone with background in this type of thing. I’m looking for real answers – not for you to feel sorry for me. The praying part IS A GOOD ANSWER – and hearing others stories help too (thank you). But the rest of you, if you are going to answer the question, read the question.

Before I got my braces on my ortho told me I would get ,000 back after 3 years through this company. Well, 3 years has passed and I was online researching how to get my thousand dollars I was promised back…and turns out that company was a scam and they filed for bankruptcy. So, now am I out one thousand dollars? Should I complain to my ortho? I think he should compensate because he promised me this company would give me a thousand dollars (that’s partially why I chose his company to put my braces on.). What can I do? Thanks.

I am considering chapter 13 bankruptcy, so what does that do to my brother, I am fully responsible for the vehicle financially. But I would never do anything to jeopardize my brother or his credit.
My brother is the primary borrower because my credit was not stable enough to support it, we have some other debts so we are considering Chapter 13, so I really need to debt out of his name because it’s not his car and I make the payments. I do NOT want by brother effected in any way from our mishaps!!
Basically, if I file for bankruptcy, he will be responsible for the payments which I will continue to make, but I won’t benefit from a re-affirmation of debt with lower payments because I am only the co-borrower.

I filed for Chapter 7 in Oct 07, and got the discharge in Jan 08. In the chapter 7 I chose to just turn the house over to the bank. Now, the bank is going thru foreclosure. Am I obligated to pay the property tax? How do I respond to the foreclosure to avoid paying, since I already moved out and decided to give up the house?

My husband and I are buying a house and are in Chapter 13. A month ago he had an affair with some chic and wants me to move out, give him the house and have me file Chapter 7 while he keeps on with the Chapter 13 as if I hadn’t helped him make these payments for 3 1/2 years.

Now, today I called my bankruptcy attorney trying to find out what was going on. The partner I usually speak with has been unusually rude to me since hearing that husband and I have issues. I suddenly realized that the problem may be the fact that the partner is a relative of my husband’s mistress. The last names are the same. The partner is her aunt, has always been nice but is now very rude and I found their names together in an online obituary for a relative.

Now, she is a witch. Conflict of interest? What should I do?

I borrowed money from a high interest lender in Tulsa, Oklahoma. The loan amount was approximately 0 and I have defaulted on the loan because I simply do not have the means to repay it.

I will be in court Monday morning and I’ve been told that since it is small claims court that I need no attorney.

Still, I’m not even sure what I should say. Do I plead guilty? No contest, not guilty?

If I plan to file chapter 13 bankruptcy in the next month or so should I inform the judge or the plaintiff about that?

When you answer please feel free to answer more than what I have asked here. I need to be as armed as possible since the plaintiff (the loan company itself) spends a good deal of its time in court collecting and therefore has ample experience in this forum. I however have never been sued and never been in court as a defendant or plaintiff so my experience could not be more limited.

In your response if it is possible for you to give me a way to either message or email you, that would be much appreciated.

Can someone answer this for me. We would be eligible to file for a chapter 7 bankruptcy in a couple months. My question is If we filed for a Chapter 13, BUT it has not been approved by the trustee and payments have not yet been sent to creditors, then would I be able to stop the Chapter 13 and just get a Chapter 7 instead???

This is really eating me up! I am a store manager and my wife is a nurse, we have two children a decent home, decent cars, never really vacation, no toys. We also have bills and pay our bills, no credit cards, save 20% of our pay, work hard, have our own health insurance.
Now I have two brothers that are different then I am but always have way more.
My oldest brother Todd, they have a huge house two luxury cars, go on nice vacations. They made a bundle of money flipping homes lived the high life until the real estate crash so a year ago they are broke had like 250k in debt, but a home that’s half pd for and cars pd for. They went to Europe and then filed bankruptcy right after that trip and now a year later they are living the high life again they just got pack from Disney World where they got the platinum package.
Now the other brother Dan he loves his government handouts, They have 2 kids and ever since there 1st was born they have been on state sponsored health insurance plus food,heating assistance, big tax returns and a government loan modification. My brother did have a job as a plummer and got promoted to a journeymen a year and a half ago due to the income increase the government handouts went bye bye until he was layed off a year ago. He got layed off he was happy now he figures with the handouts and unemployment extensions will make more then what he was making while working. Now to make matters worse he dose cash side jobs so in a year they bought a camper, trip to Alaska, ATV’s, Jet Skis, but here again there furnace went out guess what they got the govenment to pay for a new one.

We where not raised this way at all and after finally vented to my father about this he is dissapointed in both of my brothers and blames the system and there wives.

sorry for the vent I was wondering if this is a real case.
