I was served yesterday legal papers that I’m being sued for less than ,000.00 by my creditor, first I’m unemployed, I looked up online and found a lawyer that charges 50 for filing bankruptcy, I need to know the best option and plus I don’t have any money! they only thing I own is my car which is been paid off, I know it sounds like a radical question but how are they thinking of getting paid by me when I don’t have any assets? are they trying to take away my only property which is my car? and plus I can borrow money from my mom( I’ve been living with her)(her salary is approx: ,000 annually)(since I’ve looked over the fact that they see if you’re living with someone they might take them responsible as well!)(so she can’t be because we’re already below the minimum salary rate) anyways my radical question is should I even get bother by it? I mean they can’t get anything off of me! I’m flat BROKE! my bank account is even overdrawn by thousands! and since if you’re answer is yes<< (you are being sued so start the PANIC ALARM) which is best? and do attorneys from nonprofit organizations do the same work as an attorney who gets paid some 00 ? (I mean if it’s him charging me because he will go to court and file my papers and stuff..)(hearing meeting is %100 me<< so I’m wondering to go cheap with it to prove to the court that I AM BROKE for real! or borrow money and pay the lawyer! which is best?

I’ve had to drop out of college. (Devry)
For many reasons, but one main one being that I felt (and experienced) that Devry is a very inadequate school and promises much more than they can give.

Firstly, they trapped me with the "If you drop out of school now, you’ll have to start repaying your loans the day after" which scared me into staying longer. (I was 17 at the time)

After being unable to stand the garbage education they were giving me, I decided to drop out. After dropping out, I was slapped with a 36,000 bill with nothing to show for.

After not being able to pay off 7 different loans at 0 a month each, I consolidated.

I still cannot pay what they are asking.

Can I get these bills discharged in a bankruptcy?
Especially after they were consolidated?

I feel I was wronged by Devry and lost 3 years of my life with an enmormous bill to boot currently working jobs making less than an hour. It just doesn’t seem right that I have to pay for absolutely nothing.

I filed a Chapter 7 in June 2007, with intent to reaffirm 2 both vehicles. After the discharge came back on August 20, the creditor has billed me for one and contacted me regarding it, and I’ve made it current. The second, they’ve never billed and when I’ve contacted then today, October 29, they told me that that account is showing as part of the discharged bankruptcy, and not as being reaffirmed. My question is, what does that mean as far as that vehicle is concerned. Has it been written off, as it was never contested by the creditor? There was never a billing sent for it, a call made about it, or the ability to make a payment through them online for it (unlike the first vehicle).

I filed for a chapter 7 five years ago and I was wonder how long I had to wait if I wanted to file again?

This year we went under on our home based business! We filed chapter 13 on September 15 2010! We filed on our credit cards and other non secured debt, but left our 1st and 2nd mortgages off! What I mean by off is that we would be paying directly to the lender and not through the trustee off the court! I thought that we were current with our first mortgage; I knew that we had gotten behind on the 2nd but caught up before filing chapter 13! To make a long story short I didn’t find out until I went online and checked our past bank statements that we were behind on the first mortgage! We are still current on the 2nd but the first is looking at foreclosure! We did receive mortgage modification forms sent to us by the mortgage company the other day! We didn’t ask for them they just them to us! My question is if the mortgage company decides to foreclose will this be grounds to have our chapter 13 dismissed?
@ Real, I have ask my lawyer and he didn’t think that this could be an issue! But I would just like some other knowledgeable people’s opinion on this!

Social security is already insecure by Government.

Because the market is down the naive are out in abundance with statements about how lucky everyone is to not be able to invest their own money…but let me remind you, while the markets may be down, it is the Social Security fund that is teetering on bankruptcy.

Also, there has never been a 30 year period in the history of Social Security where the S&P didn’t completely blow away the returns on Social Securuty (look it up)…even if you were 100% in stocks today, having started 30 years ago you would have more money than Social Security delivers.

No one would have lost all their money. Its Always been conventional wisdom to convert most of your investments into safe stocks and bonds 5-10 years prior to retiring, so if you were invested 100% in the market and prepared like everyone else for retirement, you would be just fine.

Low cost, no load index funds such as Vanguard and Fidelity have excellent retirement funds that beat social security hands down.

If we privatize social security, we balance the budget.

Don’t let the naive, uneducated, or down right ignorant people fool you, a guaranteed 2% return built on a Ponzi scheme is not a good deal.

of the car getting repoed? How long will it take? Does the Trustee have to notify my dad? I cant afford to pay the car. Its either pay the car or live on the street with my 3 kids.

I have heard that creating a living trust might not protect me nor my assetts, particularly if I’m a beneficiary to trust designee, and the one that created the trust. I have 2 kids that I could gift the cash to. Can a lender/creditor come after my kids assetts since they are minors and I’m the custodian of their bank accounts until age 18? I’d really like to find a way to shelter and protect my cash savings (about ,000) that I have worked all my life for, rather then letting a crappy housing market wipe me out in a span of 2 years. I live in Arizona by the way- if that helps. I have never filed bankruptcy, and I always pay my bills, but if i had to foreclose I do NOT want to lose my last and only means of getting myself back on my feet. I fought so hard for so many years to save. Thank you for any advice.
Thank you all for the great advice. I should elaborate as many are thinking "What’s the problem since i have K in cash?". I bought in Jan 2006, & opted for an IO loan for 5 yrs to keep my payment low & save cash to complete a divorce settlement, get a new car, and get my life back on track. I got a really cheap used car with 100K miles & settled the divorce favorably. Since then, my home value slid downward over k. To refinance & return to 100% loan-to-value, it would eat all my savings; & that’s only if someone would lend to me. In hindsight, it was a bad move to buy. I should have probably invested the cash up front to get a fixed loan. Now I’m afraid with all the talk that values will slide another 12%. I dont think I can recover a 30% loss within next 3 years. Thus, when my loan resets, I’ll be upside down & unable to afford the new payment, & Foreclosure would be an option on the table. I just want to protect what is left if I can. I am now 27 years old, I have owed probably about 6 companies a total of mabe 6-8 thousnad dollars since I have been 18-19. I went online and checked my credit report and I saw that all of my old debts are not on there. the only debt is a lawfirm that is suing me for, 00.00 My dad said "after a certain amount of time they will be written off". What the hell is a write off and what really happened to my 00.00 in debt??
and can i still file bankruptcy because that is what I really want to do>

My "ex" entered into our online relationship with the sole purpose to SWINDLE me out of thousands. During the course of our relationship, she used marriage to enter the U.S.A. and continue her CON. Since she never intended to be in a real marriage (stopped living together after 9 days), and the authorities will rule it an "invalid marriage"……….will my health insurance company ALSO deem it grounds for demanding full restitution for ALL the bills they paid on her behalf (under false pretenses)?

NOTE: She has also filed "False Insurance Claims" months after our divorce, and the Insurance Company is demanding their money back on those claims already.

Will I be held liable for HER deceptions??? I have already been TAKEN for thousands by her, and now face Bankruptcy.

She has been divorced 10 years, raising her daughter (12) as single parent-my oldest sister supports her by allowing her to live free on her farm, she hasn’t worked for 5 years, says she doesn’t want to, always says she feels terrible to be a mooch but always asks us for money-is living in near poverty, declared bankruptcy, living off small child payment from ex and handouts from family. I love her, she is a gentle person and was not like this in her 20s. Then she gained a lot of weight, started complaining she had health issues, said she hated her office job, refused to look for any other work – I have tried to think of everything to motivate her, she has no savings, no future, I’ve offered her jobs, she just invents excuse after excuse-my back hurts, my hands hurt, I can’t hold a pen to write-ridiculous stuff. She started 8 or so years ago being a real clean freak but it’s escalated, I wonder that she is OCD but she won’t admit that or depression-she is isolating herself on farm, won’t come to family holidays/events like Christmas, says she can’t afford it but has admitted to me she can’t stand being judged. I am the closest to her, I feel the burden of not being able to make her stand up for herself and make a life, when her daughter leaves for college in 6 years where will she be? no child support then.

Lately she feels that the family (we had alcoholic, abusive parents but we ourselves have escaped that fate) is under some generational demonic curse, where did that come from? I have had some frank discussions with her regarding religion, we are both Christians but she is taking a weird angle on the whole thing, says only God will provide for her but in reality it’s the family paying for food and propane and everything. Please is anyone else’s adult sibling like this and if so, what can be done to help? I am angry but I love her and feel so helpless.

I live in a big town that has only Petco and Petsmart for pet shops. I have been seriously considering opening up a aquarium shop here. The town has about 50,000 people, with many small outlining towns that have 3000 in population each, in a 50 mile radius. There are two other aquarium shops about 40 miles away, and in the oldest one, the old man has gotten to old to care for it, and his tanks are always gross, and the fish are always dead, or sick. In the other aquarium shop, the man specializes in saltwater fish, so I feel like I really have an edge knowing freshwater fish extremely well.

My problem is, is that I am 21 years old, and I have no credit. I had some medical bills that put me into debt, but now that those are paid off, I am starting fresh. There are a lot of aquarium enthusiasts around here, and the hardest thing about this area is the fact that for both fish, and fish tank equipment, you have to go 5 hours to the big city to be able to get anything decent, or have any variety, or you have to order online, which makes things incredibly expensive. I also know that fish tanks cost a lot, but would it matter if I used pre-used fish tanks in my shop? Oh, and are there any types of banks that would give out small business loans for this? and in my situation? I don’t have any kind of savings, as my husband is going through bankruptcy, since he got foreclosed on a couple of years ago, so he would not be involved in this at all.

I am looking to buy stock in a company that recently filed for Chapter 11 bankruptcy. The stock are extremely cheap right now, so buying a 1000 stock will cost me only about a 0. So if the company tanks I will only be out 0.

Am I missing anything? Is this a good idea? I really don’t care about the 0 and I have faith that the company will turn itself around in the next few years.

What do you think?

And, which online broker is the best to go with? I opened a Scottrade account, but they want a minimum 0 deposit, which I don’t want to do.

I am 15yrs old and wish to obtain a job as a vampire for six flags fright fest here in St.Louis,Missouri. Earlier in the year (February) I went to http://www.sixflagsjobs.com/index.aspx, had took an online job application,& was scheduled for an interview as a costumed character, since it says they do accept 15 year olds in that position. So, I went to the place where the interviews where held and the man who interviewed me went ahead and scheduled me for another interview, but within two days they called me up and told me that there were no openings available at that time but I also understand that this is a relatively large park and people get fired,quit,etc., so I think I might still have a chance, but I am not quite shure what to do at this point. I really, REALLY want this job badly, and believe I would make a great addition to the six flags community. Also I do know six flags is in bankruptcy, so I think this is a good time for me because I can work at minimum wage. What are your opinions? Should I call them or something? I’d appreciate all of your inputs, and thanks!!!

WASHINGTON – Days after it got a federal bailout, American International Group Inc. (AIG) spent 0,000 on a posh California retreat for its executives, complete with spa treatments, banquets and golf outings, according to lawmakers investigating the company’s meltdown.

AIG sent its executives to the coastal St. Regis resort south of Los Angeles even as the company tapped into an -billion loan from the government it needed to stave off bankruptcy. The resort tab included ,380 worth of spa treatments for AIG employees, according to invoices the resort turned over to the House Oversight and Government Reform Committee.

The retreat didn’t include anyone from the financial products division that nearly drove AIG under, but lawmakers still were enraged over thousands of dollars spent on outing for executives of AIG’s main US life insurance subsidiary.

I am being sued by business I have never heard of. I was not served with the papers because I have moved from the address they think they served me at. I only found out about it because I started receiving advertisements in the mail from local attorneys that apparently read the public files at the courthouse. I looked online and there was a lawsuit filed and it shows they served me with the papers. I went to my old address and talked to the new owner and she said a constable came by while she was at work and gave her 84 mother the papers. The new owner called the business suing me and left a voice mail telling them I did not live there anymore, did not receive the papers and then shredded the paperwork. I changed my drivers license, voter registration, social security card, had a change of address filed and was receiving my mail, etc. within a day or so after my move. I was not avoiding anyone. The attorney’s ads said that a default judgment against me could be filed if I did not answer this lawsuit so I went to the District Clerks office and filed an "answer" to the judgment saying I was never served and do not know why I am being sued. The default judgment date was stopped and now it is going to mediation. I have to pay 0 for this mediation and still do not know why I am being sued. I sure can’t afford an attorney and have filed ch. 13 bankruptcy twice in two years, both times I could not keep up with the payments so it was dismissed.

The District Clerks office said that now that I answered the lawsuit, I am a part of the lawsuit and must go to mediation, ETC.

My questions is: Am I legally obligated to continue cooperating with this lawsuit even though I have not been served the papers telling me what it is about? My answer was that I do not know and have had no contact with the business suing me.
No reasonable effort was made to serve me because they handed the papers to someone and assumed it was me or maybe they asked her and she did not hear them and said yes.

It may be dropped now, the mediator, a law student, called me and I told her that I did not have the 0 and that I can’t understand why anyone would try to sue me – I don’t own a home or have any assetts. I realize I may have assetts later in life but how costly for them to wait and find out. It appears they may be dropping the case.

My problem with this is that if I had not found out about it, I would have a judgement against me now by default and I never would have known.

My wife and I are in the middle of a Chapter 13. We had our 341 meeting about 2 weeks ago. In our plan we are supposed to keep our vehicle and our home. We have been making our normal payments on these. Today we received a "Proof of Claim" in the mail from our Trustee with an attached "Proof of Claim" from our auto lien holder. (BB&T) We’ve always made our car payment and we don’t understand. Can anyone out there give us an idea what this means? Why are they making a claim against us if we are continuing to pay them? Thanks for the help.
