Vallejo’s Bankruptcy `Failure’ Scares Cities Into Cutting Costs
When Vallejo, California, filed for bankruptcy in 2008 after failing to win union pay cuts, Councilwoman Stephanie Gomes said officials around the U.S. would have their eyes trained on the city of 120,000.

She was right. The lesson they’ve taken from the two-year- old case, which has cost Vallejo .5 million in legal fees and made it a nationwide symbol for distressed municipal finances, is that out-of-court negotiations yield better results.

Los Angeles on the Brink of Bankruptcy
Los Angeles is facing a terminal fiscal crisis: Between now and 2014 the city will likely declare bankruptcy. Yet Mayor Antonio Villaraigosa and the City Council have been either unable or unwilling to face this fact.

According to the city’s own forecasts, in the next four years annual pension and post-retirement health-care costs will increase by about .5 billion if no action is taken by the city government. Even if Mr. Vicarages were to enact drastic pension reform today—which he shows no signs of doing—the city would only save a few hundred million per year.

Los Angeles’s fiscal woes can be traced to two numbers: 8% and 5,000. Eight percent has been the projected annual rate of return on the assets in Los Angeles pension funds. Four years ago, we strenuously warned Mr. Villaraigosa of the dangers behind the myth of that 8%, only to be told by the city controller’s office that our warnings were "based on faulty assumptions which are largely disputed."

How faulty were our assumptions? Over the last decade, the two main pension funds in Los Angeles have seen their assets grow at just 3.5% and 2.8% annually.

Five thousand is the number of employees added to the city’s payroll during Mr. Villaraigosa’s first term as mayor. According to California’s Economic Development Department, when Mr. Villaraigosa took office there were 4.73 million jobs in Los Angeles and 252,000 unemployed people. Today, there are just 4.19 million jobs in Los Angeles and over 632,000 unemployed people

Labor costs boosting SF’s deficit

employee costs will deal a 0 million blow to San Francisco coffers next fiscal year despite wage concessions.

Pensions rank among the most escalating labor costs for San Francisco. Less than a month after voters rejected Proposition B, which would have increased employees’ pension contributions, a 9.8 million deficit projection was released this week. It shows The City’s annual pension investment will grow by .1 million next fiscal year.

The labor costs — salaries, health benefits and pensions — will force government expenditures to increase by 1.1 million in the fiscal year that begins July 1, according to data from Mayor Gavin Newsom’s budget office. Labor costs are one-third of The City’s projected 3.4 million of increased spending for the upcoming fiscal year. Also, San Francisco officials project a loss of .4 million in revenue.

Since Republicans are so against universal health care, what would you propose to fix our health care system. Please do not argue that our health care system is adequate because it is obvious that the costs are too high and too many people are uninsured. Furthermore, do not argue that only people who are "bums" don’t have healthcare because many hard-working people can’t afford it.

The article cited below discusses a recent study that concluded that 60% of bankruptcies were filed due to excessive medical bills. In fact, many of these same people had health care, which was inadequate for their bills. Do Republicans have any proposals in how to lower health care costs?

I am divorced and remarried, ex-husband is also remarried. My husband and I had to file chapter 13 back in 2004. March 2007 we were discharged from bankruptcy. My exhusband says that he had to pay what I didnt pay on those bills I threw into bankruptcy. He now says I owe him over ,000. and wants me to pay it back to him. In the meantime I am taking him to court because he owes the kids ,000+ in back child support. So what he proposes is that we negotiate by subtracting the ,000 from the child support he owes the children. Is it possible that the creditors went after him for the bills I threw into bankruptcy, also, I live in a community property state.

I want to run my own consulting business as far as providing information to clients regarding wills/trust, bankruptcy, divorce/child custody modifications etc. I want to be able to do more than a paralegal (as far as being able to give more advice and be a little more credible as far as the law field goes,) but less than a lawyer(kind of like what a physician assistant is to a Doctor), if possible I would like to avoid law school. Would a Masters degree in Paralegal studies be a good option for me. How about a masters in Pre-law? If so what are some good online schools to complete my graduate studies? Please give me some good advice, I have been trying to figure this out for sometime now and am still really confused.

I filed a Chapter 7 bankruptcy that should have been completed in July or August at the very latest. My lawyer claimed to have not received my certificate of completion for the post bankruptcy course and let it go. My case was discharged before he told me anything was wrong. I’d called a few weeks before and was told everything was fine ad I’d receive confirmation soon. I was able to prove that he received the certificate and he paid the fee to reinstate my case. I planned when to file so that a year later I could co-sign on a home loan with my husband when he got back from Iraq. Now it’s just been filed and my 1 year mark will be 5 months later so my husband will come home from Iraq and we won’t be able to buy a house. This was hard enough and now he’s made it even worse. We’d have to come up with 15% down at least to get a loan. Can I sue my lawyer for his incompetence and this inconvenience. I’m not looking for free $, I’m just really frustrated and heart broken! Thanks 4 answering!
You don’t know my whole situation and you don’t have to be a jerk. I wasn’t scamming anyone, I stopped working when my daughter died and we couldn’t affort one income at the time. It’s better to pay on a house than to waste money renting so we weren’t planning a scam we were planning to recover from this nightmare!
I can prove he got the certificate because the company I took the course through has the email and fax conformation. I have already spoken to several lenders and they all say 1 year.

okay, what has really happened is my mom borrowed money from one of those cash advance places. She wrote a post dated check for 0 and was given 0 dollars, while the check was held as collateral. Now she is filing chapter 13, and she listed the place she borrowed from as one of her debtors. What will happen to that debt? Legal professionals only please!
i do not think this is a recent debt…it happened in august or earlier.

My husband and I are going through some financial hardship as he is seeking employment (although he does bring some money in due to VA benefits) and I am having a baby w/ unpaid maternity leave and won’t return to work until Aug. as I am a teacher. We’re also on 10 mo. contract so no pay in July and Aug and very minimal savings to contribute to the summer. Here are our bills:

Water
Car
Personal Loan
Washing Machine Payment
Credit Cards (x2 w/ tremendous balances 38k)
Cable/Internet (which we have to have cable to keep internet and need internet for online coursework)
Student Loan
Electric
Car Insurance
Cell Phone

Any advice as to when I can’t pay one what should I do? We’re also considering bankruptcy … bad times but we’ll survive! :)

My husband and I just came out from under a 4 yr long charter 13. We were so relieved to get out from under this dept that has been a huge burden on our family. Last week I was contacted by ECMC my old student loan collection agency. It was a treatening letter stating that I owed them over 10 thousand dollars. I called them and explained that there must be a mistake because although I realize student loans are not discharged by bankruptcy this was not the case. Our lawyer before doing the chapter 13 settled with all the creditors. ECMC was one of them and they agreed on us paying half this account. Our lawyer assured us that we would be dept free after the four years. During the 4 years we paid ECMC over 10,500.
ECMC over the phone explained to us that our lawyer never had an agreement with them and that they don’t reduce loans.
We talked back with our lawyer office to see if this problem could be resolved. We were called back about 4 hours later by the law office with the clerk there telling us, she was so sorry. She have no idea why the lawyer set up the Chapter 13 for half the loan. She apologize but there is nothing they can do. We owe the dept. And the lawyer that set it up is no longer with their office. He is now assistant D.A.
Our hearts are broken because we just knew we would be dept free after all this suffering. Is it true that the lawyer office can just say "ooh oh my bad nothing we can do about this" and send us on our way. What legal rights do we have as it was explained to us before we went into this Chapter 13 deal that all creditors must agree on the deal before we went to court. Now everything is null and void.
Actually Ryan, he did. He told us that they had settled on the amount of 10,000.
The pricipal loan was for 5,000. It had grown into a monster of 18,000. Before we went to court the lawyer said the creditors had all agreed. Now we are being told something else.
Over the 4 years while in Chapter 13 we paid ECMC 10,500. Now they are demanding 10,000 more. I guess they went up because of interest.
No the lawyer didn’t give us anything from any of the creditors. All we would get quarterly was a letter showing what was being sent to each creditor. Had no reason to believe what they said wasn’t being done.
The office did tell my husband that placing half a debt on a Chapter 13 is NOT normal procedure and that they were sorry.

Hello. Well I’m not quite sure where to start. There has been so much paper trail and no medical attention or treatment. This happened about 3 years ago, my father had a mole on his neck and scratched it. Later on when he came in from work that night, after he had a shower, it began to throb. He went to the mirror and saw that it was hanging so he clipped it off. He had some crusty pallets in his ear that was uncomfortable to touch. Well, as time has gone by it has developed into a condition that has eaten a hole as big as a quarter all the way through his ear and where once was a mole is now a large mass (larger than my hand) of tissue where once was skin. This condition has spiraled. It drains, bleeds, or seeps creamy fluid. This never dries because it is on the cavity of neck so where he turns his head from side to side or catches on his shirt it cracks or begans to seep drainage or blood.
He has lost at least 65-80 lbs. His appetite has decreased. He is always in pain. He has unknown chest pains, headaches, and he is always tired. He has been 3 to 4 times hospitalized for what we thought might have been heart attacks. He now has some colored spots coming up on his back, a small crusty spot on his nose, and his other ear has become infested with these crusty pallets. He was given a prescription by the hospital back when this first happened to treat this as a open wound (cephelaxin). My father was not able to take these pills because it made him very sick and he started to vomit. My father has lately started to show signs of other problems that may or may not be related to this condition. However, I am very scared that before he will get medical attention he will die. I have contacted all the resources available in his county and mine and still has not been eligible for assistance to be seen to be diagnosed or start some type of treatment to get him back to a normal state. There is so much more that involves paper work processes, denial after denial, and just no customer relations are available to help me. I have on several occassions asked for help through the social security representative and he has no answers to any questions, very impatient, rude, tells me all that he can do is have me go online and request more applications or reconsiderations or appeals and he can forward this to Austin. The hospital turned him away when we had a referral to come back as a outpatient for his neck to be examined, some tests run and cleaned by surgeon. The doctor is no longer there and the hospital has been recently seen on the local news of considerations of closing down due to bankruptcy. I am so afraid that I am going to lose my father before he is heard or seen to be determined eligibility for benefits. This condition is starting to ear my fathers ear off away from his face.

the late payments would include possible delinquents and charge-offs. the bankruptcy would be for chapter 13. which between the two would look better on a credit report and for the next several years? which is the better to recover from, and get things like a car loan sooner? mistakes have been made that already happened, and now it’s time to move forward and make the best of a situation. thanks for any advice!

Okay so I am a correctional officer right now, working on my degree online in criminal justice and i turn 23 next year, which are some of the requirements i have heard of to become an FBI agent. The problem is that I got divorced about a year ago and my ex husband left me with about 3 credit cards that were maxed out at the time, I cant afford to pay them, one of them is 00 alone, So when i get taxes back next year i am thinking about filing for bankruptcy. I read that to be hired into the FBI you have to have a credit check. So will filing bankruptcy hurt my chances of being considered for the job?? 5 years ago my daughter was born with complications from a birth defect.

To make a long story short i had to file chapter 13 to save our home since i was getting further behind with being out of work at the hospital and the medical bills biting me in the ankles.

I have payed the plan exactly as they lined out and everything has been smooth. The plan ends in September of this year.

What do i need to expect or worry about since i can afford and want to keep my house after the bankruptcy is over. My plan was a 100% payback plan so i will owe nothing but the monthly payments coming out.

If it matters the current holder is Chase.

I work in a factory and typically get a raise – around 50 cents or one dollar per hour once a year ( I am currently making a whopping .25 per hour). I have been in chapter 13 repayment for four months and I still have fifty-six months to go. The trustee garnishes the money from my paycheck. Do I have to report these raises to the trustee, or should I just "let sleeping dogs lie" as they say. Do they periodically review these cases? This crap is a nightmare. I have three children and my wife is pregnant. Are we ever going to be able to get ahead in life or should I just accept that we’ll be broke for the next five years?

We are going to file for Chapter 7 this December. I was curious how many months they usually want to see. Most places I read it is 3 months. I am hoping it is 3 months because we were not expecting to file until now and our statements might look bad any further that 6 months back.
The reason we have to wait till December is that my husband had a previous bankruptcy before I met him. The lawyer told us to wait. We are not paying our credit cards because we can’t afford it.

I purchased a house with an ex, and needless to say things didn’t work out. When I moved out, he convinced me to sign a quit claim deed. I didn’t realize I was giving up all rights to the house without being released from my financial obligations to it. Now the house is in a foreclosure auction. I have no idea what this means for me. My credit was fantastic before all this business began, but now my credit score is plumiting fast! I’ve been told I should file for bankruptcy so that I can have my name removed from the mortgage, but I feel like that would be a bad idea. Is it really my best bet? What effect does this auction have on me? The ex refuses to talk to me at all, so I have no clue what’s going on besides what I can find online regarding the auction.

I am 17 years old (6 months shy of 18!), and I need money.

My family is filing for bankruptcy and I’m going to need to make some money to pay for college books and other (social and recreational) expenses. However, I get sick a lot and have a weak immune system, there are no jobs available in town, and I have no source of transportation. Working for a company online would be ideal for me. I could do it whenever I want, wouldn’t have to worry about being too sick, and countless other reasons. However, I can’t seem to find anything that suits me. I’ve looked at survey sites, but they all seem to be hours of work for 50 cents. I want decent pay for decent work. I don’t expect to "get rich quick" or anything like that, I just want a job that will pay at least 10 dollars for an hour’s work (as my friends who work at fast food joints get paid at least that much).

So basically: Decent (or well) paying job online available to a 17 year old that isn’t too much work for not enough pay. Is there anything out there for me or am I just dreaming?
I would also like to acknowledge the fact that I’m not looking for snotty remarks and worthless answers. I am aware that there are scams and pyramid schemes and stupid crap like that, I was asking whether or not there are jobs available online. I know for a fact that people work online (my dad’s friend Doug works online for an advertising company, he does graphs and calculations and that is a part time job for him), I was just wondering if any job like this existed for someone under 18 years of age. I’m not sure if "freelance" would be the right term, but I’m looking for something similar. Please refrain from comments that imply that I’m naive or stupid, because I am not and it just makes you come off as a judgmental and inconsiderate member of this community. Thank you.
I worked at a magazine for 7 months on a paid internship. I imput data, called advertisers, did research related to the magazine, formatted certain articles and edited many. I am a published writer as I have both a published poem and published articles. Those are (some of – I can’t list them all)my qualifications/experience. I don’t mind imputting data or doing mundane things like that, I just need a job because my family is desperate.

My case is not actually filed yet because my Att. fees are not yet paid in full. I cut up all credit cards on the day I went in for a consult. I did not charge anything after that day but I have and did I shop with my debit card. I now only buy the absolute necessities. I may not qualify for Chapter 7 because I still have between 0-0 left over after all expenses at end of month so may need to file for Chapter 13. This left over money (all of it) would go to pay my reorganized debt, but if any emergency were to happen I don’t know what I would do. My doctor just took me out of work for a month due to excess strss/anxiety/fatigue. So now I’ll miss a month’s salary. This medical situation is not a shocker, it’s been a bomb waiting to explode for a long time and it finally happened – mostly because of work related stress. (I am a single 30 year old Flight Attendant) I do not know what to do at this point in regards to my financial situation. It seems to be a downward spiral. HELP!

Signed with the Credit Solutions a few months ago, and credit card company is still going to take me to court. I can’t afford the payments even with the credit solutions help. What should I do? Can I declare chapter 13?
