I have found conflicting information. Some sites say you can purchase a home anytime after a bankruptcy discharge as long as your credit score has been rebuilt but other sites say you have to wait at least 2-3 years. Which is it?

I want to get out of my business asap because im running broke. I’ve looking for buyer for my business for about a month and a half but still no luck. I tried to negociate with the landlord about lowering the rent or early termination but failed. Now im thinking to either just post online to give away my business if only they take over my lease. Should i do it? Or should i just simply file a bankruptcy? Im scared that my brother will be kill me if they will take our home where my brother and I cosigned for it.

Can I just file bankruptcy? My husband is an authorized user on one of my credit cards, he has never signed anything. Can I have his name removed from the account? Where can I find a means test online to see if I’m eligible for a Chapter 7? Any help would be awesome- thanks!

My bankruptcy has been discharged for about 1 year. I got a Capital 1 credit card a few months ago. I was approved for a 0 limit and since I paid the TOTAL amount every month, they raised it to 0 after 3 months. I am still paying off the balance in FULL every month. I started checking my credit score online in December and the average of all the credit agencies was 618. In Jan in went up to 621, and its still 621 now (Feb). I only have the one credit card, which I am doing the right thing with… so why is my score not going up by much? I dont want to get a bunch of credit cards (its what messed up my credit to begin with). I did apply for a Best Buy card over the weekend, but was not approved. I am looking for a new car, and Carmax approved me with "no documentation required" for 11.65%. I dont know if having a car loan will help or hurt. Does anyone out there have more experience with this?
I filed for bankruptcy because I messed up my credit from 1998 to 2002 (age 18-22). I filed in 2007 and it was discharged in 2008. I tried my hardest to pay off my debt from 2002-2007, but was not making a dent in it due to fees, interest etc. I am not one of those people who took the easy way out. The only reason I got the 1 credit card was because I was told it would help with my score. Charging only what I know I can pay off in full each month should say something about me and the lessons I have learned.

I’ve filed for Chp 7, and have a home mortgage and another mortgage for a lot we own. My home mortgage people are saying I need to sign the "re-aff" paper’s or they wont report my payments to the credit bureaus. And that I won’t be able to build up my good credit. And what about my other mortgage , too? Thanks for your time.

I stopped by a PC Club store a few weeks ago and dropped off my laptop for repair. They told me they shipped it to their repair location in L.A. and it would take several days to get it back. They finally repaired it, but they had to send it back because they broke a panel during shipping, and said it would take a few more days to get it back again.

After I hadn’t heard from them again, I called yesterday and today to see what was going on and there was no answer. I’ve looked online to see if I can contact them, but I can’t find a way. I just read that they closed their doors yesterday and they filed for bankruptcy. Now I’m out 0 and a laptop. I don’t know where they shipped it for repair. Does any one know how I can get my laptop back? What can I do? Thank you so much!

In chapter 13 I understand you must turn over any tax refunds to the trustee. While you are allready in the plan…How do they know if or how much a refund you get? Do they require you to turn in copies of your tax filings each year? My second question is. If I get a refund from Irs, but owe to the state, will the court allow me to pay the other one with the refund? before they make me turn it over?

I am preparing to file a Chapter 7 Bankruptcy to discharge my medical bills of ,000. I have no other debt, other than my car payment. What can I expect my credit score to fall to? Right now I have about a 700.

there’s a home that i’m interested in that is for sale by owner and has been that way for approx 4 months. the home is currently vacant. is it rude to ask to purchase the home on a land contract rather than going through banking channels? i’m pretty sure, due to the digging i did online, that the owner passed away in october and left it to his children (scary what you can find online in a short amount of time). i just don’t want to insult them. mine and my husbands credit is ruined beyond repair and have to file bankruptcy. we would like to be able to offer them a balloon payment as soon as possible, possible after 5 or 7 years. realistically, i’d like to lease with the option to buy for 5 – 7 years and then get a loan after the dust has settled for us. i don’t know how to lead into this conversation.
my husband owned a business that went under. that’s the reason our credit is beyond repair at this point. we both now have jobs outside of the home and are making a decent wage. although not enough to dig ourselves out of the financial hole that being self-employed costs. we may be a financial risk, but we’re hard working, trust-worthy people who are just trying to stay afloat in today’s day and age.

My husband and I filed for chapter 7 bankruptcy 6 weeks ago due to a wage garnishment and other reasons. Our lawyer told us because of the timing and amount garnished we would get all of the garnished money back. The automatic stay has been in place for 4-5 weeks. My question is when or how long does it take before you receive that money back?

I have two student loans out and was considering filing for bankruptcy to try and consolidate both loans into just one low cost loan. In any case…What is the best choice if claiming bankruptcy was an option that I am willing to endure. Her and her husband are currently under chapter 13 they have cashed there refund check…they needed it to fix there car…Will they both go to jail for cashing it? They have a 6 year old and a 1 year old. What or if anything will happen to them… She went to her trustees web site and on there main page it saids (All tax refunds during your entire case must be turned over to the Trustee uncashed. Failure to turn in your refund will result in your case being dismissed and will also prohibit any filing of future cases.) she also has a lawyer but she doesnt like her… and doesnt want to deal with her any more can she go with another lawyer? When they filed in Sept. 2007 there first tax refund check was sent directly to there trustee.. about 2 months ago they recieved a letter saying (We have you Certification of Compliance and Request for Discharge in our office to be signed as soon as possible.) So they assumed that there case was being Discharged) I just hope that they dont go to Jail b/c they have 2 kids

They received this letter on April 17 but they called her a week or so before they sent the letter. They received the tax refund almost the end of May. They went and signed the letter on June 1 so they thought that the check was theres. B/C they keep all they others. Like when Gustav came there car was crushed by a tree. they got money back from there insurance they lawyer took that check too. They wasnt going to give it to them b/c they needed a new car. So they will go and get a new lawyer when they get back from there Disney Trip… Thanks for every one advice!!!

Ok 2 million people a year going bankrupt from being wiped out by medical bills.

3/4 of those people that go bankrupt were insured before the illness took place. My point is, the insurance now does very very little to protect against a serious illness like cancer.

I dont get it, why are people so stupid? You might be happy with the insurance you have now, but wait till the illness gets expensive… they either cheat you out of the coverage or jack the rates so high that you cant pay.

Do you really think insurance companies are going to cancel your insurance if you go to the doctor for a common cold with a 0 bill? They wait till it gets expensive and then screw you over, even though its likely they could cheat you out of the 0 bill, they wont do it to everyone because they dont want YOU to know about how they really are.

Why cant we just have more sympathy? Obama isnt the answer, he is a lying chicago politician who got put into power by the FED/banks/AIG. When Obama tells millions of people that we can get the "public option", it is just smoke and mirrors. His public option isnt going to get passed, he is just pretending to try knowing full well that it cant be funded or implemented.

Sadly, he isnt going up against the insurance companies. In 1 FOUL SWOOP of Obamas pen, he couldve made it so that importations of medicine from Canada and other countries would become legal again (some medications can cost 800x more then their ingredient value in the USA), but has he done this yet?…. Why hasnt he done this?….

The american bankruptcies will continue and rise as expected. Until we get something like that of Canada or France’s system, we are going to be caughing up all our money to hospitals.

I want to file Chapter 7 to totally get rid of my debt. The only problem is my spouse doesn’t agree with this, so I would have to file by myself. I have 5 credit cards in my maiden name and 1 credit card in my married name. My medical bills are in my married name. As far as my assets, my name is on the house but not on the mortgage. My name is also on the two cars that we own.

Can I file Chapter 7 bankruptcy without the cars and the house being affected? If I can’t file by myself then what else can I do?

My parents filed for chapter 13, and they’re still paying the entire amount on their home, minus interest. The lawyer said they would not lose their home in this case, but a friend of ours was on a foreclosure website and found their home on there with the bankruptcy lawyers information as a contact.

Can lawyers put your house on those sites 1, without your permission or knowledge, and 2, is that legal? what can be done?

I live in San Diego, CA. I have absolutely horrific credit (not bragging). I had a rough patch which basically demolished my fair credit score about 2 years ago. I have been working at the same job for years and in the past have rented various luxury apartments in the past (when I had fair credit). I have never had a problem with a landlord as I have always paid my rent on time. My credit history tells a very different story however. I think my FICO is a whooping 500 which is terrible I know. I am now what they call cash rich, credit poor. I’m finally making really good money, but I have the worst credit rating. I don’t want to have a co-signer, but if I have to I can get one. I can also afford to pay double whatever the deposit may be. Will the fact that I’ve had the same job for four years, make over 3 times the rent amount, and have a good rental history save me from my terrible credit history? How tough are landlords about this sort of stuff? I want the apartment in my name only and I have a dependent.

I know that people experiencing worse situations…i.e. bankruptcies must be able to rent, so surely I can rent someplace?

Does anyone know of apartment complexes in San Diego that either don’t do credit checks or that will work with people with bad credit? I did find one place online that is a luxury apartment and works with people with bad credit, but I really want to save money and all their apartments are 00+.

I have been married for almost 6 years. Im 24 and he is 26. We have two young daughters: 3 & 5. The whole time we have been married he has cheated, numerous of times and the worst part is once it was with my sister for 8 months. and the last time was last August a weekend fling and the other woman lied and claimed she was pregnant and wasnt… He also is very abusive, mental..physical..and verbal… mainly the verbal and thats practically an every day thing… calling me every name in the book… even at times infront of our children… I love him. but not inlove.. theres a huge difference… We married young and we have even talked about divorce several of times and that we would be better off as friends… but for some reason we keep holding on… We just moved from SDakota to FL in november and I am alone here with no family.. Just his… We are staying with his dad and its a night mare… I feel so unwanted. and as if Im an outcast… (im white and he is Jamaican) so a huge cultural difference there… His dad doesnt really like me and I can tell by his actions…

I cry every day almost because I want out and cant stand being mistreated.. I have an opportunity to leave without him knowing next month… but I need to wait til after we file bankruptcy.. (long story)

I have recently begun to talk to a guy I met 8 years ago… he recently divorced a year ago and also has 2 children same ages as mine… We want to be together and we have so much in common… He knows my circumstances and wants me out.. says its not a good situation for my kids and I.. and we both are developing feelings for each other… He is willing to fly down here from SD. and bring us back home… he says im a dream come true… and wants us to be a family and treat me with the respect that I and the kids deserve… and I trust him… The only thing that Im scared of is leaving… its a huge change… and I know Ill be happy and safer…. My whole family wants me back home because they have seen the bruises on me before.. and heard the stories… also my husband was in jail last year for choking me and beating up my 19 yr old brother…. my brother steped in as he was choking me… and it was a mess…

like I said I still love him at times… but its not inlove feelings… I look at my husband with anger and pain and 90% of me wants out… I need some advice PLEASE!!!!!!

I graduated Pharmacy School Summa cum laude in 1991.All of my experience had been in retail pharmacy. Married a complete loser in 1994 and went on a path of self destruction. Charged with 3rd&4th degree cds felonies in 1994 and completed all sentencing early in Feb of 1997. I voluntarily gave up my pharmacy liscense in NJ at the time of arrest. Had to claim bankruptcy at that time, credit cards, car payment etc, didn’t cover student loans. I am in default on loans and I am trying to work out something w/them now.Have been told I have to wait 10 years to get record expunged. I had my son in 1996 and have devoted all of my life to him. Have been trying to get a worthwhile job for quite some time but, haven’t been very successful. Finding my self in a situation where I may have to move out on my own and support my son and I need some advice on how to present myself to potential employers, on resumes, on interviews and any advice as to what kind of job I should try for with my educa.?

Clue #3 … Vladimir Putins and Ahmadenijad’s late comments (these two have actually been trying to point out the truth to the US citizens that its our current government whose been involved with the Georgian War and are in it for "sneaky business" as I will call it.

Clue #4 … McCain suspends his campaign!

Clue #5 … Bush trying to implement fear into the media telling us, the US citizens, that if congress does not approve of this bailout plan that economic disaster will occur

I am convinced, I dont know about those who are reading this that our government certainly is up to no good. And we can not allow our current administration to have their way anymore. Our questions are not being answered and the FBI is investigating these late bankruptcies of so and so (AIG, Bear Sterns, etc).

Theres a big problem going on and it is our government. We need to get involved and understand the facts NOW, I think this is a good time to do so. Set aside our play time and start getting involved in our countries well-being.

Please get involved, write your senator, you can find their addresses online and do get involved. The court system is what we have left to defend our rights that are slowly being taken away from us.

And the movies we watch on tv are the signs … "Eagle Eye", "Blindsighted", etc etc … this stuff is real. If you want to believe in God, he is talking to you, you just need to heed these signs. A lot of the stuff Ive noticed on tv is about evil! From "The roots of evil" on Comedy Central, to "Choke" which is a movie that shows a person eating another person, to the video game "Sonic and the dark brotherhood". As much as you want to ignore it, and rpetend its just a humorous human imagination … stop ignoring! God acts through human intervention. He doesnt do it himself, but we do! Theres also shows on tv about vampires and McCain / Palin has the words "Bridge to Nowhere and Lies" written all over their names. Whereas Obama and Biden are being portrayed as "Change / Heart / Honesty"

Set aside your faith, set aside our differences, put away those "I dont want to believe thoughts". And let us all work together as citizens, judges, and senators to put an end to any tyranny our present administration is wanting to bring forth.

We know their connections. We know their greed. We know oil, we know contractors, we know terrorism. We know their royalty, we know their economic spending which has done us no good but harm, we know war, and we know they are out there doing their little dirty deeds to our constitution.
