Liens placed by both myself and the State Agency, USDA is the lender, FHA backed, US bankruptcy court involved, deadbeat filed Chapter 13 in 5/08, he defaulted the payments. Child Support is a priority and must be paid, is my understanding. Please help, I am getting different answers and need to know what my next move is to enforce the obligation and when I get the money? Thanks!

Essentially, it’s a question of dilemma for a friend who allowed her family to use her credit cards in promise to pay on it. As it naturally goes, her family did not pay on the credit cards. Can charge-offs be included in the bankruptcy as well? Thank you in advance.

Our debt was just discharged in Chapter 7 Bankruptcy on July 13, 2010. We had a mortgage loan (fannie mae) and a 2nd mortgage as well as Obama’s loan modification plan. While we discharged EVERYTHING we are just starting to go through the forclosure process. Since we’ll lose our house we now need to figure out what we are going to do…there is not much for rentals in our area so we would like to buy a cheap house or buy a lot and a manufactured/modular home.

Since we just got out of bankruptcy would we qualify for a mortgage loan or construction loan? I understand our interest would most likely be high and we may have to put a down payment down but is there any reason we wouldn’t be able to get a loan now?
2nd question:

so if we won’t qualify for a mortgage loan or a construction loan…If we were able to find a rent to own home or a contract for deed how would they work?

Due to my low income, I have been approved for a reduced fee attorney, costing 00, but I do not get to speak with this attorney, simply pay the fee, submit the debts I want included in BK, relinquish my tax return for 2011 and hope it all goes well. Here are my questions:

1. What is the average cost of BK if you hire a BK attorney? (I live in Kansas, if that helps)
2. Is there any way to make absolutely certain that all of my outstanding debts get covered? (The reason I began to look into BK is because I have a k medical bill for my son’s birth, but when I pulled all 3 credit reports to start getting all of my debts in order for the BK office, I saw that that particular collection wasn’t even listed on any of them. I am afraid that I will go through the work and pay the fee, and then have an unknown debt appear when it’s all said and done).
3. Is there any way to avoid giving up my tax return to the BK courts? My debts are the result of many separations and now a divorce from my ex. 2011 is my year to claim our son, and with another on the way in August, a tax refund would be REALLY helpful. Don’t get me wrong, I understand that my debts are my responsibility and I am not looking for handouts, I just need to be able to start fresh in order to give my family the life that they deserve. My mistakes are my own and I have learned a great deal from them. Now, I need to know how to make things right.

I want to buy their ereader and I have seen they have an open book format and the price is with wifi which is great. I am worried that once I get it that Borders and Borders.com will be gone. Do you think they will pull through even through their recent bankruptcy. I really like how Borders is making their transition to the online e-book market. It looks really good visually and their prices are good too.

I filed chapter 13 in March and am making payments to the trustee. I didn’t file chapter 7 then bc I couldn”t afford to lose my car. My lawyer told me that I wanted to keep it until I saved up a down payment for a car then I could file chapter 13 and change it to chapter 7 later.

When do I lose the car though? Am I going to lose it as soon as I sign the papers? How do I make it to where I always have a car?

since i am filing and my income for 05-07 is under 10 grand a year (i am in ohio also) can my taxes be included in the bankruptcy? i am filing chapter 13.. if not what si the ebst way to go about paying these taxes that i cannot afford to pay. i owe roughly 5000. i know the irs has payment plans, but i know they also settle too. can you settle and get a payment plan?

i am very confused in this sort of thing.
for the second poster i cannot file chapter 7 becuase they will take my car and it is really my only asset.

Im only 24 and really want to buy a house, where can I go to get myself informed of all the steps I have to take. I checked my credit online and I have only two accounts which I already payed off. But my credit score is 541. I have no bankruptcy no credit card, the only reason why it was low is because I applied for credit card which I never got. Would I be able to buy a house, How much money do I need to have in my account. any answers would help thanks.

We short sold our home the same day we filled for bankruptcy, the home was sold and now we received a motion for relief on the automatic stay. what happens with our bankruptcy case?

I bought my home in 2006 and put down $ 100k, yes its 20% down for a $ 500k house. I have put in another $ 50k in upgrades and remodel. Fast forward to 2009, laid off, no income I resort to using my credit card to pay my mortgage while my house was being listed by my realtor. 6 months went by, then a year, the house remained unsold. I’m up to my limit in credit card debt, thinking to sell the house for $ 350k, which will give me approx. $ 50k to pay my credit cards. Year and a half later, house is in foreclosure; credit card at max limit. No job, no car (sold it to pay credit card debt), ..and now living like a deadbeat.

Credit card companies still call and say "hello". Same story told to them over and over, no income, no job, no money etc. They "understand". Then they sell the debt to collection agency, same thing again. I told them my story..and they don’t care. "When are you gona pay?" I say with what? I can sell my t-shirt and underwear, but that might be worth 25 cents. What good will it do? So now, they are suing me in court. Went there and told the same story…judgment for the plaintiff. Okay, now they want to garnish my wage…but I don’t got no job. They want to freeze my bank acct…I have none. They want to..probably kick my ass..that they can definitely do..but that would hurt them, because if I get hurt and sue, they probably owe me money.

So here is my dilema, should I file Bankruptcy ..as there are other creditor waiting in line to sue me. Or should I go to court and and plea guilty but have no way to pay?

Yeah, I know..I’m a deadbeat, but I don’t blame my misfortune on no one except myself. Lost my life savings and people are laughing at me. What a cruel world this is. To file BK or not to file BK? If I do, I will have a fresh start says a friend. If I don’t, my friend says that the creditors will put my balance on my credit report, and renew it every 7 years…meaning that I can call the credit reporting agency to remove it, but they have a right and probably will repost my balance…as nothing had been collected. Is this true? I thought a negative item must be removed after 7 years, but it could be put back in and stay for another 7 years?? Please help. Thanks in advance.

i have credit cards that are killing me. around 10k debt. i am wondering if i can file bankruptcy on just my credit cards, but not my home and my vehicle. i have never been ever been late on any payment or have missed a payment on anything ever in my life including my credit cards. the interest is so high on my credit cards that im paying 700-1k a month just on credit cards and im barely making a dent on paying them off. so can i do this legally with a lawyer with out anyone coming after my home or vehicle. i live in florida. i also just bought my home october 2009 with a fixed 5.5% interest rate at 165k. my vehicle i have had 1 1/2 years and originally paid 26k on a 3.99% fixed interest rate.

Well, i just turned 15, and… we moved several times in the past year, and we lost our house and some of our stuff to bankruptcy. First living with my grandmother who is dieing of cancer, and always used to cuss at me. She was always concerned with herself and never even cared… but i can understand that, she is dieing, and she is old. But my dad yells at me all the time… for stupid stuff.. i mean not cleaning up my room, or stuff i don’t even do. He tells me that i can never do anything right, and that i’m fat and lazy. I’m not lazy! I do what is asked of me! I sometimes forget! :( I’m always so depressed, and i cut myself. My mom never gives me the time of day, nor my dad. I’m home schooled, and I don’t really have any friends in this new town. They are always fighting, and always yelling. My brother calls me a b**ch and other really bad names all of the time. I mostly stay in my room, and just do my schoolwork by myself, (it’s an online school program) and try to stay away from my family. I’m scared that they will yell at me, for something, or fight with each other. I can’t wait to turn 18 and leave. I feel so alone, is this abuse/neglect? I don’t know, or is it me just being over sensitive?

Before my trustee payments were adjusted I got behind by three mortgage payments. Is there a program to help with this or a loan with low interest?
