A neighbor alleged an injury caused by my negligence. I am preparing to file chapter 7 bankruptcy. I understand that if the neighbor obtains a damages judgment against me, it could usually be discharged in bankruptcy. But what about a prospective future damages judgment arising from my past (alleged) negligence? Does it matter whether my neighbor has filed his case yet or not when bankruptcy relief is granted?

My husband’s business is run as a sole proprietorship. We are considering filing personal Chapter 7 bankruptcy. One of the credit cards we would like discharged was used for business expenses only. We have already deducted the business expenses on our 2010 income tax, even though at this point they have not technically been paid. If the debt is discharged, how does this affect our income taxes? Will we have to file an amended 2010 return omitting the expenses, thus paying more tax? Thanks!

Hi im asking this question on behalf of my mother in law who is currently in jail. She just recently told my husband, who has power of attorney for her to look into filing bankruptcy. At this point, her only valuable asset is her home, which is what we are trying to save, so if we file chp 7 will that really do any good?

I have to prepare a Motion for Relief from Automatic Stay along with the proper Certificate of Service, Notice, and proposed Order for my bankruptcy class. Where can I find out what these need to look like or what to included in them. This would be filed in a court in Southern Illinios. I have all of the facts and everything. There is no example in my text book.

I was having over 70000 dollar credit card debt and about 32000 dollars in bank loans. i filed chapter 7 protection and my 102,000 dollar debt was eliminated. What other benefits exist beside elimination of debt?

There is a utility trailer and some lawn equipment that is needed to keep the business going, would that be liquidated in chapter 7 or is work equipment safe? Chapter 13 plan is no longer feasible and there is consideration to convert to 7 but the work equipment must be preserved. Please let me know specific to New York State, because NY is always "different".

My salary falls beneath the means test but the bonus puts it over. Will I qualify for Ch 7 if I wait the 6 months so my bonus is out of that range?

My debts have been discharged in Chapter 7. However, a major electronics store has contacted me indicating they have a lien against a laptop computer purchased from their store (on a store credit card) and they want the property returned. Can this property be seized?

I met with a lawyer today and he told me I couldn’t file Ch 7 because I had equity in my home, and couldn’t file a ch 13 because I couldn’t prove that I could make the monthly payments…………………. What!!!!!!!!!! Do I have any options?

I know that I hear this threat a lot, but I am a receptionist. I plan to stay with the company I am at for as long as they will have me. If I ever do need to find another position, it will most likely be as a receptionist as well. To become a receptionist, will bankruptcy really affect my chances of finding a job in this field? I filed in March 2007 and expect my actual discharge letter in the mail any day now-wait, is that the mailman? My bankruptcy already shows up on my credit report and my credit score isn’t so terrible! Specifically, I want to know if its o.k. to start applying for ONE SINGLE credit card and a car loan. That’s it. I’m rebuilding my credit on those two things. Period. Thanks.

I have a lot of debt and don’t make enough to pay medical bills off and such. Is chapter 7 the way to go?
Just so you know Jackdneverf, not everyone in this world has such a good life as you! When you have a job that has no insurance every time you go to the doctor it’s automatically 0. Don’t judge someone until you have walked in their shoes!

I have a chapter 7 bankruptcy that was discharged in 2009 april….i have a company who is now trying to collect their debt that was discharged….they have even put it on my credit and I was actually denied a car loan due to this debt…..can I do anything to them legaly…ie…sue them or somthing and it should be their resposability to fix this on my credit right.

I am looking into bankruptcy, the only on the bubble question is that my vehicle my be worth 10000.00 and I used that for work. With bankruptcy laws the value is only 5,000.00. Will the court let you make payments to the trustees if they want to liquidate it.

I would like to hear from people who filed and experience chapter 7 bankruptcy. I want to know to if it actually stays on your credit report for 10 years. Is it also possible to get an apartment and a checking account from credit unions or banks?

If someone recently filed Chapter 7 bankruptcy in Georgia, and has fallen behind on making their monthly utility payments as a result of trying to make their bankruptcy payments, can their utilities be disconnected? I know that disconnection can be suspended if the person files back utility payments under their bankruptcy; but, does the same rule apply, if the person didn’t include their utilities in their bankruptcy and fell behind on making payments after they filed Chapter 7 bankruptcy?
