In chapter 7 bankruptcy, are debts from past nonintentional torts discharged prior to a damages award?

Chapter 7
A neighbor alleged an injury caused by my negligence. I am preparing to file chapter 7 bankruptcy. I understand that if the neighbor obtains a damages judgment against me, it could usually be discharged in bankruptcy. But what about a prospective future damages judgment arising from my past (alleged) negligence? Does it matter whether my neighbor has filed his case yet or not when bankruptcy relief is granted?

It will be discharged; it doesn’t matter whether or not they obtain a judgment.
Nearly all consumer bankruptcy attorneys offer free consultations. Take advantage of this to meet with one and get advice based on all of the details of your particular situation. You can find a referral at NACBA.org (National Association of Consumer Bankruptcy Attorneys).
