I am a 39 year old mother of three daughters,disabled by heart diease .i lived on a 30 acre farm for 10 years.after my husband left us me and my girls ran into fianancial trouble.iI draw a check from S S I for my disabilty and it wasnt enough to cover the bills.After filing a chapter 13 bankruptcy trying to save everything,my now ex-husband forcablly took a tax refund check from me that was supposed to go toward the bankruptcy causing it to be dismissed.My farm was foreclosed on and sold at auction.the purchaser had me immediately evicted.I didnt take possession of our things for two months,and then alot of them were missing or broken.what can be done about this.help please

StarcraftII comes out in a week and a half! Been waiting 10 years! I pre-ordered it as soon as I found out back in 2008…with Circuity City. Well, they’ve gone out of business. Filed bankruptcy. Now they’ve been taken over by some other group…yadi yadi yah. Will my pre-order be honored or am I SOL? It would seem to me that their old debts and obligations would be washed away…but it’s worth asking.

Am I going to have to buy this game twice?

I went to a university in Michigan over 10 years ago(1998) and never finished. I have gotten a degree since then, but that is another story.

I filed for chapter 7 bankruptcy in 2000 and included this in the bankruptcy which because this loan was not backed by a bank nor was it a Stafford or any other type of government backed loan. It was like a payment plan you would pay every month to the school during the semester with no interest. Anyways I dropped out and received a credit and somehow I ended up owing 0 or so. Well it went to collections and eventually I just included it in my bankruptcy and so now 10 years have gone by and all of a sudden I am getting a notice contacting me about this "loan".

What can i tell them and or any information on getting this remedied. Also where can i get a copy of my bankruptcy files and debtors list of those I bankrupted so i can forwarded this info to them? Can i get it online? I would like to get rid of this because I will not pay it and I do not want it on my credit report as I have fix it so i am back on track having a good credit rating again.

How long till I can be approved?Hello I filed chapter 7 last year was discharged in August. I recently checked mine and my wifes scores they are both around 595. All the info I am reading online states that it is two years is this true or is it based on your score more than the time since filed. I live in an area where you can buy a fixer upper about 50 miles from the city for about 50,000. Does anyone with experience in this situation know what my options may be do I need to wait 2 years 10 years or could I begin trying to get financed once my credit scores are above 620? My bankruptcy was due to lay off and me being in the hospital for major depression. I was actually told to file for disability by my doctor but decided against it .
I did leave some info out I see . This all happened last year I have since been back to work and already have 2 secured credit cards and my car I am paying on. So 2 years with perfect credit from time of discharge and we will be good to go. My rent right now is actually more than my house payment would be.

people advise against filing bankruptcy because "it will ruin your credit score"?
What do you do if you just dont have the money to get out of debt and you have LOTS of it and the interest just makes it worse and worse?
The icing on the cake is that it actually costs you at least 00 just to file for bankruptcy. What if you can’t even afford that?
If you file bankruptcy then yes, it will be on your record for 7-10 years. But if you just remain in debt that you physically can’t pay back, wont that remain much longer? It will just never go away.

And to top it off, jobs run background AND credit checks now so we can’t even get jobs that pay enough to afford to pay back debt on top of regular everyday expenses.

Hello everyone. I’m a 29 year-old who declared personal bankruptcy in May 2009 and am trying to get my life "back on track" (cliched, I know…). My main question (and reason for posting this on a large community website like Answers) revolves around relocating after a personal bankruptcy. I’m hoping some others on here have had similar experiences. Job opportunities are just not here (in my home area) and I’ve come to the conclusion that, at some point or another, I’m probably going to have to move in order to "get ahead". I have a decent job now but growth potential is almost non-existent and I’ll soon be spending more than I take in (hello financial turmoil, part 2). Anyway, I’m mainly concerned about job hunting/relocating so soon after my bankruptcy last year. I realize many employers and almost all reputable landlords run your credit, and my bankruptcy has pretty much disqualified me from the financial industry and jobs that require security clearances (although I probably wouldn’t be applying for positions in those industries…). Since my bankruptcy, I’ve managed to maintain my finances fairly well and haven’t missed or submitted late payments for any of my remaining obligations since discharge (i.e., student loans and the small credit card I was approved for in late 2009). My current landlord also renewed my lease for another year. I believe my credit score was roughly 670 as of this January – certainly not great but not exactly rock-bottom either). I guess my main question is: is this the "right time" to be looking to pack up my meager belongings and look to start a new life somewhere else? Or should I wait until my credit score improves in a year or two, which may afford me better opportunities? I realize the BK will be on my credit report for 10 years, but I really don’t see myself holding out until then. Any advice/personal experiences/words of wisdom would be appreciated. Thank you!

CapWest – I shouldn’t have said "spending more than I take in". I meant to say that, if my income doesn’t improve, soon enough the cost of living will catch up with me. At the current time, 90%-95% of my income goes toward cost of living expenses.

From the department of inappropriate resentment, I wonder what it is like to go through a Chapter 13 bankruptcy. A friend of mine filed a Chapter 7 about 7 years ago. They have just filed AGAIN (Chapter 13 this time). They spend money like water and don’t do without anything. If they see it, they want it and buy it.

About 10 years ago, my husband and I were 90K in debt (due to illness) making 35K per year. We’re currently paying off the last ,500. It sucked and it was hard and we are still doing without! But we never considered bankruptcy because even though it was hard, we could pay it, and did.

This couple lives better than we do, by far. They are going to dinner/movies tonight and just filed the bankruptcy 2 days ago! We go to the movies only twice a year at most because we are busy paying off out DEBTS! Is paying on a Chapter 13 any kind of consequence? Or is it a bailout for people who have no self control?

Maybe I’m just jealous I didn’t make that choice.

I f–cked up and had to file Ch. 7 and I had an American Express Card Blue for students, as we all know Ameircan Express is one of the harder cards to get even though Iwan’s really bad at paying them late, since I had to include the card in my discharge, they have me in the system as a previous cancled account. I want one of their delta frequent flier cards that reward you with delta for every mile you spend, I wish I knew someone in their office I could pay to approve the application, but its automatically done online, any ideas how to get back in good standing? My dad said wants he lost his even after 10 years he still couldn’t get it back, I guess they hold grudges!! :( Any ideas?

I am looking for some advice. My husband and I are considering filing for bankruptcy. What I would like to do is have him file single vs. joint as most of the debt we have is in his name. He has about ,000 in credit card debt and loans. The only joint purchase we have is our car. The amount of debt I have myself is under 00. We have 2 small children. The problem is my fear of what would become of our lives AFTER bankruptcy. I am self employed and will have a harder time qualifying for loans without him. In our family he is the major bread-winner. He is currently working both a full and part time job and we still aren’t cutting it. He has been at his job for over 10 years. We are currently renting and would like to buy a home in the future and provide security for our children.

As far as I know it’s 10 years of no credit, so you can’t buy a house or a car under your name. (correct me if im wrong) what else?

also, after the 10 years, does the bankruptcy stay on your credit report for LIFE? or it comes off after 10 years?

So I am only 23 and a family memeber ruined my credit. She opened up bank accounts in my name , bills, apartments … etc, stole my check book and wrote 14 bad checks in one day…. used my name and social for doc. visits and precriptions. She just admitted this to me and she started all this when I was only 17 18 years old. Ther are things on my credit that are mine, but not enough to ruin my credit. I think I may have to file bankruptcy. I was told that it will not show on your credit after 7 to 10 years. I mean since I can’t do anything now because of my credit, and the bankruptcy will go away in that amount of time, then by the time I am 33?? or so It will be gone and I can start from there. I feel like this is my only option, but it seems to good to be true to just wipe out all my credit with bankruptcy and then be able to start all over in ten years??Is this true, how does bankruptcy work ? How do I go about checking my credit if I don’t have a cc to do it online? I have went to freecreditreport.com and freetriplescore.com and they are just a scam cause you still have to put a cc down… so how can I look and see exactly what I have on my credit?

Ok so here is the situation I want to leave my husband and the only reason I am still here is due to finances. If I leave and I file bankruptcy will that basically be with me for the rest of my life? I am 32 so if it is on my credit for 10 years that would put me at around age 42 before I can establish myself again. Any suggestions would be more than greatly appreciated!

My Chapter 7 Bankruptcy was discharged 3 years ago. I just got my credit report from all 3 bureaus and the "condition" of some of the accounts that were included in the bankruptcy is "derogatory." I was told by someone in a similar situation that it should just say "closed" and then in the notes "included in bankruptcy". However, I can not find anything online (from a reputable source) to confirm or deny that claim.
Also, the odd thing is that, on some of the accounts, it will say different things between the bureaus. For example, for Chase: Transunion says Closed and Equifax and Experian say "Derogatory"

Does anyone know FOR A FACT if I can legitimately dispute the "derogatory" status of these accounts and get them changed to "closed"?

NOTE: I understand that bankruptcy is bad and that it will stay on my public record for 8-10 years. My question is, should the individual credit accounts that were included in the bankruptcy say "Closed, included in bankruptcy" OR "derogatory, included in bankruptcy" … or does it even matter when it comes to the credit score, etc?
Thanks everyone. I’m not challenging that the accounts should say "included in bankruptcy" as I know that they will say that. I’m asking if the Condition or Status of the account should read: "Closed" OR "Derogatory"? Derogatory accounts weigh on the credit score. Hopefully this clears up any confusion.
Also, I have been slowly rebuilding my credit by paying everything on time and using the credit I have wisely. =)

I am helping a family member get her life back on track. It looks like her best option may be bankruptcy.

If there is an unsecured, unpaid federal tax lien on her credit, will it be removed when she declares bankrupcy, or is it on there forever (unless she pays it)? I do not know how the situation came about, but the liens were placed against a home that was sold 10 years ago.

I had a bankruptcy from 16 years ago. It was supposed to be removed from my record after 10 years. Now these online background sites all have it listed. Anyone who searches for me can get this information. It’s now affecting my ability to get work and is a painful reminder of a horrible time in my life. Why are they allowed to provide this information after the bankruptcy time period has passed and can I do anything to get this information removed from public consumption? Most of us were told we’d only have this scar on our records for 10 years, which was plenty long. To know that it has now returned to haunt us feels like we were lied to by the courts.

H.R. 1106 has a clause allowing one to put their primary residence into a bankruptcy, therefore lowering the monthly payment to an affordable one. At this time the wealthy can put a vacation home, boat and airplane into a bankruptcy.
I am 71 years old diabetic with congestive heart failure. I have lived in my home for 36 years. 10 years ago I went to my bank asking for a business loan. The banker suggested I take the equity out of my home and and change my loan to an adjustable loan. For the first 3 years it was fine. However my business failed and I’m on social insecurity. I have emptied my savings, sold my furniture and jewelry to pay the ever increasing mortgage. My monthly income is 3.00 a month and my mortgage now is 23.00 per month. If I cannot get help from the courts, my only other alternative is suicide.
To the best of my knowledge H.R. 1106 was passed by the senate and sent to the congress last week and is stil sitting there.

Im 27 and have been struggling with debt all my life. It just seems to get worse and worse every year and I want to file bankruptcy. I hear it stays on your report for 7 – 10 years? Which one is it it 7 or 10? Is it tough to get a car loan after bankruptcy cause with my credit right now they refuse to give me any credit. 00 to file with an attorney is a little bit steep for me right now, is there any alternatives to file, and can I pay an attorney every week untill my fee is met?
