i have been on disability now for about 3 years. i have had credit cards for 2 years. i was doing good with paying my credit cards at first, but with all the fees and interst, its impossible to pay. i dont make much money every month and heard that creditors CANNOT take money from my disability check. with this being known, should i file for bankruptcy chapter 13 and pay every month for 4 years (which i dont understand at all) or should i just go to court and tell the judge that i am on disability and made the mistake of getting the credit cards. i have a repocessed car that i need to go to court for in december. what happens if i dont go to court? can i call someone and let them know my situation so that these creditors and companies will leave me alone? how long will these unpaid bills be on my credit report? im so clueless and have no clue what to do. i dont want bad credit, but cant afford bankruptcy. whats the worst the judge can do to me if i dont pay these credit cards or the repo’d car? i dont own a house or a vehicle. should i just let my bills go and ignore the calls and notices in the mail (accept the court dates)?

I’m 27 years old, male, in good shape and health. I started my own business a few months ago after having Health Care provided through my previous employer for the last 3 years. Now that that’s gone, I have no Health Insurance. I’m a freak accident away from Bankruptcy (knock on wood)

Does anyone know a good company and/or plan to get insured with? I looked online – and was just completely confused with Deductibles, Copay’s, the Monthly amount, etc, etc.

I could have continued the Insurance I had before, but for 0 a month. That seems too pricey right?

i search that is cheaper and i also have 3 kids in elementary school,but my concern is that i am from Virginia and my license will be in California i am trying to aply my knowledge in Bankruptcy or Inmigration law which is federal law will this degree help me i don’t want to spend 3 years of hard work and money and find it out that i can’t exercise my profession in here.Please Help

PLEASE HELP!

My parents filed CH 7 in 2005. They included their property in this bankruptcy and left the property shortly after they filed because their full intent was to have the property discharged in the proceedings.

The bankruptcy was discharged in 2007. My parents continue to receive notices from their mortgage company, Ocwen, to collect on the loan. they have been sought after by the county and city for taxes and property maintenance. They have not understood why, because they thought that the property was discharged in the bankruptcy. AND their attorney continually told them that they should just ignore the letters and demands (she even told me this..)

I was told that they are having a sheriff sale for the foreclosure soon on this property. They have been brought to court by the city to collect on property maintenance (the case was dismissed due to the bankruptcy). I finally got a hold of the bankruptcy papers on this case. Through the petition the house was to be surrendered, but the lender filed a Motion and was granted a relief from stay and abandonment. The attorney didn’t contest this (and then failed to tell my parents this- which would have explained why they continued to get harassed by the lender and now subsequent foreclosure 3 YEARS LATER!).

My question is: was the debt/house/mortgage amount in the original petition discharged when the bankruptcy was discharged? There were no additional liens on the property, only the original loan (that was in the claim). I’ve been reading things online but I can’t get this answer clearly enough to know. I know that the lender got relief from the stay and with that they could attempt to rid themselves of the property (albeit 3 years later..), but is the original debt and property no longer the responsibility of my parents? what is their liability, if any? Are any expenses still remaining that are associated with the property no longer any responsibility to my parents because of the discharge?

ok, this is probably the same question- but simply put.. because the relief of stay and abanodment was granted, does that mean that it removed the house from the bankruptcy discharge? which would be awful!!
I love how this is a story about predatory lending you still have jerks trying to make some easy money. go rot someplace!

I used to be very responsible with my money. I have about 3 years worth of college but never finished with an bachelor’s degree. I used to work and have a great life and my own apartment. When I moved back home, My very negative mother and somewhat controlling parents greatly rubbed off on me. I have had trouble ever since. With college, jobs, and money and ended up filing bankruptcy, because I was trying to rebel against their lectures on credit cards. Now I cant do anything. My mom has become this mean dictator, and I see her true colors. My dad just doesn’t understand. I need to get an apartment and I know I could keep my job after I got my own apartment. I’d just visit my friends and limit my time with my negative mother!
Do you think there is any chance the bank would loan me about 1,500 dollars for a loan on an apartment?? I am also a part time college student.

Before everyone starts posting responses, here is my full situation. I was careless with my finances and also a self-supported college student at a big 10 school. I had no choice but to file bankruptcy to start over and that was discharged nearly 3-years ago. Since then, I had been VERY good with my finances and responsibilities after realizing this was a "new fresh start" for me to do it all right. I have stable employment and am in a good place now. I am paying to own my own home (through an in-house loan, similar to a land contract) and have never paid late or missed a payment in the past 3-years. I have financed on my own and purchased a new Ford since the bankruptcy discharged and made all my payments on time. This vehicle was traded in for my current Chevy lease (I needed a more reliable car for winter driving after owning the Ford for 14+ months) which I did require a co-signer for, but I have made every single payment in full and on time for the past year. I have finally built up my credit enough to qualify for two major credit cards (not ones that specialize in giving people with "bad credit" or "bankruptcy credit" a chance, but actual major financial institutions) I have both a savings and checking account – simply put, I learned the HARD way and have changed my lifestyle for the better after my experience. The situation I am facing right now is that I am looking to purchase a "2nd" summer car, not to be spoiled, but because I put TOO many miles on my lease and will be penalized. I am aiming to find a reliable car that I can use in the summer time only for the next few years and continue to lease a good winter car. I have done all the research and budgeting and know that I can afford to repay the loan. I have found some good vehicles that fall into the ,000 price range and am interested in getting a personal loan for such; however, with the stigma of bankruptcy on my record and not that high of a credit score, I have found it extremely difficult to get the banks to truly understand my situation now. I have researched online countless hours for any institution who deals with this type of circumstance, but have had no luck. I was hoping someone out there had been in a similar situation and found something useful. If you have, I would greatly appreciate you sharing that information with me. My ex-husband is the most unresponsible person i have ever known in my life. He lied to me on a daily basis, borrowed money from people & never payed it back. Took our kids savings bonds..ok he stole them & cashed them in. Forged my name on tax return checks. Filed bankruptcy twice, hid bills from me, we had a foreclosure on our home. i begged this man for marriage counseling only to hear him say i dont need anyone to tell me what im doing wrong, he even told me he had brain cancer to see how i would react. he was totally addicted to online games & met another woman & decided to end our marriage before he even met her. in the past 3 years she has come to visit him 3 times now..the 1st time after one week they decided they want to get married. He owes the irs ,000 & because my name is listed as the beneficiary i am liable for it too. he did not pay taxes on his retirement saving he withdrew when he was let go of a job. will he ever change??? BTW i was married to the nut for 23yrs.

My mother filed chapter 13 bankruptcy in 2009. My father passed away in 2007 and now 3 years later she has received a 00 funeral bill. This was not included in her bankruptcy. The funeral director at the time had known us and been friends with my father for several years. He never billed my mother for services and told her not to worry about it. He is now no longer the director and we received the bill today. Not only she is being billed for the services but now there is 00 additional interest fees. Ok SO what im trying to find out is whether anything can be done as fas as her bankruptcy. Can she go back once its been finalized?

I have bad hypochondria. I developed this 3 years ago and it’s pretty bad. I’m constantly fearing that I will catch some disease and die or that I will move my body or eat wrong and choke to death or break an internal organ. Most of my fear is of having a heart related problem. I don’t go out anymore and I stay inside so that nothing bad happens, like getting in a car accident. If someone mentions an accident or death of a loved one it makes me both sad and very scared and I have a panic attack. I spend hours looking up symptoms online and I now have to file bankruptcy because of medical bills for doctors visits for minor illnesses when I didn’t have any health insurance. I want to go teach english abroad for a year but I don’t know how I can when I can’t even barely leave the house outside of work. I’m afraid I’ll get ill and die in a foreign country.

After trying to find ways to be able to take care of our responsibilities we have come to the last resort and that is to file bankruptcy. We don’t own any homes or any real property. what I am curious about is which is better chapter 7 or chapter 13. We want to be able to start saving a soon as it done and when feesible start rebuilding credit. Our credit card debt is only 00 which is a lot, but it could be worse. We just had two bad years with this one being the worse. I am looking for advice on the best way to go between the two. Chapter 7 or Chapter 13 and why.

We are not happy about doing this as we have tried everything. We don’t have anything of value and we have tried to pawn stuff but couldn’t get .00 for most. We live very modestly. So please do not answer this question if you are going to be negative.

As I stated it has been a bad 2 years, actually almost 3 years. I got real sick and had to leave my job and am now on disability. My husband took on a second job a year ago. He pays child support. Between the two of us we have 5 kids between the ages of 9-16. We have two vehicles, which one is in the shop. We also are surrendering this vehicle.
We have an attorney and he is recommending chapter 13. I (we) have a lot of medical bills. After I had to leave my job I couldn’t afford the cobra payments for continued health insurance. To maintain health insurance with my husbands employment (state worker) would have cost more than the cobra payments.
My ex- husband filed bankruptcy and I did not know that anything he had when we were together, came back to me.
I never thought I would get sick and have to quit work. I was not prepared.

I am in chapter 13 (3 years into it), still have about 2 years left to pay everything off. My car is under this BR and the engine is shot and the transmission is going out. I need a car for work. The dealerships I have talked to said no bank would finance me even with an approval letter from the trustee of the BR. Any advice at all? I found good used ones from individuals but again, I would need a loan. I’m stuck with no way to work!!

HSBC stopped sending me my bill in nov.2007, I thought it was odd (I have never missed one payment in the 3 years I have has this loan) I called them,and was directed to "national bankruptcy hotline" and tried to register online to pay and it would not let me.So I could not get thru to HSBC. Turns out my co-signer (my father!) filed for chap13 bankruptcy, and my car was dragged into that. So here I am not paying my bill for the next several months, thinking that ok when the bankruptcy is clear, I can start paying my bill again, my father’s lawyer did not even know what was going on. So in feb.2008 I receieve my FIRST notice in the mail from HSBC stating if I make all late payments (total 1500.00) by a certain date, they will not pursue the car, and it would be like I never missed a payment at all. I paid it of course, and have been making my monthly payments since then (even though i still dont receive a bill).

I checked my credit, and i have a negative account with HSBC stating a charge-off on the auto loan 4 months late payment and late payments as of 06/2008!!!!Past due amount:10,200$. I am completely frustrated, I have been making my payments every month now! I even tried to dispute the claims and nothing happened. I talked to national bankruptcy hotline since no one at hsbc will say a word to me, and they said since I made the payments late, it doesnt even matter even if the car is in a bankruptcy. So now i just want to sell my car, and pay if off, just be done with the whole mess. Is there any possible way to get this cleared from my credit? Thanks for any advice!

I owe 0 bucks for my 2007 federal taxes and want to make installment payments over a few months to pay it off. Will I get in trouble for requesting this? I have been in my ch.13 for 3 years. Also, I am pretty sure that they will take my stimulus refund and send me the difference. Normally and refund from the IRS is supposed to be signed over to the trustee. I just don’t know a different way out.
Would this be grounds for a dismisal??

I am 33 years old single female.I have no children. I live alone. I pay rent in my small apt. I still owe my car. My debt is right now k and is increasing every month because of the interest. Debt its in credit cards and medical bills. I’m a licensed massage therapist and I’ve tried to work in lots of spas but all of them are terribly slow. The most of the days there are no clients. Now I work daytime in 2 spas and nighttime with private clients. But not everyday I have clients either daytime or nighttime.I don’t work with a doctor because I make less money than what I can make in spas and on my own. My income right now is around k annual with a debt of that’s its increasing each month. My lines of credit have been reduced, now I’m only paying the minimum amount and without enough credit available to spend. I am getting physically very sick (which affects my job) and mentally very depressed because of this. I have never being late in any credit card bill, but I will be very soon because the minimum payments will be higher and impossible to pay. I don’t care if I have to pay rent the rest of my life. I just want to be peaceful and pay my basic bills, live in an apt, keep my furniture, my tv and my car. I don’t have luxury and I don’t care about luxury. I have known a lot of people that in 3 years they have built a great credit after a bankruptcy.And I know I can build it up again well someday.I have a friend that 2 years after filing for BK, start receiving tons of credit cards offers. I know that the economy it’s too bad, that millions of people are filing for bankruptcy and the banks make money from interest so sooner or later will offer credit and loans because they won’t have any other choice. About consolidating debt, I have to cancel my credit cards but still paying monthly payments. It’s what almost I’m doing right now, paying but not be able to spend! so what’s the difference? that I’ll be in the newspaper, not being able to buy a house, not getting credit cards for the next couple of years? I don’t think that’s too bad.I can live with that. I would do it if I can pay off my debt in just one year!! but in the track I’m going, the debt will be almost doubled and will be impossible to pay it even in 3 years! And I can work my ass off, but is not only in my hands to do it, the economy is BAD, and in my job, everywhere I look is BAD, so it’s not only depending if I work my ass off or not! I prefer to be embarrased the rest of my life of filed for BK instead of being embarrased because I was sued from my creditors and having all my belongings (like car) repossesed, and being almost homeless! Credit cards are poison, I don’t care getting one again someday actually. I have friends that they don’t have a credit card for years and they are happy. I don’t know why it’s so important for some people to own a house. I can live paying rent, I prefer investing in something more valuable than that, like education and good health.

I signed permission to do a background check pre-employment. It is the FCRA background check. I have shady credit only because I had bankruptcy 3 years ago. I was told that cannot be a reason to not be hired.

What else may be checked? I have no criminal background but was fired from a job 16 years ago for illness/missed work.

My last employer said she has not heard from anyone yet and the application/FCRA background check permission was filled out online on 7/31.

I ran a credit check yesterday and there was no inquiry on it.

I called recruiting Friday and they said that they couldn’t tell me anything but that my application was there and active.

My sister makes about k a year. She is a single mother. She filed Chapter 7 last year. She gave her landlord a 30 day notice that she was leaving. She has lived in the apartment for 3 years. Her lease renewed in August. The landlord called her and said she is responsible for rent until they re-rent the place and if she doesn’t send the $$ they can file a judgement and garnish her wages. My sister has worked really hard to get this new place and she has done an excellent job on the accounts that have been opened since her discharged Chapter 7. She feels her only protection from the landlord is to file a Chapter 13. From what I know about Chapter 13’s, your "disposable income" is used to pay your creditors. My sister really doesn’t have any disposable income so can she even file a Chapter 13? Also, will she no longer be able to use her new credit cards she’s been doing excellent on?

I’ve been renting for 3 years now after filing Chapter 13 in 2007. I’m converting to a 7. Will I be able to get a mortgage once the 7 is filed very soon after? My lease is up in May. I don’t have anything for a down payment or closing costs.

Okay so i was really bored online and googled my last name and address for fun. Only to find my address and parents names and that they had filed for bankruptcy in July. I had no idea. I just got a ton of christmas presents and I go to a private school. I knew it wasn’t the best of times but I had no idea that things were bad enough for us to file bankruptcy, what exactly is bankruptcy and is there anything I can do to help my family?

I know that they paid for my presents in cash, not credit. idk if it makes a difference. They haven’t used credit cards in like 3 years but know that I think about it we always used to use them.
