My husband and I recently had to file Ch 13. I am now pregnant and worried to death that we will be living on the streets! What happens when we go to rent a bigger apartment? Are we automatically denied now? And our leased car is due to be turned in, can we buy it or do we have to turn it in and be out a car? No one tells you what happens after filing. I have only heard horror stories, nothing even semi-positive. Plenty of people file, and I am just wondering if things have worked out for them. If anyone has any advice and has been there we would really appreciate hearing from you. Thanks in advance!

My house is going under foreclosure and there are two loans. The second loan put a judgment on me. I am trying to sell the house under short sale. Will they come after me for whatever money they loose? If so, to what extent? If I file for bankruptcy will that take care of this mess so that I can begin to rebuild my life? I don’t have anything of value and currently unemployed and my family and I are actually living with my parents in their apartment now. I am a first time buyer and have not refinanced. The house was bought on November 2007. I also stopped paying about five months ago when all this began. Will this never end and will they come after me until I die?

Apartment after eviction and bankruptcy?
A friend of mine lived in Orlando, Florida, lost her job, was pregnant, moved back to NY and left the apartment to her then husband. The ex, made a few payments late, causing an eviction. He vacated the apartment with a notice. The eviction is under iclerk of court, but not in her credit report because she then filed for bankruptcy and was discharged from all debt in February of 08, however the amount that was owed never made it to the credit report. She has then established credit and has a score of 630, which is fair for someone who recently had bankruptcy. She has no assets, no mortgage, no car payment, just 2 credit cards which have no balances, since she makes her full payments in less than a month. She has started fresh in her life, things happened and people make mistakes, in this case, leaving the apartment to her ex husband, was a bad one. Is there any chance she can get an apartment?
Asking for a 1500.00 loan, after a year ago filing bankruptcy?
I used to be very responsible with my money. I have about 3 years worth of college but never finished with an bachelor’s degree. I used to work and have a great life and my own apartment. When I moved back home, My very negative mother and somewhat controlling parents greatly rubbed off on me. I have had trouble ever since. With college, jobs, and money and ended up filing bankruptcy, because I was trying to rebel against their lectures on credit cards. Now I cant do anything. My mom has become this mean dictator, and I see her true colors. My dad just doesn’t understand. I need to get an apartment and I know I could keep my job after I got my own apartment. I’d just visit my friends and limit my time with my negative mother!
Do you think there is any chance the bank would loan me about 1,500 dollars for a loan on an apartment?? I am also a part time college student.

Chapter 13 Bankruptcy question?
My sister makes about k a year. She is a single mother. She filed Chapter 7 last year. She gave her landlord a 30 day notice that she was leaving. She has lived in the apartment for 3 years. Her lease renewed in August. The landlord called her and said she is responsible for rent until they re-rent the place and if she doesn’t send the $$ they can file a judgement and garnish her wages. My sister has worked really hard to get this new place and she has done an excellent job on the accounts that have been opened since her discharged Chapter 7. She feels her only protection from the landlord is to file a Chapter 13. From what I know about Chapter 13’s, your "disposable income" is used to pay your creditors. My sister really doesn’t have any disposable income so can she even file a Chapter 13? Also, will she no longer be able to use her new credit cards she’s been doing excellent on?
Question about debt & bankruptcy?
Hey everybody,
I’ll be 23 in a few months. I’ve already been married & we bought a house [but due to a pipe busting in the winter & causing a ton of mold & then five trees falling on the house in a wind storm that the insurance company did not want to fix], the home ended up going into foreclosure. The loan was not in my name, however my name was on the deed. I’m not married anymore & the last time I checked my credit, the house did not show up but, I think that was before it was actually foreclosed on.
He & I have two credit cards [probably 00 of debt total] that I have to pay half off of [so, about 00 right there.]
Then I have a Kohls & Macys card [about 0 total].
Then I have three other items that are not credit cards that come to about ,050.
Total, I have just a little under ,000 worth of debt which I know doesn’t seem like much but, after I deduct all my bills, I don’t have much money left. Things keep popping up left & right like medical expenses & tires for the car, etc & whenever I think I’m starting to get ahead, I end up even further in debt. I already have two jobs, I already save as much money as I can. Every bit of debt that I have has already gone to collection agencies so I can’t go online & pay on anything.
I’m just wondering if [since my credit is already horrible] I should just file for bankruptcy. If I did, would the foreclosure still show up [assuming that has affected my credit]? Would it be easier to rebuild my credit after bankruptcy or repair it by paying everything off? If bankruptcy is my best option, how long will it affect me? Will I be able to rent an apartment? What if a few years from now, I want to buy a house or condo? If bankruptcy is not my best option, is there any programs that aren’t scams that I could use to consolidate or something? Not sure if this makes a difference but, I do have a 2007 car that I bought brand new. I have three years left of payments & I’m current on it. I’m thinking about trading it in for a vehicle with AWD.

Is bankruptcy an option for me?
Through no one else’s fault but my own, I find myself not being able to pay my bills.
Here are the numbers as I’ve figured them out: I make about 2400 month after taxes. My essential bills (apartment, car, phone) cost me 2013 a month. My unsecured debt monthly payments are 1390. If you do the math, you’ll see that I can’t afford to pay all of my bills. I was using my GI Bill benefits to help pay for the bills, but even when I was getting the full amount, I was still not able to pay my bills.
My total secured debt is 29000. This includes my car and bike (more on this in a moment). My total unsecured debt is 21000.
My questions are:
1. Will I qualify for Chapter 7? I understand Chapter 13 is like a payment plan, but I’m not even sure I would be able to do that given the debt I have.
2. If I qualify for Chapter 7, will I be able to keep my car but return my motorcycle? I currently make payments on both. Buying the motorcycle was a very bad move on my part and I regret doing so.
3. Is the amount of debt I have too low to consider bankruptcy? The overall amount does not look that large (I know people with more on just a couple of credit cards) but the monthly payments are killing me, even after I attempted to make arrangements.
I know I made some mistakes and I deserve to be ridiculed, but I don’t think there’s anything you can say that can make me feel worse. I’m hoping someone can give me some advice rather than insulting me.

Where can I get a real ,000 personal loan with bad credit. I completed a bankruptcy due to divorce a while back. Since then I’ve been able to get a new car and apartment, but I can’t seem to get a personal loan. I have no problems paying the loan and my new income more than qualifies for this type of loan. I’ve applied a a few places and was turned down. I’m tired of checking out places online that promise and personal loan that turns out to be a payday type loan. I want to seriously know if there is a place in California or on the internet that will give someone like me a real personal loan. There has to be some place the give this type of loan to people with my credit background. Please don’ t tell me not to get a loan and all that other nonsense, I have no problem paying this loan back with in 4 months time and the only reason I went bankrupt is because of a x-husband who refused to pay his half of our bills since I left his cheating butt. Loan to take care of a serious situation.
A few months back I tried to get a store credit card. They declined because of bankruptcy. I have never filed bankruptcy. After that, I needed a place to live, so I tried get get several apartments…..All of them declined me because of this bankruptcy. I looked up my credit online, and could not find anything about bankruptcy. I paid off the (2) small bills that were on my credit, and managed to get an apartment by showing them my parents bankruptcy papers. They said it happens all the time!!

I have been in my home for a year and a half. I purchased it through owner financing. I lost my job two months ago and they are telling me they are going to forclose on my starting next week. My option at this time might be bankruptcy, but only a ch.13 would help me. I then, am leary, because I don’t want to put myself in more debt just to save my house when I am not that far behind. They will not work with me. The ch.7 alternative I have been told, will not help me save my home, so I am beyond upset and really don’t know the best thing for me to do, but I really don’t want to end up homeless. I rented at one time in my life and the only time, and was evicted from the rental because the landlord wanted me to sleep with him. No lawyer would help me because they all represented him at one point, so now… I can’t even get into an apartment. If someone could please offer some advice, it would be greatly appreciated. I am a young widow with two boys at home.

How can you rent after a bankruptcy?
We are filing bankruptcy due to high debt. We own our home which we are going to try to sell…if not, then we are going to do a short sale. We’ve NEVER been late on any payment (both mortgage or bills) but are struggling each month and it’s ruining our lives. My question is, every one requires a credit check these days (to rent). How do we find a place to live? I want to keep my children enrolled in the school but the other alternative would be to separate living arrangements and move to our parents homes (I wont live with my in laws & my husband wont live with mine. We can rent a house for what an apartment goes for in another city. How do we get a landlord to look past the bankruptcy and see that before it, we made every payment on time (while struggling to do so). We could easily make the rent (minus all the extra debt we had).
Found out onlline my apartment owners filed chapter 13 bankruptcy. Do I need to worry ?
i found out online my apartment complex owners filed a Chapter 13 bankruptcy in March 2009. The story online says all their assets will be sold at auction to pay creditors. I have not been informed of this by my landlord but we did get a notice of an inspection in 2 days.
Is their a chance I could get evicyed because of the place beng sold because of bankruptcy ? Do the new owners have to legally honor my lease ?

I have never been late on my payments on any of my debts.
I’ve been told (by some friends and colleagues) to just let them all go late and use the extra $$ to get set up in an apartment (since I am surrendering my home due to it being worth less than I owe on it)
I mean, my credit is going to be crap anyway and it will take me a few months to get the bankrupty filed and the hearing held. Also, I will need some $$ to pay the up-front Attorney fees.
I don’t like the idea of doing this, but I don’t have any other way to come up with the $$ I need.
Please don’t lecture me about the whys and hows of how I got to where I am today… I have 2 worthless ex-husbands to thank for that. At least I am doing something positive to give myself a fresh start. Also, any advice as to how the Chapter 13 went for you would be appreciated.
BTW; I earn a salary that is above the median income for my state, so I know I won’t qualify for a Chapter 7.
I may have to consider chapter 13 bankruptcy. The problem is, I may want to sell my apartment within the next 7 years. I have no mortgage. I know that after selling a property they take a portion of the sale.
MY QUESTION IS: Do they make you pay the initial amount due to the creditors or the amount determined by the court after filing for chapter 13?
the property is also worth at least 200,000. So how can i avoid the risk of losing my home?
