Someone owes me a lot of money and they have filed for bankruptcy(chapter 13) here in Pennsylvania. I am part of the proceedings and will get about 30 cents on the dollar of what is owed to me for 5 years. The couple filing made a verbal commitment to me (that was witnessed by at least 3 people) that they would continue to pay on the loan after the 5 years until it’s paid in full. The law of course says the debt is satisfied after the 5 years. Is their verbal commitment to me enforceable if it would come to that? At least 3 people will testify for me that they heard and were witness to the conversation. Will I win if it goes to court on this basis? Thanks for all answers.

I work for a company that is currently in bankruptcy chapter 13. It owes 42 million to creditors. The reason this company is in bankruptcy is bad personal real estate deals by the CEO. The actual business is still profitable.

My question is, I may know of an investor that can come up with million to get him out of debt.

What can/should I ask for if this deal does go through?

I have a 2nd mortgage, now with a collection agency. I need to a settle, but collection agency didn’t agree with the offers I made. I’m in California, and my 1st mortgage is much higher than the property value. Who can help me to get a settlement offer? What type of attorney, do I have to hire to get a settlement.? Is Bankruptcy (Chapter 13) the only option, to eliminate the debt? After loosing my job, I fall behind my mortgage payments.With current income I only can afford to pay my 1st mortgage. i guess what im trying to say is that the house we are trying to purchase has been for sale for about 3 months. We have received a ratified contract and were told we were going to close on jan 20th now we cant b/c the owners filing for bankruptcy chapter 13. Why would they file after the bank has took their home? Why wait so long too? And how can the bank sell thier home if there is a possibility of the owners getting it back?Now we might not get the house i am so confused

My brother, 47, is going to see a lawyer about bankruptcy, chapter 13. Four years ago he went chapter 7. He has money problems. He is on his own. He lives in a different state, Minn, and has an 8 year old son that he has over every other week. He pays child support of 0 weekly. He tries to be a good dad to his troubled son. He works in printing at a plant in St. Paul with a rotating shift, and works hard earning /hr. He lives alone and pays 0 for rent. He lost his new car to the repo man, isn’t very good with his money and accrued ,000 in debts. He is being sued by a creditor whom he owes ,000. They offered to settle for ,000 with two payments of 0. He is paying off ,000 in back taxes at /month. He is thinking of filing for chapter 13 to pay off these debts and get back on his feet. He wants to get a part time job, but the odd rotating shift makes it hard for him to do so. He doesn’t have any support system, so what should he do?

My husband and I filed for bankruptcy chapter 13 back in 2006. We had to file bankruptcy because of my husband had a period of time of unemployment and was unable to pay his bills. One of the creditors that is listed on our bankruptcy petition has been harassing my husband at work saying that we opened a new account back in 2007. Number one, we wouldn’t qualify for any credit cards because of the bankruptcy. Yesterday, a collection company that says that they represent the creditor said that they were going to repossess our car to satisfy the balance of the bill. They can’t repossess a car that is owned by a bank. We are paying on a loan and the bank holds the title. I called the collection agency and told them to stop harassing my husband at work. The agent called me a liar, thief and a crook for not paying back the money. I told him to send proof of a claim of debt. He said he was going to subpoena us and sue us in court. He became mean and belittled me further. I hung up. He somehow managed to trace our unlisted home phone number and called me back 5 times in 10 minutes. I then called my attorney. She called him back and had our Trustee call him also. We are under a automatic stay and a protection order from creditors. According to the courts, we are not to receive any type of correspondence or calls while under bankruptcy protection. This man could be arrested for harassment. My question is if someone on the street were to come up to someone they don’t know and start calling them a criminal, liar. Wouldn’t they go to jail? What gives these "collection agents" the right to harass people?
I think that they all belong in the big house. Not with white collar offenders but hard core offenders. Am I right? Thanks. I’m still feeling unsettled over the whole situation and had to in the end change my phone number. I’m an honest person who is paying their bills on time. Thanks.
We are paying back the creditors we owe money through the bankruptcy court every month. We are disputing the new debt that this collection agency is trying to collect. We haven’t had any credit cards since 2005. Plus, I had a credit rating of over 700 before I got married. I qualified for a home loan on my own before my marriage. I am not a dead beat. My husband was living off credit cards for over 2 years while he was unemployed. The debt was his not mine.

For lack of a better term i was forced to take out a mortgage last year on my home that was paid for. The terms and percentages were awful but thats besides the point.

My income at the time was sufficent to pay my bills and the mortgage.

I ran a successful business for a little over two years until 4 months ago when things went downhill. My mortgage payment is more than most people make in my area in 2-3 paychecks and now im unemployed with a SMALL list of other monthly bills besides the mortgage. I do have about k in other unsecured debt from the business and other unsecured creditors from when i was young that i never took care of.

I have thought about bankruptcy, chapter 13 is a no-go mostly because i cant afford the mortgage payments now so why would i waste my time with a 13?Otherwise it could work,but otherwise i dont really need a bankruptcy if were not including the house mortgage because i could just set up monthly payments with my creditors at a small payment.

my monthly expenses are slim so im not worried about that.

My problem seems to stem from my home, i have about 40k worth of equity in a 117k home.

With that kind of equity, it really does not make sense to file a chapter 7 because in my state you lose all equity besides 5k no matter what.

It really doesnt make sense to do a 13 because as already stated i cant afford the payments now,much less the payments to all my creditors plus the mortgage.

And the only other options are selling, of which is not really an option because foreclosure has already been initiated.

Or a deed in lieu of foreclosure, but then im giving them all of my equity for "free" although the foreclosure would likely not show up on my credit report and i could begin to repair the other damage.It would be faster to do this than to wait 10 years for a BK to come off the credit or 7 years for a foreclosure to come off.

OR just let it be foreclosed on……thats not appealing at all ofcourse.

currently i am in the process of filing bankruptcy, chapter 13. i live in louisiana and have been fortunate to pay only 500 bucks as a retainer fee. i am under the understanding that certain debts take priority over others being the IRS, secured, and unsecured. i am praying that my bill is no more than 600 bucks a month. my question is, currently i have a used car that is on its last end. i am desperately trying to save enough cash to purchase another car, which will also be used until my bankruptcy case is paid out. i am the type of person who can make due and live off of a budget considering i lived off of noodles and cafeteria food in college. therefore, do the trustee cut your check so bad that you are not able to save a penny. i am hoping to at least save something once a month in order to purchase another used vehicle.

i have been on disability now for about 3 years. i have had credit cards for 2 years. i was doing good with paying my credit cards at first, but with all the fees and interst, its impossible to pay. i dont make much money every month and heard that creditors CANNOT take money from my disability check. with this being known, should i file for bankruptcy chapter 13 and pay every month for 4 years (which i dont understand at all) or should i just go to court and tell the judge that i am on disability and made the mistake of getting the credit cards. i have a repocessed car that i need to go to court for in december. what happens if i dont go to court? can i call someone and let them know my situation so that these creditors and companies will leave me alone? how long will these unpaid bills be on my credit report? im so clueless and have no clue what to do. i dont want bad credit, but cant afford bankruptcy. whats the worst the judge can do to me if i dont pay these credit cards or the repo’d car? i dont own a house or a vehicle. should i just let my bills go and ignore the calls and notices in the mail (accept the court dates)?

For Bankruptcy Chapter 13, they asked us to provide a business budget and a business expense reports… can anyone explain what they are and possibly attach a sample…. i really don’t know how to create one.

I can do loans in seven states, and I can even get someone a house in bankruptcy (chapter 13). 500 scores aren’t usually a problem. I can do jumbo loans up to 3 million dollars. I can even do no documentation loans. My coverage areas are:
Alabama, Florida, Georgia, Illinois, North Carolina, Pennsylvania, and Texas.

Any suggestions. I have teamed up with a brokerage firm as well, and just looking for fresh ideas.

I filed bankruptcy (Chapter 13) about a year ago….I get offers for more credit cards and car loans than ever before….I’m not interested in getting more credit cards or a new car. I really would like to purchase a home. What are my chances in purchasing a home with this bankruptcy on my record? Am I totally deluded in my thinking that it is possible for me to get a home loan without a cosigner with my terrible credit history? Or is anything possible in this world of foreclosed homes?
This would be my first time purchasing a home and also I am a Vet so I am entitled to a VA Home loan.

I filed Bankruptcy (Chapter 7) in 2002 – after a divorce. I then had to file Bankruptcy (Chapter 13) in 2007 because of a foreclosure on my home. I’m one month from finishing the Chapter 13. Is my credit screwed for the rest of my life? What can I do to begin to increase my credit score.

My significant other is in the middle of finishing his divorce and his soon to be exwife filed bankruptcy chapter 13 but used the entire equity in their home. he is afraid she is going to cost him his part of the equity. she couldnt file a 7 because of the use of the entire equity now he is afraid for his half of the home. should she dismiss this 13 and restart a 7 or should she convert it and if she does will he lose his home. we dont know what to do for him. thanks
