If a client files a chapter 13 bk in 2002 and converts it to a chapter 7 and is discharged in 2005, can they file another chapter 7 in 2011? What law clarifies this question?

Due to my low income, I have been approved for a reduced fee attorney, costing 00, but I do not get to speak with this attorney, simply pay the fee, submit the debts I want included in BK, relinquish my tax return for 2011 and hope it all goes well. Here are my questions:

1. What is the average cost of BK if you hire a BK attorney? (I live in Kansas, if that helps)
2. Is there any way to make absolutely certain that all of my outstanding debts get covered? (The reason I began to look into BK is because I have a k medical bill for my son’s birth, but when I pulled all 3 credit reports to start getting all of my debts in order for the BK office, I saw that that particular collection wasn’t even listed on any of them. I am afraid that I will go through the work and pay the fee, and then have an unknown debt appear when it’s all said and done).
3. Is there any way to avoid giving up my tax return to the BK courts? My debts are the result of many separations and now a divorce from my ex. 2011 is my year to claim our son, and with another on the way in August, a tax refund would be REALLY helpful. Don’t get me wrong, I understand that my debts are my responsibility and I am not looking for handouts, I just need to be able to start fresh in order to give my family the life that they deserve. My mistakes are my own and I have learned a great deal from them. Now, I need to know how to make things right.

I am considering filing for bankruptcy and have two unsecured loans totaling about ,000. Does a BK cover this? Also, what is the difference between a Chapter 7 and a Chapter 13.

I bought my home in 2006 and put down $ 100k, yes its 20% down for a $ 500k house. I have put in another $ 50k in upgrades and remodel. Fast forward to 2009, laid off, no income I resort to using my credit card to pay my mortgage while my house was being listed by my realtor. 6 months went by, then a year, the house remained unsold. I’m up to my limit in credit card debt, thinking to sell the house for $ 350k, which will give me approx. $ 50k to pay my credit cards. Year and a half later, house is in foreclosure; credit card at max limit. No job, no car (sold it to pay credit card debt), ..and now living like a deadbeat.

Credit card companies still call and say "hello". Same story told to them over and over, no income, no job, no money etc. They "understand". Then they sell the debt to collection agency, same thing again. I told them my story..and they don’t care. "When are you gona pay?" I say with what? I can sell my t-shirt and underwear, but that might be worth 25 cents. What good will it do? So now, they are suing me in court. Went there and told the same story…judgment for the plaintiff. Okay, now they want to garnish my wage…but I don’t got no job. They want to freeze my bank acct…I have none. They want to..probably kick my ass..that they can definitely do..but that would hurt them, because if I get hurt and sue, they probably owe me money.

So here is my dilema, should I file Bankruptcy ..as there are other creditor waiting in line to sue me. Or should I go to court and and plea guilty but have no way to pay?

Yeah, I know..I’m a deadbeat, but I don’t blame my misfortune on no one except myself. Lost my life savings and people are laughing at me. What a cruel world this is. To file BK or not to file BK? If I do, I will have a fresh start says a friend. If I don’t, my friend says that the creditors will put my balance on my credit report, and renew it every 7 years…meaning that I can call the credit reporting agency to remove it, but they have a right and probably will repost my balance…as nothing had been collected. Is this true? I thought a negative item must be removed after 7 years, but it could be put back in and stay for another 7 years?? Please help. Thanks in advance.

For lack of a better term i was forced to take out a mortgage last year on my home that was paid for. The terms and percentages were awful but thats besides the point.

My income at the time was sufficent to pay my bills and the mortgage.

I ran a successful business for a little over two years until 4 months ago when things went downhill. My mortgage payment is more than most people make in my area in 2-3 paychecks and now im unemployed with a SMALL list of other monthly bills besides the mortgage. I do have about k in other unsecured debt from the business and other unsecured creditors from when i was young that i never took care of.

I have thought about bankruptcy, chapter 13 is a no-go mostly because i cant afford the mortgage payments now so why would i waste my time with a 13?Otherwise it could work,but otherwise i dont really need a bankruptcy if were not including the house mortgage because i could just set up monthly payments with my creditors at a small payment.

My problem seems to stem from my home, i have about 40k worth of equity in a 117k home.

With that kind of equity, it really does not make sense to file a chapter 7 because in my state you lose all equity besides 5k no matter what.

It really doesnt make sense to do a 13 because as already stated i cant afford the payments now,much less the payments to all my creditors plus the mortgage.

And the only other options are selling, of which is not really an option because foreclosure has already been initiated.

Or a deed in lieu of foreclosure, but then im giving them all of my equity for "free" although the foreclosure would likely not show up on my credit report and i could begin to repair the other damage.It would be faster to do this than to wait 10 years for a BK to come off the credit or 7 years for a foreclosure to come off.

OR just let it be foreclosed on……thats not appealing at all ofcourse.

Hi I am 18 and i recently got in 17,000 dollars in debt of medical bills after getting help of the gov. i live in nj in a room in my parents house i have no job, no car, basically nothing (I do not go to college). i want to declare for bk since im young and will have it all over my late 20’s but i dont know what effect it will have on my parents… I plan to work work construction later in life (Will the bankruptcy affect this?)

this is from a consumer loan company I filed bankruptcy on..now they are trying to put a lien on real estate I do not own…my ex wife does..i never received a summons or notification…just saw it online when looking something else up
the court action is against me in this case…she had already been notified that the loan co was going to garnish her wages for the loan (joint)..the divorce decree states I have to pay the loan..I couldn’t and filed BK …how can the loan co come after me? I have been told by attorneys to pay her the wages back she is having garnished…because of the ruling in the divorce

I filed a Chapter 13 in 2007 due to multiple problems with my mortgage company. Last fall, my house burned down and the insurance covered the loss. We rebuilt in the same place and I used a part of the contents coverage money to pay off my Chapter 13 early. I had a small personal loan that was included in the BK (because everything has to be included, even good accounts) and the trustee sent them a lump sum payment of the loan balance principal plus interest (a lower rate than my loan was written with). The loaning party used the money to pay off accrued and what they considered past due interest and late fees and left me with nearly all the principal balance still "due" and began dunning me for payments. Am I obligated to continue making these payments since they already got enough money from me to pay off the principal plus a reduced interest rate? I cannot ask an attorney due to major non performance issues with the attorney who filed my BK.

I filed chapter 13 in 2004. I was told that my plan would be for 5 years…my payments were changed 3 times so that I would meet the 5 yr time frame. When I check my acct summary, I notice that the plan base amount is about k less than the claim amount. I never paid it attention, just kept making my payments. A few weeks ago I called my attorney’s office to inquire about possibly refinancing for a buyout. When the assistant went online to check my balance (which I would’ve needed for the refi) She said the trustee made notes that he would be discharging my case 12/07 which corelates with the base plan amount being paid out at that time. What is the difference in those amounts. Why was I told I would be in BK for 5 years? Who should I believe?

I asked this question last week, and I would like more answers if you could answer them. I am a few months into a 60 month plan chapter 13 BK. I owe the creditors about 7,700+,700 lawyer fee. I pay .00 every two weeks. And it is set at 70%. I dont have my home included in this, because I make sure I pay this every month and on time. My question is – what are my chances of calling these credit card companies (or the collection agencies that took over these accounts) and asking them to set up payment plan that I can afford with no interest? I want to hear all advise. Let me just add, that I do not have my home included in this. Can the credit card companies sue me and have my wages garnished or put a lien on my house If I dont send them what they want every month?

our case has been represented by a BK Lawyer but unfortunately I never get any feedback from him or his office, I went to court 2day & my lawyer did not show up therefore the trustee has continued my hearing for the payment plan for next Wed.the trustee told us that he cannot preseed this case 2day with out our attorney & that the declarations pages have not been filed at the clerks office. our attorney had 30 days before this date to file theses declarations and the attorney has not done his part, we have already & always provide the lawfirm all proof of payments with money orders, mortgage/bank/car/Statements all paid on time we are current with our loans. we are scared that the trustee might convert our case to a CH 7. we dont want 2 Loose our home we have Equity on our mortgage this is why our case was converted 2 a CH 13 by this attorney. please give me advise but the truth what will happen 2 us & our home. we are husband/wife filing for BK 13, we have no minor children our kids are adults now.& we are paying for our 2nd & 3rd loan with the bank all current.& we are making the Trustee’s payment on time & current. tell me what can we do?

How long does it take to receive a notice that your BK case has been paid. I paid the whole balance off in February 2010. Can I contact the Trustee to receive a notice of closure or my BK lawyer?

I am considering filing chapter 7 bankruptcy. I have 3 major credit cards, all of which have been charged off and added up have a balance of roughly 20k with interest and attorney fees. I also have some other random bills which have gone to collection: cell phone, utility bills, medical bills, etc, that add up to about 3k. I also owe about 10k in back taxes to the IRS, which I’m not sure if this could be included in the bankruptcy? I have made some mistakes in the past, living beyond my means and am much more educated and mature now and would like to get my life and credit built back up.

1. Is bankruptcy a good idea for me?
2. Can taxes be included in a bankruptcy?
3. How long does it take to get my credit built up to say a 650-700 credit score after a BK and are banks willing to give you a loan if they see you have a bankruptcy, even if your credit score is good now?

I worked for a mortgage company in 2003 and we would give someone a loan the next day after a BK discharge. I know things have changed but any insight in today’s credit market and how a BK is viewed by creditors in 2009 would be very helpful. Thanks

I have a debit card with a visa logo. If i make a purchase online it will automatically take it as credit. Would this affect in anyway on my bankruptcy case?
It is an ATM card with Visa logo. Not a credit card.
