A neighbor alleged an injury caused by my negligence. I am preparing to file chapter 7 bankruptcy. I understand that if the neighbor obtains a damages judgment against me, it could usually be discharged in bankruptcy. But what about a prospective future damages judgment arising from my past (alleged) negligence? Does it matter whether my neighbor has filed his case yet or not when bankruptcy relief is granted?

My husband’s business is run as a sole proprietorship. We are considering filing personal Chapter 7 bankruptcy. One of the credit cards we would like discharged was used for business expenses only. We have already deducted the business expenses on our 2010 income tax, even though at this point they have not technically been paid. If the debt is discharged, how does this affect our income taxes? Will we have to file an amended 2010 return omitting the expenses, thus paying more tax? Thanks!

Ok, my husband and I are in about ,000 in debt, He lost his job so he gets unemployment which the amount doesn’t even cover all the bills, I don’t have an education (I do take classes to get my G.E.D.,they take up my entire day; literally. I will be finished with it on May. 31,2012),so I am currently unable to work. We don’t go out to eat at all(strict diets and we hate people to serve us).We don’t have any extra expenses because our families pay for mine and my husbands cell phone,house phone, cable, and my husbands car insurance bills. His check is gone as soon as we get it so we had to get food stamps and medicaid just to help keep food in the house for our son and ourselves. I can’t get a loan for school to go to college when I finish, I have been told that if I file for bankruptcy then I won’t be able to get a grant,by a friend. I hate being in debt, having to rely on family to pay our bills , and not ever having any money,even though I am grateful to have a family who is willing to help us out when we need it. I
have done a lot of research on this matter and even went to 2 different financial planners who have both said to file for bankruptcy is our best option. We own an ugly old trailer(only worth 00 and 1 automobile worth 00, with a initial property value of 00 so every thing we have is safe from the property liquidation process). Oh yeah did I mention we are expecting another child? So I have advised a plan:

Plan:( we usually receive 00-00 in income taxes FED and 7 State, Husbands pay check 00 monthly even)
1) File for bankruptcy after I get my income taxes.(Filing for bankruptcy can cost in between 0-00per person if filing separate or 0-00 if filed together and we have someone who owes us money who is going to pay for out credit counseling courses and test, still no where close to what he owe us).We are filing it together.We would be filing for Chapter 7 Bankruptcy.
2)My husband and I would then open up a secure loan at the amount of 00 each that has a 6.9% interest rate and fees.
3)Now that all of the numbers have been ran, it is going to cost 04.11 per person to pay off the secured loan ( I figure we just open up a savings account, each, with the loan and put in 4.11 per person to cover the cost) and make automatic payments from said savings account for 1 full year. As I am sure every one knows the longer the on time payment history is the better credit rating you will receive. ( I figure we will need to do this for 5 years)
4)Take my husbands pay check and open 2 secured credit cards per person for 0 each with an interest rate at 1.5% .(only so low because it is secured, We both have terrible credit)
5)Turn around and pay our monthly bills with the card( bills and monthly hygiene products equal up to 2 monthly without paying off debt,we won’t have any more.)
6)Turn around again and pay off the cards with his pay check (our parents each said that they will give us 0 to pay for our 1st months bills free and clear as long as I finish school , so 00 cash total.)
7)Do this for 5 years while putting the released funds from the secured loan in a separate saving account at the end of each year for a house down payment(,000 plus interest)
8)Now 1 year after we set this up we will have 2 children, 1 will be 6 the other will be almost a 1.I will be finished with my G.E.D. education, Already started college( I found out the you can still get grants if you file for bankruptcy, they even have grants for people and student who have filed for bankruptcy,so my friend was wrong.)So now I can start saving for my children college,I chose the Gerber Life College Plan, I can pay 06.12 annually from my income taxes so that they will have a fair amount to get them started(I am only getting ,000 per child).
9)Still 1 year after plan started, use the some of the money form my taxes to open up a life insurance policy for the family, I chose 1 for 0,000 and is 2.09 a year(,000 per person).
10)Still 1 year after plan started, put the rest of our income taxes (about 07.68) every year for 4 year in our saving account for the house down payment(a total of 030.72 plus interest)

Ok so about 6 years into the plan we will have about ,000 in savings for a home, a credit score of at least 700 FISO (each), a good size life insurance policy for the family, a college graduate, A working college fund for our children, and an eye out for a modest home.

So my question is, Will my plan work if we stick to it? Oh yeah take in affect my hubby isn’t going to be unemployed forever and neither will I.

I am a computer professional with 11 years experience, some college, some tech school, no degrees. After school, I was unemployed from late 2008-2010 because apparently we are in the throes of our 2nd great depression. Currently I work at the only job in my city that was willing to hire me; a gas station. I am a clerk dodging bullets on third shift, dealing with people writing their names on the bathroom wall in feces, and bringing home 240 bucks or less every two weeks. I was denied foodstamps and healthcare by the state of WI, so to survive during almost 2 years of unemployment before landing my gas station career I took out a credit card to buy food, gas, and outrageously priced cigarettes as I’ve been unable to quit (judge if you must). Currently I have racked up nearly 13,000 dollars of credit card debt. Each month I pay in 200 to one card, and 120 to another leaving just enough for rent… most of the time. (Not electric bill, food or other expenses). I have been applying to an average of 5 jobs per day only to be ignored time and again, and last week I gave up completely on looking for work, and have decided to enjoy my life a little rather than hanging out at a job center every day off. I own nothing. I have a beater ford escort from the early 90s that I purchased for 250 dollars cash, a matress, some sheets, and a couch I picked up off a corner. I also own a dartboard and a cheap handgun given to me by my girlfriend’s father (which I think about using daily). Not really worried about the repo man coming to call if you know what I mean. Since all the debt was used buying perishable goods, and since I can’t find work, I am thinking my best course of action would be to file chapter 7 bankruptcy so I can once again sleep at night, riding my bike in the summer, not working winters, and just stealing food to survive. Being white and having no children it’s more than obvious welfare won’t work for me. Just looking for some insight… maybe someone has some advice for me.
It’s my understanding they can only garnish wages in a chapter 13 bankruptcy, and even then, only on disposable income. Making just under 00 dollars a year, this just isn’t feasible to repay. It’s starting to look like this is my version of a government bailout…

I have a chapter 7 bankruptcy that was discharged in 2009 april….i have a company who is now trying to collect their debt that was discharged….they have even put it on my credit and I was actually denied a car loan due to this debt…..can I do anything to them legaly…ie…sue them or somthing and it should be their resposability to fix this on my credit right.

My husband and I filed Chapter 13 bankruptcy in October of 2008. We have came to the crossroads in our life where we can not afford the monthly payment for our chapter 13 Bankruptcy any longer and still be able to provide for our family and we have 2 small children. We have contacted our lawyer and explained our particular situation to him and he just does not seem to care. He stated that the payment was as low as possible and still be able to pay out in the 5 year time period. We are researching converting from a Chapter 13 Bankruptcy to a Chapter 7 Bankruptcy. The only asset that we have is a 2004 Chevrolet Trailblazer LS that we still owe more than 10,000 dollars on and they are only paying 108 dollars a month toward this as they are paying the lawyer as well. Can someone please explain what the pros and cons would be to converting to a Chapter 7 Bankruptcy? And if this is even an avenue that we can look at.

So here is my story. I filed for Chapter 7 I believe back in 2001 or 2002. It was a horrible experience and probably lowest point in my life! Since then, I’ve slowly and gradually just paid my bills on time and just bottom line, learn from my horrible mistake and move on.

Just the other day, I proposed to my girlfriend, BOY was that nerve wrecking! But I can’t believe I actually took that huge gigantic step. BTW… she did say "YES" :)

Since it’s only been a day or so, we have to sit down and open up about what "we want" for our wedding and future. One of those scenarios is, buy a house, condo or even rent. She has pretty good credit and me… well, I have that Chapter 7 on my record. So I went into the Free Annual Credit Report website and looked how it looked from years past. "Considering" the past, alot of the bad stuff has dropped off but I noticed that the one that concerned me the very most looks like it might drop off at the end of this year?! Can someone here take a look at it and give their opinion? Here it is:

If someone recently filed Chapter 7 bankruptcy in Georgia, and has fallen behind on making their monthly utility payments as a result of trying to make their bankruptcy payments, can their utilities be disconnected? I know that disconnection can be suspended if the person files back utility payments under their bankruptcy; but, does the same rule apply, if the person didn’t include their utilities in their bankruptcy and fell behind on making payments after they filed Chapter 7 bankruptcy?

To start, I am now pretty humbled. I was making 60k a year, driving a new sports car, and living life happily with minimal debt. My wife and I made some poor financial decisions and I was left with a bit debt after our divorce. It is now at a point where with the economy, working in the sales field, I am only making just under 40k. I have 22k left to pay on the car at 0 a month, paying about 0 a month in gas to travel to my job,about 20k in unsecured debt. I had to abandon my lease in the apartment that I was living in so i have no clue what I owe to them. I tried to trade the vehicle in for something different but trade in is only worth 15k, so about 7k in negative equity, and with a low to mid 500 credit score, nobody is willing to work with me. I have thought about filing a bankruptcy, but even at 40k a year, I am above my means for a chapter 7 bankruptcy according to lawers, and breaking too even per month on a chapter 13. Maybe someone has a idea of a solution. thanks.

Our debt was just discharged in Chapter 7 Bankruptcy on July 13, 2010. We had a mortgage loan (fannie mae) and a 2nd mortgage as well as Obama’s loan modification plan. While we discharged EVERYTHING we are just starting to go through the forclosure process. Since we’ll lose our house we now need to figure out what we are going to do…there is not much for rentals in our area so we would like to buy a cheap house or buy a lot and a manufactured/modular home.

Since we just got out of bankruptcy would we qualify for a mortgage loan or construction loan? I understand our interest would most likely be high and we may have to put a down payment down but is there any reason we wouldn’t be able to get a loan now?
2nd question:

so if we won’t qualify for a mortgage loan or a construction loan…If we were able to find a rent to own home or a contract for deed how would they work?

I filed personal chapter 7 bankruptcy in 2007.
I now own a business, a daycare, that is failing due to so many parents being out of work.
Is Chapter 11 the proper bankruptcy to file for this type of debt, and if so, am I eligible?

My HOA’s Attorney raked up excessive unjustified fees on me for their own personal gain. I was late paying my HOA fees initially and willing paid the stated late fees along with my HOA dues. However, the Attorney collecting these fees does not accept credit card payments over the phone or online, etc. Therefore, I mailed the amount owed. To my surprise, I later received another letter indicating I owed another 0 for late fees. I ignored this notice b/c I thought that they probably didn’t input my payment in their system prior to the letter going out. So I received another letter stating I owed the 0 plus additional fees, and so on. Basically, each time I paid the stated late fees via mail, the Attorney claimed my payment didn’t arrive on time to their Office, and therefore I owed additional late fees.

In addition, all of my payments were applied towards Attorney late fees rather than my HOA dues. My dues were only 0 per year, but within that year I paid over 0 in additional fees that were never applied towards the full amount owed to my HOA. The Attorney continued to take their money off the top and say that I still owed a balance towards my HOA dues. As a result, I stopped paying b/c I felt I was being ripped off and the fees continued to increase. They ended up suing me for the amount they claimed I owed along with more Attorney fees and court cost.

Since I mistakenly missed the initial court date, when I showed up for the second court date where they filed a judgment against me, they won simply b/c I missed the initial court date. Now they are garnishing my bank account for the amount owed from the judgment.

Currently, I’m unemployed and my home is in foreclosure. I recently filed chapter 7 bankruptcy to stop the sale of my home so I can have time to secure a job and work out a modification on my home loan and get it out of foreclosure. I have not had the meeting of creditor’s as of yet. Can I discharge the past due HOA fees from the judgment/garnishment? I am willing to pay the past due HOA fees I accumulated after the garnishment since I intend on keeping my property. Also, I live in Georgia. Thanks for your answers.

I hope when people read this they do not judge…as I am only asking a question to make a decision. Over the past 3 years, my husband and I have lost about 00 in income per month due to job losses and pay cuts. This was immediately after purchasing our new home during the housing market boom. We managed to stay afloat by going through all my 401K money, and my husband taking a second job. It soon got to be overwhelming, with us having 3 children. Many times neither of us saw my children for days due to the fact that we were both working evenings. They are age 14, 13, and 7. The stress of having to take care of everything was beginning to effect my daughter, so I decided enough was enough. Some things are just more important than that big beautiful home. I made my husband quit his second job, so that someone could be here with the kids in the evening. We have since filed chapter 13 bankruptcy, as we were getting taken to court to be sued by a few of the credit card companies. My mom saw how stressed out we were, and came to us and asked us to move in with her as my father passed away 3 years ago unexpectedly. She wants to help us and in turn it would help her as she is by herself and could use help keeping the home repairs up not to mention she is terribly lonely. She doesnt want us to pay her anything, which would allow us to save a lot of money and get back on our feet financially and she also wants me to go back to school so that I will be able to get a better job in the future. (I was halfway done with school when I had my first child and had to quit.) We are very fortunate to have this opportunity. We currently have put our home up for sale and are in the process of chapter 13. I doubt we will sell our home with the housing market being what it is these days. So we made the decision that at the end of the school year we will move into moms. I will quit my job so that i may attend school full time, and we will convert to a chapter 7 bankruptcy, and let the house go into foreclosure. It was a very painful decision for us, and we have lost a lot in trying to keep up. My question to everyone is…if you had this opportunity would you take it? It is a gut wrenching decision for me and my family, so please dont think we are taking the easy way out.
