My husband and I filed for chapter 7 bankruptcy 6 weeks ago due to a wage garnishment and other reasons. Our lawyer told us because of the timing and amount garnished we would get all of the garnished money back. The automatic stay has been in place for 4-5 weeks. My question is when or how long does it take before you receive that money back?

I want to file Chapter 7 to totally get rid of my debt. The only problem is my spouse doesn’t agree with this, so I would have to file by myself. I have 5 credit cards in my maiden name and 1 credit card in my married name. My medical bills are in my married name. As far as my assets, my name is on the house but not on the mortgage. My name is also on the two cars that we own.

Can I file Chapter 7 bankruptcy without the cars and the house being affected? If I can’t file by myself then what else can I do?

My parents may be filling for a chapter 7 bankruptcy and have 4 cars in their name (my truck included). I just paid my truck off and am about to put it in my name. If my parents file for bankruptcy soon after I put my truck in my name can they still take my truck? I heard there was a year time period between letting go of assets and filling for banckruptcy before those assets cannot be taken. I live in Colorado Springs, im sure theres different laws depending on state of residence.

I am only 25 years old and have a little over ,000 in revolving debt. About ,000 is unsecured credit card debt and ,000 is on a leased car. I am getting over my head in bills and falling behind by about 3 months on most of my credit card bills. I have creditors calling me and I avoid all calls now because they are so rude (as if I owe them personally). I am under so much stress that my health is being affected. I met with a credit counselor regarding debt management and came up with a plan to pay 0 a month to pay towards my debts, over a period of 5 years. I added it up and the debts I will be paying is only going towards the ,000 credit card debt and 0/month for 12 months for 5 years equals out to be ,000 that I will pay out on a 000 debt, well over what I originally owe. Also, I have done my research and debt management seems very similar to filing Chapter 13, so I am considering filing for a Chapter 7 bankruptcy, can somebody clarify what my advantages are over the disadvantages. I know that filing for bankruptcy is bad on my credit but I think that if I file bankruptcy it will be easier for me to save money towards big major purchases in the longrun. Plus I am only 25. Assuming by the time I am 30 it should be alll good right? Am I thinking naively? Also I was thinking that if I file before my fiance and I get married, it would be much better? Also what exactly do I need to qualify for a Chapter 7? Please help!!!!

I filed chapter 7 bankruptcy due to a failed business and was discharged about 9 months ago. In my bankruptcy filings I surrendered my house and moved out after the filing. To this date the bank has not yet foreclosed on the property and I was just taken to court for the 450/month HOA dues for the past year. The house has been empty all this time and now I am out over K. I thought about renting out the place to recover some of this money , but I am concerned that there may be consequences to renting when you are technically in foreclosure. I want to accelerate the foreclosure process and get rid of this issue and get on with my life, but not sure how to proceed. Any guidance would be appreciated.

my friend file a chapter 7 bankruptcy in 2005 and has now been out of work for a year and a half.
Is it to early for him to be able to file for bankruptcy? what’s the time frame from being able to file for another bankruptcy I guess, is what I want to know? and if chapter 7 the best one for him?

Are judgements discharged in chapter 7 bankruptcy. Example if you were evicted from an apartment or house. Also if you own your vehicle will they take that or do you get to keep it? And how long does it take for your credit score to improve and for you to be able to apply for credit again?

I filed a Chapter 7 bankruptcy that should have been completed in July or August at the very latest. My lawyer claimed to have not received my certificate of completion for the post bankruptcy course and let it go. My case was discharged before he told me anything was wrong. I’d called a few weeks before and was told everything was fine ad I’d receive confirmation soon. I was able to prove that he received the certificate and he paid the fee to reinstate my case. I planned when to file so that a year later I could co-sign on a home loan with my husband when he got back from Iraq. Now it’s just been filed and my 1 year mark will be 5 months later so my husband will come home from Iraq and we won’t be able to buy a house. This was hard enough and now he’s made it even worse. We’d have to come up with 15% down at least to get a loan. Can I sue my lawyer for his incompetence and this inconvenience. I’m not looking for free $, I’m just really frustrated and heart broken! You don’t know my whole situation and you don’t have to be a jerk. I wasn’t scamming anyone, I stopped working when my daughter died and we couldn’t affort one income at the time. It’s better to pay on a house than to waste money renting so we weren’t planning a scam we were planning to recover from this nightmare!
I can prove he got the certificate because the company I took the course through has the email and fax conformation. I have already spoken to several lenders and they all say 1 year.

If I include my mortgage in a Chapter 7 bankruptcy filing, how soon after filing will I have to vacate the property. The auction sale date for it is January 11th.

My attorney just filed my petition for chapter 7 bankruptcy and I am going to a meeting of creditors in about 4 weeks. Do I continue paying on the loans i wish to reaffirm and try to catch them up (I am currently 1 payment behind on my car and i want to keep it) or do I wait until the meeting of creditors and just reaffirm? After reaffirmation will i have to catch up what i was behind, or do they just add what i was behind to the loan and allow me to make regular payments again?

Can someone answer this for me. We would be eligible to file for a chapter 7 bankruptcy in a couple months. My question is If we filed for a Chapter 13, BUT it has not been approved by the trustee and payments have not yet been sent to creditors, then would I be able to stop the Chapter 13 and just get a Chapter 7 instead???

i filed chapter 7 bankruptcy in 1999 jointly with my wife. it’s still on my credit report for another year. i have 40000 grand in credit card debt again.i know the laws have changed for bankruptcy.can i file jointly again and still reaffirm my mobile home loan and keep my crappy cars that are paid off,but they are badly damaged by hail so probably worthless. basically am i allowed to file chapter 7 bankruptcy again?

I am still getting letters addressed to me from HO Assoc threatening to attach a lien to property that I surrendered in Chapter 7 bankruptcy that was discharged Nov 09. The property was auctioned in Feb 10 but not sold, do I still owe the HO Association?

I want to buy a 2008 Suzuki Burgman 400cc scooter, (can’t use a motorcycle, leg problems). The bike costs about k. My credit score is 640 right now, which isn’t half bad. But on the other hand, I filed for chapter 7 bankruptcy in april 2009, which will probably affect my interest rate. I got a low balance credit card 6 months ago to help me rebuild my credit and credit score. Seems to be working (old score used to be 560).

Money is a bit tight though right now because I’m also trying to get myself a college degree. Did the idiot thing and dropped out years ago. I’m paying cash right now, but once I get my gpa back up to par, I can get financial help from fafsa. When that happens, I’ll need a vehicle. I do distance education at the moment, but some of the courses will unfortunately be on-campus. Also I’ve heard that even with D.E., some instructors still like you to come in for labs, lectures, etc once in a while. So I need something more reliable than having to borrow a vehicle off my friends and family. I think I can afford a cheap vehicle if I plan it just right. But I need to factor in the monthly payments and insurance costs first to decide whether I can really afford it.

On rough average, How much do you think the bike payments and insurance payments would run me per month?

If a person files chapter 7 bankruptcy, will he/she get to keep any property?

What about chapter 13 bankruptcy?

I know it really depends on the person’s income and how deep they are in debt, so I’m going to give a scenario.

The person:
-owes family members money (,000)
-still has to pay off the house (4,000 left)
-has a business with equipment (more than ,000 worth of equipment)
-the business lease is (,650 each month)
-credit debt (0,000)
-no one has sued and no one is currently suing him/her
-two cars that has been paid off, but the bank still has control of it (,000)
