My bankruptcy has been discharged for about 1 year. I got a Capital 1 credit card a few months ago. I was approved for a 0 limit and since I paid the TOTAL amount every month, they raised it to 0 after 3 months. I am still paying off the balance in FULL every month. I started checking my credit score online in December and the average of all the credit agencies was 618. In Jan in went up to 621, and its still 621 now (Feb). I only have the one credit card, which I am doing the right thing with… so why is my score not going up by much? I dont want to get a bunch of credit cards (its what messed up my credit to begin with). I did apply for a Best Buy card over the weekend, but was not approved. I am looking for a new car, and Carmax approved me with "no documentation required" for 11.65%. I dont know if having a car loan will help or hurt. Does anyone out there have more experience with this?
I filed for bankruptcy because I messed up my credit from 1998 to 2002 (age 18-22). I filed in 2007 and it was discharged in 2008. I tried my hardest to pay off my debt from 2002-2007, but was not making a dent in it due to fees, interest etc. I am not one of those people who took the easy way out. The only reason I got the 1 credit card was because I was told it would help with my score. Charging only what I know I can pay off in full each month should say something about me and the lessons I have learned.

I want to file Chapter 7 to totally get rid of my debt. The only problem is my spouse doesn’t agree with this, so I would have to file by myself. I have 5 credit cards in my maiden name and 1 credit card in my married name. My medical bills are in my married name. As far as my assets, my name is on the house but not on the mortgage. My name is also on the two cars that we own.

Can I file Chapter 7 bankruptcy without the cars and the house being affected? If I can’t file by myself then what else can I do?

I graduated Pharmacy School Summa cum laude in 1991.All of my experience had been in retail pharmacy. Married a complete loser in 1994 and went on a path of self destruction. Charged with 3rd&4th degree cds felonies in 1994 and completed all sentencing early in Feb of 1997. I voluntarily gave up my pharmacy liscense in NJ at the time of arrest. Had to claim bankruptcy at that time, credit cards, car payment etc, didn’t cover student loans. I am in default on loans and I am trying to work out something w/them now.Have been told I have to wait 10 years to get record expunged. I had my son in 1996 and have devoted all of my life to him. Have been trying to get a worthwhile job for quite some time but, haven’t been very successful. Finding my self in a situation where I may have to move out on my own and support my son and I need some advice on how to present myself to potential employers, on resumes, on interviews and any advice as to what kind of job I should try for with my educa.?

I am retired on fixed income. My home was just foreclosed on. My credit is already ruined. BofA has upped my interest to over 25% and I don’t even use the cards to increase debt but have offered to close account and they still won’t help as I don’t make enough $ to get approved for a lower payment. That’s what they told me! So I have 2 credit cards with balances just under 00 and am unable and it doesn’t make sense to try to pay them when it almost all goes to interest… I will be dead before they are paid off. Repeated calls and threats to stop payments have not helped. I have a 7 yr old paid off car and medical issues that require Rx’s. What is my best recourse? Filing bankruptcy costs too much also. I told them I wanted to pay what I charged but their interest rates were destroying me. Can my Social Security be garnished?

Hi.. I recently was served with a summons and complaint that states I have twenty days to respond to it in writing to the court or I will be faced with a default judgement. I have looked up alot about this online and found out that in my state (indiana) I can file a "Motion to dismiss fo failure to comply with rules" if the plaintiff did not have a contract written instrument not attached to the complaint and summons, and it did not. I still need to call my court here in my county to be sure that it is the rule before I can try this though. I need to know how to word my answer if I would go with this route and if even if I dont I still have to answer to avoid the default judgement. I know that I need to go through and deny each complaint that is numbered on the sheet but I do not know how to word it exactly. The reason that I am being sued in the first place is because my b/f and I had a couple credit cards that I was a joint on with him. He was always the one responsible for making the payments. He ended up having to file bankruptcy, and once the case was discharged it automatically made me the one responsible for the amount. I have no way of making any kind of payment on it at this time. I have been out of work since 2007 when i found out I was preg with my daughter and i have been a stay at home mom since. So i know that the judge can not order for any kind of wages to be garnished and I do not have any assets for them to take, so most likely its just going to be on my record and if I would get a job or any money withen the next ten yrs or so id have to pay it then. Do I need to deny the complaint in my answer even though I know its true .. or will the judge just order me to pay it then because he wouldnt have been able to hear my story or i guess situation? The complaint states that 1. The defendant is indebted to the plaintiff int he amount of ***** plues accured interest of **** as of jan 2010.
2. Venue is proper with this court and based on the defendant residing in **** County.
3. The plaintiff owns and is the holder of an acocunt due and oweing by the defendant, and is the asignee of Elan/ Mainsource bank.
Wherefore the plaintiff respectfully requests the following relief.
1 Judgement against the defendant in the sum of ******* plus accured intesest of **** as of jan 2010
2 Interest thereon at the rate of 8 percent per annum from jan 2010 , and 8 percent per annum from the date of judgement , until the judgement is satidfied.
3 For plaintiffs costs herein expended
4 For any and all other relief to which the plaintiff may be entitled pursuant to contract, statute. or common law.

My husband and I are going through some financial hardship as he is seeking employment (although he does bring some money in due to VA benefits) and I am having a baby w/ unpaid maternity leave and won’t return to work until Aug. as I am a teacher. We’re also on 10 mo. contract so no pay in July and Aug and very minimal savings to contribute to the summer. Here are our bills:

Any advice as to when I can’t pay one what should I do? We’re also considering bankruptcy … bad times but we’ll survive! :)

Okay so I am a correctional officer right now, working on my degree online in criminal justice and i turn 23 next year, which are some of the requirements i have heard of to become an FBI agent. The problem is that I got divorced about a year ago and my ex husband left me with about 3 credit cards that were maxed out at the time, I cant afford to pay them, one of them is 00 alone, So when i get taxes back next year i am thinking about filing for bankruptcy. I read that to be hired into the FBI you have to have a credit check. So will filing bankruptcy hurt my chances of being considered for the job?? Please only answer if you know the answer, I really need to know!! Thank you so much!!

We are going to file for Chapter 7 this December. I was curious how many months they usually want to see. Most places I read it is 3 months. I am hoping it is 3 months because we were not expecting to file until now and our statements might look bad any further that 6 months back.
The reason we have to wait till December is that my husband had a previous bankruptcy before I met him. The lawyer told us to wait. We are not paying our credit cards because we can’t afford it.

i have 2 repos, some other loans , 2 credit cards about 1000 a piece and some collection accounts on my credit, what would be the best chapter for bankruptcy to be filed? many sy chapter 13. i am looking for a clean start

My case is not actually filed yet because my Att. fees are not yet paid in full. I cut up all credit cards on the day I went in for a consult. I did not charge anything after that day but I have and did I shop with my debit card. I now only buy the absolute necessities. I may not qualify for Chapter 7 because I still have between 0-0 left over after all expenses at end of month so may need to file for Chapter 13. This left over money (all of it) would go to pay my reorganized debt, but if any emergency were to happen I don’t know what I would do. My doctor just took me out of work for a month due to excess strss/anxiety/fatigue. So now I’ll miss a month’s salary. This medical situation is not a shocker, it’s been a bomb waiting to explode for a long time and it finally happened – mostly because of work related stress. (I am a single 30 year old Flight Attendant) I do not know what to do at this point in regards to my financial situation. It seems to be a downward spiral. HELP!

I was an authorized user on my Mom’s Credit Cards….?
Now they are saying I need to pay, her unpaid bills.
I was a minor when put on the credit cards as a authorized user, and now they are saying I’m the joint account holder, when she never signed me up for that I was a minor! Now, I’m only 18.

Anywho, she’s filing Chapter 13 bankruptcy on her CC debt, (the ones with my name on them too) but they are saying even if she does, I’ll have to as well. Shouldn’t the debt just be taken care of once she files Bankrupcy on it, or can they really make me file bankrupcy as well, to get it out of my name?

It’s already effecting my credit, as we never gave them ANY information other than my name and maybe my birthdate, but somehow, when I went and checked out my credit report, all the 4 credit cards that I was authorized user on, are there…. showing that Im in default.

What can we do?
Will I really have to file, EVEN if she does?!

This year has been extraordinarily difficult and I’ve had to use the money that I was setting aside for property taxes which are due in Jan and Feb. They give you till the end of Feb to pay without penalties. Credit cards and title loans aren’t an option, those have already been tapped this year as has the Roth which was depleted anyways because of previous problems years ago. About the best I could hope for would be to borrow against my 403b but again due to serious problems a few years ago (including being told I would be dead within two to five years by Doctors), I never amassed anything significant there and actually nearly lost track of having it. It would only be enough for maybe half of the property taxes. There isn’t any equity in the home that can be drawn on, I’ve only had it for a year and aside from antique computers, I have nothing to sell. There’s a benefits retirement program but because I had a backup job that reactivated the program when I lost my job in April, I can’t touch that money at all unless I quit my job. Also that money may have gone into the State lost funds thing because I lost track of a lot when I was really sick a few years ago. So now with maybe four months max to save up for property taxes, which means it isn’t going to happen, what’s going to happen when I can’t pay the full bill by the end of Feb? Should I file for forebearance from the mortgage company? The Obama MHA would require an escrow for the taxes to be established, if I can’t save up enough for that by the end of Feb, how could I establish an escrow for that amount? Should I let bills go into arrears to save up for the taxes? Should I just declare chapter 13 bankruptcy?
I should probably add that I’ve lost a third of my income. I had a backup job already arranged when I lost my job in April but it was at two thirds the pay with better benefits. My girlfriend also had legal problems that I sorted out for her but that has left me with a budget that doesn’t balance. I’ll make it balance somehow, I have to. But loosing one third of my wages is loosing over k. I’m in a serious negative cash flow situation. I should be able to pick up some contract work, that should bring in up to 20% more cash but that’s not a certainty. Can’t ask family, sister had a stroke and is about to declare bankruptcy if the hotel folds. Probably need a DMP to make budget work.

I am getting married and need money to pay for this wedding. I am an only child and have hardly any family left. I have really bad credit from a previous marriage, my ex husband ran credit cards in my name and took out loans in my name, I had to file bankruptcy to have all these collectors stop calling. I applied for a couple personal loans but did not qualify. Is there such a place where they will loan me money with a credit score of under 500. Do you know the site that i can get more information about it?

We started operation of our own semi (hence called a trucking company), 3 and half years ago. Semi is paid off, but last year, engine blew, cost was 18,000, and we lost a big account. The small accounts we have are not cutting it. It has been bad for the last year and a half (it was probably always bad, we just did not realize it yet). The gap between paying the bills, and supporting the bills with credit, is almost completely closed. We still have good credit (well, my shows too many credit cards, about 630 score, hubby’s is 720), but we are still barely paying the bills, last month, we had two late fees, totaling 40 each in late payments. These kinds of things are happening on a regular basis with no light at the end of the tunnel so far. One major breakdown again, and we are finished. I need direction fast, before our credit and name are dirt. I have contacted credit counseling, one was legit, the other a scam, which I did not fall for scam, but the legit one said my interest rate was so low on all cards, that they could not help me that much. The one thing that could help us would be to re-fi the house, and consolidate 1st and 2nd mort, but our tax return shows we made a whopping 6500 bucks. Any direction appreciated.

This year we went under on our home based business! We filed chapter 13 on September 15 2010! We filed on our credit cards and other non secured debt, but left our 1st and 2nd mortgages off! What I mean by off is that we would be paying directly to the lender and not through the trustee off the court! I thought that we were current with our first mortgage; I knew that we had gotten behind on the 2nd but caught up before filing chapter 13! To make a long story short I didn’t find out until I went online and checked our past bank statements that we were behind on the first mortgage! We are still current on the 2nd but the first is looking at foreclosure! We did receive mortgage modification forms sent to us by the mortgage company the other day! We didn’t ask for them they just them to us! My question is if the mortgage company decides to foreclose will this be grounds to have our chapter 13 dismissed?
@ Real, I have ask my lawyer and he didn’t think that this could be an issue! But I would just like some other knowledgeable people’s opinion on this!

I pulled a chapter 7 in Jan of 2005, because I had lots and lots of health related things back then, which I’m totally fine with now thank god, but it really made my bills huge, and I was younger and d8mb, and overspent on credit cards, and just did it.

Ever since then, I’ve actually managed to get other credit cards again and start re-establishing my credit score and credit history,thank god. That’s been a blessing, especially since my bankrupcy is current and they still approved me. I also had pretty high limits too, on some of them. But then again I’m also pretty well off so my total household income, etc..helps too.

However, what bothers me is this: after the full 10 year period, does it become completely irrelevant, and you can act like you technically never went bankrupt, and don’t have to mention it ever again, or what?

Even if you DO have to mention that you went bankrupt before in your life…being that the 10 year period is up, does that mean that it will have 0 effect on you and your score and the potential for companies to work with you and take you on as their customer?

Also..aside from the bankruptcy itself, I discovered that if you were late on all your bills for a significant time back when you went bankrupt, and those credit card companies lost money,..they still mark you as "never paid, delinquent," and all other derogatory terms on your credit report.

So it’s not like you just have one word "bankruptcy." It goes on and on about other derogatory items as well.

How long until THOSE get erased from your credit score? Or do they stay on there permanently?

I heard that inquiries and late payments and all of that stays on for about 2 years, and everything has its time frame.

So can someone answer how long the rest affect you for?

And what I can do to get them removed from my credit reports, if they’re on there for a longer amount of time, or what not?

I didn’t have an Attorney!…

* I didn’t qualify for a free Attorney due to a Conflict of interest… (Because my Ex is a Police Officer in this State (DE)!)

* My Ex’s Parent’s PAID for my Ex’s Divorce Attorney, while knowing that my Parents couldn’t, because my Father is Deceased and my Mother has Alzheimer’s Disease.

* My Ex took (and/or Closed) all of our Money, Credit Cards, Bank & Credit Union Accounts, Stocks/Bonds, Medical Insurance, Pension, Etc.

* I was a "Stay-at-Home" Mother/Housewife, with NO income during the ENTIRE Marriage.

* I was 100% Disabled during the ENTIRE Marriage.

* My Ex Filed for Personal Bankruptcy one (1) week PRIOR to Filing for DIVORCE!

* My Ex ‘Abandoned’ our daughter & myself, but was NOT charged with ‘Abandonment’, because my Ex claimed that he took our 4 yr old Daughter with him when he left our home. (Which I have witnesses that can prove is False.)

* My Ex mislead the Family Court & was Granted an Interim Custody Order with our Child Residing with him, and NO Child Support, just a Bi-Weekly (for Myself) Visitation Order.

* The 14 Month old Divorce Decree DOES NOT INCLUDE:
- A Spousal Support Order,
- A Property Division Order,
- or ANY other Agreement/Order, besides the Interim Custody Order.

* The Divorce was Granted by DEFAULT, on the grounds of "Irreconcilable Differences".

I have been FORCED to depend on Friends to survive, and REALLY NEED to go after what I’m ENTITLED to, after being Married for 10 years.

Has anyone EVER been, or know of someone who has been through my situation, and if so PLEASE give me advice as to what I have a right to, or any advice at all, as to what I can do about it. I cannot seem to find any help online, or without an Attorney (because I can’t afford one, & can’t find one "Pro Bono").

by building my credit back up?

I have a 5,000 repossessed car, about 3,000 in credit cards and about 2,000 in doctor bills. I don’t own anything. I am disabled and have shown that i can’t be trusted with credit, but i want to change my life around and open a business. The only problem is, I don’t make enough money to pay off this money being disabled. Thats why i need a better career. Crafts and Mixed Media have always been a hobby of mine. I would love to open a gift shop, but i have no clue how to get started or even if i could do something like this with my life. I am 26 and most of these mistakes came from when i was 19-22. I feel like i ruined my chance at a young age. Please give me some input. Thanks so much. :)
