My debts have been discharged in Chapter 7. However, a major electronics store has contacted me indicating they have a lien against a laptop computer purchased from their store (on a store credit card) and they want the property returned. Can this property be seized?

So my hubby and I joined a debt settlement company to help with our k debt. It was originally for 48 months, we have completed 18 months and payed off some debts already. So now I have been served with 2 summons from 2 of the debts. the debt settlement company tried to settle with them, but they want way more than we can afford) Has anyone been thru this? My options are go to the court date and see what judge decides I have to pay, pay the huge amount they want(which we can do for a couple months but then just default again) or do Chapter 13 bankruptcy. This is just awful because I feel we were on the right track paying off the debts and learning how tomdeal with credit. I live in Texas so they cannot garnish wages or have a lien on my home. They can only put a levy on our bank accounts, which we no longer have direct deposit and have minimum cash in there in order to avoid them taking everything by surprise. Any opinions?

I just graduated college a couple months ago and can’t find work. I let my family take advantage of me and run credit cards up, so now I am ,000 in credit card debt. Part of which is a ,000 Care Credit account my step dad used to get false teeth after having his knocked out in an accident.

Now they are ignoring the debts they accumulated and promised to pay or they make excuses why they can’t. I’m an idiot for trusting them! I have sold everything I own to pay for the bankruptcy. I am being sued by two of the creditors.

I have no choice but to file bankruptcy since I have no income and no assets. I am seriously thinking suicide might be an option as I have always valued responsibility and utterly embarrassed by this situation.

I’m so frustrated. How can my stepdad put his teeth in every morning and not feel bad about the utter horror he is putting me in? To make matters worse, he just put a new pond and water fountain in for me mom for mother’s day, complete with bridge and all the pretties. They are also buying a new truck.

I hate my life. Is there a chance for me to recover from this and live a normal life? I am still keeping my car which I am current on payments, but I’m scared and confused.

My grandparents are retired, they get their SSA checks every month, and food stamps. Currently what they receive is enough to pay for bills, mortgage, credit cards, and other expenditures; in other words, the income they receive is enough to get them by. Over the last couple of months they’ve been thinking about leaving their house for good. They refinanced the two mortgages they had on the home mid-2010 and were able to avoid doing this for a while. As I’ve mentioned before, they are not running short on money. Eventually they made up their minds and decided to leave the house once and for all to live with their son who offered them a place to live. There are several reasons for this decision and I feel that they are not relevant to what I’m asking.

My questions are these:

- What will happen to the house once they are gone and stop paying the mortgage? I will assume that foreclosure will inevitably happen, but what concerns me is that they are not physically there to answer any questions or to meet with anyone or reply to any letters/phone calls. I want to know if there is a special kind of foreclosure that deals with cases like these.

- Can it affect them legally in any way?

- Who will take possession of the property?

- From some research I did online on bankruptcy it became obvious that they were not suited to receive the discharge since their financial situation is relatively stable, but I want to know if this could be an option to relieve them of their home and other debts without having to just quit living in their home.

By the way, the property is in Clayton County, GA.

I would think Chapter 7 where all of your debts are essentially wiped clear.
Chapter 13, is more expensive and you still have to pay back your creditors what you can afford to pay in a 3 to 5 year period.

Clearly, Chapter 7 has to be the more common one.

I just had to file my second bankruptcy. 2 in 4 years. This time it’s chapter 13 so atleast I’ll be paying off my debts. I need a place to live. Any suggestions, I make a reasonable cash income of over 3 grand a month.

My brother, 47, is going to see a lawyer about bankruptcy, chapter 13. Four years ago he went chapter 7. He has money problems. He is on his own. He lives in a different state, Minn, and has an 8 year old son that he has over every other week. He pays child support of 0 weekly. He tries to be a good dad to his troubled son. He works in printing at a plant in St. Paul with a rotating shift, and works hard earning /hr. He lives alone and pays 0 for rent. He lost his new car to the repo man, isn’t very good with his money and accrued ,000 in debts. He is being sued by a creditor whom he owes ,000. They offered to settle for ,000 with two payments of 0. He is paying off ,000 in back taxes at /month. He is thinking of filing for chapter 13 to pay off these debts and get back on his feet. He wants to get a part time job, but the odd rotating shift makes it hard for him to do so. He doesn’t have any support system, so what should he do?

Hi I am 18 and i recently got in 17,000 dollars in debt of medical bills after getting help of the gov. i live in nj in a room in my parents house i have no job, no car, basically nothing (I do not go to college). i want to declare for bk since im young and will have it all over my late 20’s but i dont know what effect it will have on my parents… I plan to work work construction later in life (Will the bankruptcy affect this?)

I am only 25 years old and have a little over ,000 in revolving debt. About ,000 is unsecured credit card debt and ,000 is on a leased car. I am getting over my head in bills and falling behind by about 3 months on most of my credit card bills. I have creditors calling me and I avoid all calls now because they are so rude (as if I owe them personally). I am under so much stress that my health is being affected. I met with a credit counselor regarding debt management and came up with a plan to pay 0 a month to pay towards my debts, over a period of 5 years. I added it up and the debts I will be paying is only going towards the ,000 credit card debt and 0/month for 12 months for 5 years equals out to be ,000 that I will pay out on a 000 debt, well over what I originally owe. Also, I have done my research and debt management seems very similar to filing Chapter 13, so I am considering filing for a Chapter 7 bankruptcy, can somebody clarify what my advantages are over the disadvantages. I know that filing for bankruptcy is bad on my credit but I think that if I file bankruptcy it will be easier for me to save money towards big major purchases in the longrun. Plus I am only 25. Assuming by the time I am 30 it should be alll good right? Am I thinking naively? Also I was thinking that if I file before my fiance and I get married, it would be much better? Also what exactly do I need to qualify for a Chapter 7? Please help!!!!

I just got divorced and I have two questions for people with bankruptcy experience. Our divorce was by agreement (through lawyers) so we never got to see the judge. The debt declared by both of us was split in half. Basically, I pay these collection companies and you pay these collection companies type of deal. Now I’m ready to file for bankruptcy and have the following questions:

1. My ex-wife didn’t declare all her debts in the divorce papers. I recently found that out on my own. She is a very dishonest person and had a secret life during our marriage. I guess she didn’t disclose everything on the papers as she was afraid she could lose custody of our child when all the nasty details of the affair, hotel payments, etc. came afloat. Without getting into "you can sue her" for lying on the papers or "contact an attorney", how can I find out all her debt so I can get it discharged? She won’t tell me about it. I have my 3 year old daughter’s social security (for medical debt inquiries, etc.) and I know my ex’s too (using hers for debt inquiries could be illegal I think). My initial thought was to start calling collection companies around, Sears, Check into cash, Banks, Walmart (she did some nasty s. once and Walmart was sending "you owe me money" letters, etc. ) with her social security but that’s illegal I think. How can I find out all her debt? I don’t want any surprises after I file for bankruptcy. I appreciate it if you don’t give me "Ask a bankruptcy lawyer" type of answers. I just need some answers now from people that might have gone thru this or have experience dealing with bankruptcy matters.

2. We were separated for almost 2 years before the divorce. I kicked her out of the house so it wasn’t legal separation. In the creditor’s eyes, is the NEW debt she incurred after our separation but before our divorce considered my debt too?

3. In the eyes of the creditors, is the debt she incurred during our marriage, SOLELY IN HER NAME (her credit card, some loans she received, etc.), considered my debt too? Obviously she had a secret life and I didn’t sign most of her agreements. I didn’t have any clue about her dealings.

4. As I said before, the declared debt was split in half on the divorce papers. I’m filling for bankruptcy now to discharge my part of the debt. Could my ex-wife have any legal grounds to go after me for not paying my part of the debt as there is no doubt the creditors will go after her? By filling for bankruptcy, to most rational people it would mean taking care of my debt. I could be wrong.

5. Divorce question. Am I divorced? :-) It’s been 6 months already and I haven’t heard from the courts? Is our lawyers sending the divorce agreement papers to the courts considered being "DIVORCED" or do I have to wait for some certification of divorce from the judge? I was supposed to go for a final "optional" appointment with the lawyer to get answers to my questions but I just dropped the whole thing (too much $$$$$$$$$$$$$)!!!!!

I’ve been looking at an informational site and couldn’t find anything that would answer this question plain and simple. For Chapter 7 it said you could keep clothes and furnishings and something else but it wasn’t house. It said everything of value had to be liquidated to pay the debts. For Chapter 13 it said something about mortgage, but it made it sound like it had to be paid off in 5 years, which I know for what my sister owes on her house, she’d only come close if they weren’t charging any interest during that time. If worse comes to worse for my sister and she ends up with her cars going into repossession and house into foreclosure, and she files bankruptcy, can she keep her house and one car, or would she have to sell them and start from rock bottom all over again?

I want to get this Harley Davidson on a payment plan, but also to rebuild my credit rating. Can I go out now right after my recent Chapter 7 discharge of Debts and purchase this motorcycle. Will I get into any trouble with the Court, trustee or the creditors. Am I allowed to do this or I have to wait a while before I make any major purchases.

currently i am in the process of filing bankruptcy, chapter 13. i live in louisiana and have been fortunate to pay only 500 bucks as a retainer fee. i am under the understanding that certain debts take priority over others being the IRS, secured, and unsecured. i am praying that my bill is no more than 600 bucks a month. my question is, currently i have a used car that is on its last end. i am desperately trying to save enough cash to purchase another car, which will also be used until my bankruptcy case is paid out. i am the type of person who can make due and live off of a budget considering i lived off of noodles and cafeteria food in college. therefore, do the trustee cut your check so bad that you are not able to save a penny. i am hoping to at least save something once a month in order to purchase another used vehicle.

I am now 27 years old, I have owed probably about 6 companies a total of mabe 6-8 thousnad dollars since I have been 18-19. I went online and checked my credit report and I saw that all of my old debts are not on there. the only debt is a lawfirm that is suing me for, 00.00 My dad said "after a certain amount of time they will be written off". What the hell is a write off and what really happened to my 00.00 in debt??
and can i still file bankruptcy because that is what I really want to do>

I am a hopeless fellow from the Philippines,searching job everyday after my business bankruptcy 3 months ago, I have nothing but debts a mountain of debts, who scares me till bone. I ask for help, many to be mentioned, but some of those are politicians, TV personalities and "WISH KO LANG" GMA 7 show, but no one wants to help. Searching job thru online, only end up as scam, the devil’s scam. As of now I am looking for a job abroad, but I don’t have money for my traveling documents, can any employer abroad or host family help me to work abroad, can anybody help? I am begging? I’m an unemployed teacher and have just lost my car (my only asset) and am representing myself in my bankruptcy. My combined debts (assuming I’ll still owe about ,000 on my car once it sells at an auction) is approximately ,000. I do not have a savings and no longer have retirement accounts because I had to cash them out to cover living expenses. Twelve years ago I had to file bankruptcy and am concerned about how that will look to the judge. I worked to earn my college degree since then and was doing well when suddenly I found myself without a job. Any thoughts on that? My debts back then were fully discharged, and I’m hoping to file a Chapter 7 for another discharge of my debts. Here are some of my questions, any input would be appreciated:

1) Is there any kind of assistance available for people who cannot afford the filing fee?
2) Once I file, how long can I expect for the court date?
3) Does the online bankruptcy class that is required cost anything?
4) Can my 0 debt to the IRS (back taxes) be included or just the interest and penalties?
5) Any suggestions for someone doing this without an attorney?

I’ve done my research and am actively seeking answers to my questions, but there are some very informed and helpful people on this site, so for peace of mind I really welcome your input.

I am considering chapter 13 bankruptcy, so what does that do to my brother, I am fully responsible for the vehicle financially. But I would never do anything to jeopardize my brother or his credit.
My brother is the primary borrower because my credit was not stable enough to support it, we have some other debts so we are considering Chapter 13, so I really need to debt out of his name because it’s not his car and I make the payments. I do NOT want by brother effected in any way from our mishaps!!
Basically, if I file for bankruptcy, he will be responsible for the payments which I will continue to make, but I won’t benefit from a re-affirmation of debt with lower payments because I am only the co-borrower.

I have been payiny min payments on 11K in high interest debt off for the last 2 years, and it does not go down.

I make late payments, my interest rate is at 28 percent, I am basically an idiot. Now that I live on my own the cost of my debts is killing me.

I would like to be able to buy a nice house ect but i cant keep giving them free money and making my life suck.

Can i settle the debt? Can the interest stop and i just pay it off in smaller payments?

Obvioulsy by credit score would suck after this settlement, if a settlement like this even exsists, but its not bankruptcy????????????????????????????
