Right now, I have no means of paying it off. If I were to get funding to go to college, and then be able to make more money, will I still have that debt for the rest of my life? If I wait to pay it until after I get a degree, the fines and interest will be even worse than they are now. I have read that I can’t discharge credit card debt through bankruptcy. What do people do when they lose income from a spouse through divorce or death? How can they ever get past their debt when credit cards are in their name?

I went through a divorce and was forced to pay my ex a lot of money that I did not have. I could not borrow on my home because of the lowering values. I sadly had to put them on my credit cards. I was doing fine, joined a debt management online organization and was actually paying them off. I finished the first and then applied that amount to the rest. I took on a second job, sold my car, and everything else I could cut up all my cards and was very proud of myself for starting to dig myself out of debt. Then I got blindsided, three of the four cards raised my interest to the max because they said I was a credit risk. My score has actually started to come up some so I am really confused about this. My minimum payment is now more than I can pay and still feed my kids and pay the mortgage. I really dont want to file bankruptcy, I want to do the right thing and even after talking to the credit card companies, they are cold and indifferent about this..What can I do?

I filed Bankruptcy (Chapter 7) in 2002 – after a divorce. I then had to file Bankruptcy (Chapter 13) in 2007 because of a foreclosure on my home. I’m one month from finishing the Chapter 13. Is my credit screwed for the rest of my life? What can I do to begin to increase my credit score.

I live in Florida, Married almost 5 years,my husband is really bad to me, he makes lots of credit card debts (cards are in his name only), mortgaged the house (deed in his name, I signed paper as wife), he used creditconsulidate company to do about his credit cards debts, but it sucks his payment for 6 months without paying his debts, so it makes his debts goes up about 300%. because he never listen to me, never live our marriage lives as good coulple, always rude to me. so my patient is gone, I plan to devorce in Feb. but have question about if he does bankruptcy, what will effect to me and my divorce.

My significant other is in the middle of finishing his divorce and his soon to be exwife filed bankruptcy chapter 13 but used the entire equity in their home. he is afraid she is going to cost him his part of the equity. she couldnt file a 7 because of the use of the entire equity now he is afraid for his half of the home. should she dismiss this 13 and restart a 7 or should she convert it and if she does will he lose his home. we dont know what to do for him. thanks

I filed Chapter 7 Bankruptcy in 2002 due to a divorce – and then Chapter 13 Bankruptcy in 2007 due to medical bills and the mortgage payment on my house was on an ARM and I couldn’t afford it – I just completed the Chapter 13 – never missed a payment. What are my chances of getting mortgage in approximately a year or so. I’ve been employed for the same company for 26 years.

Okay. My dad is a selfish manic depressive ass who occasionally takes all the money and flies to Manila to be with an online girlfriend. He does this, and somehow gets away with it, despite being in bankruptcy and under court order not to leave the country. In any case, he has been a financial problem, and other kinds of problems, for Mom, and my family, all my life. IF he comes back this time, I don’t want Mom to pick him up from the airport and play along with him till the bankruptcy is paid off. The lawyer "discovered" 8k additional in debt!! when they thought they were done by this coming December. I live near them to watch over them, but not close enough to have panic attacks all the time over worrying for their violence and whatnot. My brother has moved FAR away coz he wants to kill Dad. My sister is a top scholar at a great university and doesn’t need this junk. I put off my dreams to put her in a good spot, but I don’t know how many more years…coz I want MY dreams now… BUT
But part of achieving them is knowing my mom is in good shape and not in danger from him, and that he is in good shape, not in danger from her. I think, since he is an untreated bipolar, he could go to an institution for rehabilitation or evaluation and help for a little while, but he would prolly charm everyone there and not get helped, coz that is what he does to people, he charms them. Mom and my sister will put him in jail if he does anything "off", but I want him to go to "help" when he gets home, if he comes back this time. Am I being unsensible? Also, should I go ahead and get that extra job….
Or stay out of it and just do what I want. Mom thinks I should worry about getting raises and going up at the work I have now, and forget her.
I’ve tried to get her to move out. She says she won’t coz then she will lose lots of money, that she has to stay on that property till the bankruptcy is paid off and then file for divorce. I don’t know why she is being so stupid about it, when she is smart, when she should just "cut her losses" and move away.

I have looked online, and gotten nowhere. My credit score is too low for prosper.com due to a recent bankruptcy (divorce!) and my current AmEx debt (keep reading). I don’t have a co-signer. I do have a great job, and the only reason I need this loan is because I was living in an area with an extremely high cost of living (Orange County, CA) and used my corporate AmEx for personal reasons and now have to pay it off or risk losing my job (I have been placed on probation, and get emails about this a couple of times a week). I have since moved (they allowed me to transfer) to Portland, OR, and kept my same CA salary. So, technically I could pay a few hundred a month to pay down the card, but my company wants it completely paid off within the next 60 days. Can anyone help? And, no, I will not fall for the "you send me $ then I send you $" scam.

I live in California and because of a divorce that went horribly wrong, I am considering Chapter 7 bankruptcy. But what is considered exempt for personal property? Are they going to come in and take all my furniture? Make me sell my car (which I own) and buy a cheaper one? How about retirement accounts (401K, IRA)? Has anyone gone through this in California?

To clarify, it was the debt accrued from the divorce and the resulting judgment that has created the need to file for Chapter 7. I have taken the Means Test and qualify easily.

I filed bankruptcy a year ago, this was from a divorce and a lot of overwhelming debt. I now make excellent money as an RN and my bank gave me a loan for a car because they saw my income versus debt (which i had no debt but living expenses). Well now, I am wanting to have a cosmetic procedure done and I was wondering if anyone knew of any financing companies who would finance 100 percent of expenses…….I know I am probably expecting too much, but it is something that i have wanted all of my life and after all that ihave been through and all the hard work that i have done to overcome all of this….I wanted to treat myself. any adivce is appreciated.

Hi, my good credit was ruined by a divorce and a loss of a job in feb2009. I was making ,000 a year so the judge thought he would give me ALL the marital debt, then i lost my job about a month later. I was at that job for 5 years. I bought my own house and expedition with nothing down, if that tells you a little about how my credit was. Then i lost my job, and had to file bankruptcy just so i would not loose my house, and then of course my ex fought me on the bankrupty and it got dismissed, but of course my credit has already been ruined. I make good money again, but im just trying to play catch up, and i am married again to a wonderful man, and the only thing we fight about is money that is it! For my entire life i was the one to ALWAYS help others and now, at my time of need there is no one. So does anyone know of any place online or whatever that will finance Christmas gifts even when you have pathetic credit if you can indeed prove your income? I could care less if i get anything, but my girls are still young, and i want to do something for my husband so bad, for what all he went through just because he loved me so much. After a long period of disability and a financially devastating divorce I have no realistic option but to file chapt 7. I’ve put this off for ages as I tried to save for legal fees. One creditor has begun court proceedings which I have thus far ignored. I need to end this asap and begin anew. My credit was perfect for decades before this disaster. I do not take this lightly at all, but now that it has happened to me, I just want to fix it and start over. Any advice on how to begin filing the paperwork, online resources to help guide me, etc. would be most helpful and greatly appreciated.

I really am asking for a friend of mine. this is her 2nd divorce. 1 year ago, she filed for bankruptcy (dont know if it was 11 or 13). she separated from her husband and is rolling her house into it and changing it into chapter 7. she went to file for divorce this week and the attorney told her she cannot file for divorce until the chapter 7 has been discharged in 4-5 months… is this true and why? she cant thru to anyone to find out.

After divorce, I took too much of the debt we accrued together and couldn’t survive. I filed bankrupty in Aug 2005 & it feels great to have no debt. I’ve received my first credit card in Feb 2006, with a 0 limit. What else should I be doing to assist in repairing the damage I’ve created?
I do pay off my balance monthly, so I’m good:)

I am currently in a Chapter 13 plan (since 4/05). I live in CA and have been a homeowner from 1998 till right before filing my Chapter 13 due to an expensive & litigious Divorce. Unfortunately, I am unable to afford a home based on real estate prices in California. I have restablished credit (below the 00 threshold allowed) & my credit score is 600 which I’ve been told is very good for an active BK. In regards to taxes, I can no longer claim my kids and I’ve lost the homeowner’s deduction, I would like to purchase an RV as a permanent residence. I have checked with an attorney and a tax advisor who both advise this is a smart move based on my income and tax bracket. The attorney advises that the Chapter 13 Trustee will, most likely, approve this purchase. My challenge is finding a lender that will lend me the money for the purchase that reports interest paid to the IRS. I am looking at a 000 purchase including tax and fees. I have access to 401k funds for a 30% downpayment on a collateralized loan on a used RV. According to my tax advisor, interest paid on a primary residence (yes, even an RV) has no real limit, so I would be willing to pay up to 25% APR based on my finances and credit history. Any suggestions on lenders, alternative means of financing or am I just plain crazy…
In addition I have a free place to park. Includes all utilities free. Does anyone know any ‘alternative’ finance companies that report interest to the IRS? APR does not matter up to 25%. Based on my income and tax bracket this the best situation for me.

I live in Florida and I have about ,000 in unsecured credit card and ,000 in a car loan. I am contemplating filing chapter 13 bankruptcy. I’ve read that I will have to come up with a repayment plan over 3 to 5 years. What can I expect to pay back for monthly payments? I’ve also read that the repayment can be 10 cents to the dollar. Is this accurate?
By the way, the reason for the bankruptcy is due to a divorce and now having to pay close to 00 in child support per month.
