Hi im asking this question on behalf of my mother in law who is currently in jail. She just recently told my husband, who has power of attorney for her to look into filing bankruptcy. At this point, her only valuable asset is her home, which is what we are trying to save, so if we file chp 7 will that really do any good?

My ex who pays child support is filing bankruptcy

I know child support can’t be forgiven, but, can it be put on hold while he is getting his finances together(chapter 13).

He had me sign a paper a while back -that was from his lawyer, that said they were not going to include child support in the bankruptcy part(easier for him?)
What does this mean they are not including it – and does this benefit me, or is there something I don’t know and I should?

I have two student loans out and was considering filing for bankruptcy to try and consolidate both loans into just one low cost loan. In any case…What is the best choice if claiming bankruptcy was an option that I am willing to endure. Also in filing bankruptcy if even at all I can, what would be the best cost efficient (cheapest) way to go about doing so when taking legal action and lawyers if needed?

My hubby and I have accumulated a lot of credit card debt and we are pretty much not able to make ends meet. W pay ,500 in credit card debt per month and that is only by paying the minimum. Right now my husband is in his medical residency and in 2.5 years his income will be much higher. He thinks that we can keep this up until then, I on the other hand think that we have reached our limits and there is no way we can last that long. My question is how bad is life after filing bankruptcy, will they take our cars away? We only rent, so there is no worry about a house. Any input would help. Thank you

I am retired on fixed income. My home was just foreclosed on. My credit is already ruined. BofA has upped my interest to over 25% and I don’t even use the cards to increase debt but have offered to close account and they still won’t help as I don’t make enough $ to get approved for a lower payment. That’s what they told me! So I have 2 credit cards with balances just under 00 and am unable and it doesn’t make sense to try to pay them when it almost all goes to interest… I will be dead before they are paid off. Repeated calls and threats to stop payments have not helped. I have a 7 yr old paid off car and medical issues that require Rx’s. What is my best recourse? Filing bankruptcy costs too much also. I told them I wanted to pay what I charged but their interest rates were destroying me. Can my Social Security be garnished?

I’ll leave out the details but I am almost certainly going to file. Already spoken to 3 lawyers and picked one. Would like to hear from folks whov’e been through this in the past. I’m curious what "life is like" after it’s all said and done. Do you have regrets? I never in a million years thought I would be ever filing bankruptcy but I started a side business 6 years ago and it’s failed in this economy. And I’ve spent every penny I had saved up.

I’ve been told after it’s discharged, you will be able to get a loan to say, buy a car within 6 months? And a mortgage within a year? (I need to re-fil my home on the lower rates).

We started renting the property Feb 2010 and have always paid the rent on time or early by deposit into their bank account. On October 1st they called us and told us to stop paying rent and that we would not be getting our deposit back and that he is filing bankruptcy and the house is in foreclosure so to stay until the bank contacts us and to save our rent money to move to a new place. They have not paid on the mortgage since March 2010 and Bank of America filed for foreclosure in the court on Oct 17, 2010(I found this information online yesterday). I was just wondering how much time we had because we are trying to save up as much as possible to move. We don’t want someone from the bank to knock on the door and say get out either because we have a 7 year old and a 7 month old. Does anyone have any helpful advice?
Yes we signed a 1 year lease before we moved in.

Okay so I am a correctional officer right now, working on my degree online in criminal justice and i turn 23 next year, which are some of the requirements i have heard of to become an FBI agent. The problem is that I got divorced about a year ago and my ex husband left me with about 3 credit cards that were maxed out at the time, I cant afford to pay them, one of them is 00 alone, So when i get taxes back next year i am thinking about filing for bankruptcy. I read that to be hired into the FBI you have to have a credit check. So will filing bankruptcy hurt my chances of being considered for the job?? Please only answer if you know the answer, I really need to know!! Thank you so much!!

currently i am in the process of filing bankruptcy, chapter 13. i live in louisiana and have been fortunate to pay only 500 bucks as a retainer fee. i am under the understanding that certain debts take priority over others being the IRS, secured, and unsecured. i am praying that my bill is no more than 600 bucks a month. my question is, currently i have a used car that is on its last end. i am desperately trying to save enough cash to purchase another car, which will also be used until my bankruptcy case is paid out. i am the type of person who can make due and live off of a budget considering i lived off of noodles and cafeteria food in college. therefore, do the trustee cut your check so bad that you are not able to save a penny. i am hoping to at least save something once a month in order to purchase another used vehicle.

I was served yesterday legal papers that I’m being sued for less than ,000.00 by my creditor, first I’m unemployed, I looked up online and found a lawyer that charges 50 for filing bankruptcy, I need to know the best option and plus I don’t have any money! they only thing I own is my car which is been paid off, I know it sounds like a radical question but how are they thinking of getting paid by me when I don’t have any assets? are they trying to take away my only property which is my car? and plus I can borrow money from my mom( I’ve been living with her)(her salary is approx: ,000 annually)(since I’ve looked over the fact that they see if you’re living with someone they might take them responsible as well!)(so she can’t be because we’re already below the minimum salary rate) anyways my radical question is should I even get bother by it? I mean they can’t get anything off of me! I’m flat BROKE! my bank account is even overdrawn by thousands! and since if you’re answer is yes<< (you are being sued so start the PANIC ALARM) which is best? and do attorneys from nonprofit organizations do the same work as an attorney who gets paid some 00 ? (I mean if it’s him charging me because he will go to court and file my papers and stuff..)(hearing meeting is %100 me<< so I’m wondering to go cheap with it to prove to the court that I AM BROKE for real! or borrow money and pay the lawyer! which is best?

My fiance just booked a flight with Sun Country Airline because of the cost (very low) and I was wondering if anyone has flown with them recently. The reviews I found online were mostly from several years ago. Sun Country recently came back into operational status from filing bankruptcy so I don’t know if things have changed with them. My fiance is in the military and is only going to be home for a short while so any notice that we should change his travel plans would be great.

I am nearly 000 in credit card debt total and I am unable to pay my bills and I am looking at filing bankruptcy, but I don’t know if it is a good idea to do? I also wanted to know what company is the best for filing bankruptcy. I know that after I file I wouldn’t be able to get an apartment or a car or a job due to me being a bad risk of getting anything, but I wanted to know how much does it cost to file bankruptcy and is it a one time fee payment or is it per month? I have a 2nd mortgage that may be charged off–What are the tax ramifications? I know it can be reported to the IRS as income–but we are also filing a Chapter 13 bankruptcy–so we will be paying the mortgage through the court, so itwill still be paid. Is it only reported if we didn’t pay the mortgage? Or is itreported regardless?
What else do I need to know?
Randolph–the rude answer is not necessary–If I had the income now to pay it without filing bankruptcy—I would. That’s the problem–What is your source of knowledge in answering this question–you don’t put anything down. How do I know you’re not just an idiot ?
The first mortgage is still working with us–but I’m not sure how much longer they will do so. We are not eligible to file a Ch. 7. I know the bankruptcy will not affect tax obligations. If the charged off mortgage is reported as income–that’s what I’m wondering about IRS tax wise.

I Figure someone has seen this debit card program. Maybe you can tell me if this is real. I need a debit card, because I’ll be travelling a lot. I’m preparing to do behind the wheel training with Swift trucking – to be an over the road truck driver.

I don’t expect to get back to my (former) home often enough to pick up bills Besides, I won’t have any. And until I make enough money to get a laptop, I couldn’t keep up with them, if I did. Due to my divorce & filing bankruptcy, my credit is screwed anyway. So credit cards are out.

Were thinking about filing bankruptcy and doing a Chapter 13. Only because our 2nd mortgage sent us to collections for the full amount. Right now we pay 0 a month in credit card fees. Someone told me yesterday that my repayment plan would be much higher that that. Is that true? I thought I would only have to pay up to 15% back in the unsecured debt. Do any of you have the answer? What is the point in filing Chapter13 with a higher payment? I can barely make it right now, in fact we can’t make it.

One of my friend is married to a great guy. He supports her full time as well as her mom and another family member who has many health problems in which he pays all costs on that as well. They have no children of their own. It was to the point of them almost filing bankruptcy because of the added medical care cost he has been paying. She has a settlement from a workers comp case coming to her soon. So instead of helping her husband who has been footing the bill for months she meets a man online. She signs a lease with him and decides to move out of state and leave the husband with all the bills to be with a man she has never met in person. So I did the unspeakable. I called her husbands best friend and told him what she planned. Of course he called her husband and told him. I fell like I have betrayed a friend but I am also glad that at least he knows whats going on so he can do a little damage control. Did I make the right decision? Yes i know all the details and this guy treats her like a queen. She has cheated on him several times and he keeps letting her come back. In my heart I feel I made the right choice but I still feel guilty because this girl was suppose to be a friend of mine.

My boyfriend tried to apply for a credit card at capital one, and he got rejected. He tried taking out a loan for a home, and got rejected. He recently went online to annualcreditreport.com and pulled all of his reports off of there, only to find that his fathers debts were on his credit report because he and his father have the same name. We know his dad did not use his SSN or birthdate to create these debts under his name though, because he himself is going through bankruptcy trying to get these debts cleared off his name. So what were wondering is who do we hold responsible for it? The credit card company? the credit bureau? and what do we do about it?

We know that we can get this removed off his credit report, but were not sure of how to go about things.

& should we be compensated for the troubles he had to go through because of the times hes been denied.

If we decide to take this to court, should we get an attorney?

Why Democrats said they will pay taxes so everyone can get free Healthcare? Why not tell the doctors to lower the cost? Because
