Question about foreclosure and Chapter 7 bankruptcy?
Thanks to anyone who can help. My husband and I filed Chapter 13 bankruptcy a year ago. We are already struggling just paying that and our house note, we applied for a loan mod and they turned us down for both the Obama plan and the Chase program and any repayment program. They said to call my attorney. She wasn’t in so I called another lawyer who told me about all that could be done is to add the back payments into our bankruptcy, well we can’t afford what we’ve got now, I told the people at Chase that we would have to file Chapter 7 and give up the house and I asked how long it would be before they foreclosed, she said they weren’t in foreclosure mode yet because of active bankruptcy but I know once they hear we’re doing Chapter 7 it will be a different story. So I guess my question is, has this ever happened to anyone else and how long did it take after filing Chapter 7 that they foreclosed their home. I just want to know if I have till after Christmas before they take our home. Thanks so much for reading this.
Thank you. The reason we were turned down is because they said we should be able to afford it, well that’s all we could afford and it’s only if my husband doesn’t get laid off or rained out because he’s a welder. We’re behind several payments so I’m sure it wouldn’t take them long to take it.
Thank you guys so much. My attorney had told me a while back she thought we would qualify for converting from 13 to 7. I appreciate all the post. And to the person who said we went in over our head, try telling the hubby that. I tried to tell him that days before he signed the papers. And we have struggled the past 4 years because of it.

Where can I find a specific list of non-exempt assets for chapter 7 bankruptcy in Arizona?
I would like a more detailed listing of what my non-exempt assets are under the law when filing chapter 7? Are my pets non-exempt? What about clothing, food, appliances, etc? I am going grazy doing google and yahoo searches. Can anyone please help me find this list? Any serious help is much appreciated. Thanks.
I have been looking into filing chapter 7 or 13 bankruptcy. I see that chapter 7 is known as liquid asset bankruptcy where I am told that the court trustee sells your possessions to pay your creditors. Can anyone tell me about their experiences with this? How much do they take exactly? I would also like to hear about anyone who has experienced Ch 13 bankruptcy. What was your final settlement like? I ams scared to death of either of these. But, I need to do something to get my debt under control. These interest rates keep going up on me and I have been paying everything on time. But, now the rates are so high, I am in over my head. I appreciate all of you guys and gals sharing your experiences with me.
How will my bank records affect my Chapter 7 bankruptcy?
I am filing Chapter 7. My personal account does not show much activity. My business account shows sales of roughly 20,000 monthly however when I pay off the company that finances my inventory ( I do not own my inventory) It shows a profit of around 00 per month. Even though my profit is below the median income, will the large deposits arouse suspision on the part of the court. The large deposits are followed by large payments to that company that owns my inventory.
Is filing Chapter 7 bankruptcy a good idea for me? How long does it take to get back on track after I do?
I am considering filing chapter 7 bankruptcy. I have 3 major credit cards, all of which have been charged off and added up have a balance of roughly 20k with interest and attorney fees. I also have some other random bills which have gone to collection: cell phone, utility bills, medical bills, etc, that add up to about 3k. I also owe about 10k in back taxes to the IRS, which I’m not sure if this could be included in the bankruptcy? I have made some mistakes in the past, living beyond my means and am much more educated and mature now and would like to get my life and credit built back up.
1. Is bankruptcy a good idea for me?
2. Can taxes be included in a bankruptcy?
3. How long does it take to get my credit built up to say a 650-700 credit score after a BK and are banks willing to give you a loan if they see you have a bankruptcy, even if your credit score is good now?
I worked for a mortgage company in 2003 and we would give someone a loan the next day after a BK discharge. I know things have changed but any insight in today’s credit market and how a BK is viewed by creditors in 2009 would be very helpful. Thanks

Question about chapter 7 bankruptcy filing?
I have ,000 credit card debt and i get lot of calls from collection agencies but i never pick up the phone and ignore the answering machine. I also ignore letters from creditors.
I will be filing chapter 7 bankruptcy within one week. Someone told me that if you ignore collection calls and letters, then they automatically pull the money out of your bank account.
So i withdrew all the money i had in my bank and keep cash at home. Am I over-reacting or do they really pull money out of your account electronically if you ignore their calls?
Chapter 7/13 bankruptcy and foreclosure???
I have filed chapter 13 bankruptcy because my house is in foreclosure. This was a desperate measure but after recalculating my bills I really don’t think I can afford to keep the house. I have not meet with the trustee yet, but I am thinking about converting it to a chapter 7 to get a fresh start because I am up to my ears in debt anyhow (about ,000 not including the house) My husband is unemployed right now and we have 3 kids. So keeping the house would really push my budget to the limit for I don’t make much money. I am not familar with how chapter 7 works? Will it discharge the foreclosure? or will I still have to pay for the house? Also, I have a car and so does my husband, his car is paid for mine is not (I am current on the payments) so how does this work in filing chapter 7? I live in the state of Texas if that helps.
How will filing Chapter 7 bankruptcy in Illinois affect me?
Last year at this time my credit score was 750, but over the past year I have had some financial crisis and am very deeply in debt. I talked with a lawyer today and I understand the difference between chapter 13, and 7. My question is, other than the obviouse destroying my credit, how will filing chapter 7 affect me? Will I ever get a credit card again? Will I lose my atm/debt card? Will I be able to rent a house or apt after my foreclosure? Please, anyone who has any experience with this, any info would help.

Is College Debt Dischargeable In Chapter 7 Bankruptcy?
I will be filing Chapter 7 bankruptcy soon, and am trying to figure out if the ,000 I owe my University will be discharged. None of the balance is from student loans, or any other type of Financial Aid. It is from past tuition, bookstore charges, room & board, as well some other irresponsible charges to my Bursar bill. Thank you in advance.
To answer the answers below, I am actually in the process of choosing my bankruptcy attorney, but the last one I spoke with wanted to charge me 0 to look up that information, and would not include it in his normal bankruptcy rate.
As for the answer regarding student loans, NONE of the University debt includes any type of loan or other type of financial aid. Thank you for such quick responses though!
Do you have to file a reaffirmation agreement in Chapter 7 bankruptcy for secured creditors?
We are filing Chapter 7 bankruptcy and want to discharge all unsecured debt, but we are current on home and car and will continue to make those payments. We will have to fill out a B240 reaffirmation agreement on these or just fill out the Chapter 7 Debtor intent form that says we will reaffirm?
