My husband and I are going through some financial hardship as he is seeking employment (although he does bring some money in due to VA benefits) and I am having a baby w/ unpaid maternity leave and won’t return to work until Aug. as I am a teacher. We’re also on 10 mo. contract so no pay in July and Aug and very minimal savings to contribute to the summer. Here are our bills:

Water
Car
Personal Loan
Washing Machine Payment
Credit Cards (x2 w/ tremendous balances 38k)
Cable/Internet (which we have to have cable to keep internet and need internet for online coursework)
Student Loan
Electric
Car Insurance
Cell Phone

Any advice as to when I can’t pay one what should I do? We’re also considering bankruptcy … bad times but we’ll survive! :)

This month I’ve been dealing with a relative. She bought a brand new HDTV and gave me her old one. My husband has been wanting one but keeps items til they break. The picture has a long shadow that is very annoying when watching TV. So this means that probably the set is broken. We have to go today or tomorrow and rent a new TV since we gave away our old tube TVs to Goodwill.
Yesterday, she and I went to see a ballet. She promised to pay for my ticket. She backed out at the last minute, but I wanted to go anyway so I ended up paying for the ticket. Next, I asked her to return a gift for me while I parked my car. The item had a gift card used to pay for the item. I didn’t realize it at the time but she short changed me nearly . The clerk reimbursed the item partially on a store credit gift card. I realized this when I went to pay for my order at the store.
She’s been having a bad time lately with her dog being sick so I didn’t want to offend her.
However, I mentioned it to my husband and he basically blew up! I would never keep money that wasn’t mine.
For some reason, she thinks because my husband makes a good living that she can take advantage of us. My husband and I are in a chapter 13 bankruptcy with court payments of close to 00 a month out of our monthly income. So even if we do make a good living that really makes it so that she makes more money than us at the moment.
She has only rent, electric and a cable bill to pay. We have rent, car payment, car insurance, electric, health insurance premiums (which have gone up), cable and several miscellaneous bills. So we’re paying triple what she pays per month. Also, she is driving my car and we’re paying the insurance on the vehicle. That’s going to change in February or sooner. She buying another car herself. She wants to use my car as down payment. That ain’t happening either!
My mom spoiled her as a child. But to lie and steal from her sibling is wrong. What should I do to make her realize that I’m not the corner bank? Thanks.

I filed a Chapter 13 in 2007 due to multiple problems with my mortgage company. Last fall, my house burned down and the insurance covered the loss. We rebuilt in the same place and I used a part of the contents coverage money to pay off my Chapter 13 early. I had a small personal loan that was included in the BK (because everything has to be included, even good accounts) and the trustee sent them a lump sum payment of the loan balance principal plus interest (a lower rate than my loan was written with). The loaning party used the money to pay off accrued and what they considered past due interest and late fees and left me with nearly all the principal balance still "due" and began dunning me for payments. Am I obligated to continue making these payments since they already got enough money from me to pay off the principal plus a reduced interest rate? I cannot ask an attorney due to major non performance issues with the attorney who filed my BK.

My friend had purchased a car new 10 years ago, and it had went through flood waters so the car was totaled. The insurance company paid off ,000 of the ,000 back then. She then filed a chapter 13 bankruptcy against the car, but it was discharged, and never paid them for the car. The loan company never contacted her about the car. 10 years later, it’s not even on her credit report. It’s just sitting there, can’t sell it or junk it with no title. Any ideas what she can do about the car? If she calls the original loan company, will they come after her? Thanks.

I can see it now. Under Obama the insurance companies will have the permission of the government to file bankruptcy because they can not "afford" the "affordable" coverage Obama will negotiate and the government would then bail them out. With McCain, they do not have that option because the government would not be involved at all.

My credit score is 490 and i’m in the process of getting bankruptcy.
I dont know how life is after babkruptcy. I know things like car rates will be very high. How different will things be? i’m only 25 with two children, working and making 21,000 a year. I want to buy a used car soon but I’m scared of high rated including insurance. Will I be denied for everything? I only have a Macys card and that one is in good standing and will make sure it is. Any one can tell me how life will bw with low credit score and bankruptcy?
My total debt is over ,000 because of stupidity and not being able to control my spending. I have a date already to meet the creditors.

My "ex" entered into our online relationship with the sole purpose to SWINDLE me out of thousands. During the course of our relationship, she used marriage to enter the U.S.A. and continue her CON. Since she never intended to be in a real marriage (stopped living together after 9 days), and the authorities will rule it an "invalid marriage"……….will my health insurance company ALSO deem it grounds for demanding full restitution for ALL the bills they paid on her behalf (under false pretenses)?

NOTE: She has also filed "False Insurance Claims" months after our divorce, and the Insurance Company is demanding their money back on those claims already.

Will I be held liable for HER deceptions??? I have already been TAKEN for thousands by her, and now face Bankruptcy.

While my husband was not working due to medical reasons,I did something I said I never wanted to do. We have two school age children at home,money was a real problem for us for about two years. I reluctently took on using credit cards for groceries,clothing and Christmas for the children. My husband was denied disability benefits and bills in the meantime got way out of control. even with the income he has now,the mortgage,electric,insurance,etc. eat up every thing he gets.I am only able to work a parttime low wage job in my area.The cards are all in my name and there doesn’t seem to be any other way out.Is there someone out there who can help me online to find the help I need?

I filed Chapter 13 three years ago and had been making my payments every month on time. I have two years left. I am now unemployed and completing my BSIT. I also inherited 75% interest in a total of four rental units (duplexes). I can rent them for about 550.00 per month. I am a few months behind on my payments to the Trustee, but I can catch up with the executrix fee that I will earn in a few months or I can take it now. Also, this was three year court battle and I am entitled to the back rent for three years.

My house that is part of the Chapter 13 I owe 93k with an ARM. I had a value a few years ago at 160k. The rental houses values are about 60k and 47k and I can get 75% of the sale income.

The taxes on all three properties are pretty low too at about 1400.00 for all associated property taxes.

The person who owns 25% and I do not get along at all and is NOT a family member. I don’t want to buy her out at this time. I want to wait until I have the cash and in a few years.

I want to manage the property and send her her portion of the proceeds after the her portion of taxes, insurance and any repairs have been taken care of.

I don’t think I should sell or buy anything with regards to the rental property. I believe that the passive income is important. What do you think?

My husband and I live in Kentucky and a couple years ago my husband was involved in an accident without insurance. I know that was a mistake and we should’ve had it, but there was a time lapse of like 5 minutes where we were uninsured and didn’t realize it. Anyway, my husband got a driving without insurance charge and had to pay fines for that and restitution for the other driver, as it was an injury accident. That is all paid and we thought it was over. Today in the mail, two years after the accident, we got a letter in the mail saying we owe the other drivers insurance company money they had to pay out…like 10,000 or something. We don’t have the money and are currently in a Chapter 13 bankruptcy and none of our property can be touched for 4 more years and we still have a mortgage on our house. What is going to happen if we go to court?

My fiance and I are getting married in less than 2 months. He was rear ended at a red light (the other person was texting on his phone and traveling 40 mph) and is currently being treated (and we have a lawyer). He’s in so much pain that he’s on oxycodone and is attempting to go to work when the pain is not so bad (since we have a mortgage to pay and all).

I am very afraid that the people that hit us have minimum insurance coverage (k). We’ve been doing medical liens for our doctor visits. We do have medical insurance but they won’t pay anything until we make a try to make a settlement with the person that hit him.

If we sue them, and they declare backrupcy, will we have medical debt collectors coming after us or will that go away with the other person’s bankruptcy? We are paying every cent to try to knock out our student loans at super high interest rates…I have no idea what I would do if we would have to pay the entire cost of his upcoming surgury and treatments.

We are trying to get debt free and live a respectable life. We do not want to get rich from a settlement…simply pay for our losses.

I let my bestfriend drive my car. He got in an accident and now I owe the other driver ,380. We decided to go outside of insurance due to the fact that this is my father’s car and I can not tell him what happened. My father is of an old background and very distrusting. He made me sign and have notorized a piece of paper saying I will not have anyone else drive this car. Well, because of the kind hearted ness I have for my bestfriend I let him drive while his car was in the shop. Bad move. Now I have no money and I need to pay this other driver. She has my insurance information. She’s been nice so far but i can not make a promise i can not keep. I can not tell my father because he will take his car back and not have any interaction with me again. I am not over exaggerating: my father has already not spoken to me for one year because I cosigned a car for a friend. The only reason my dad (along with the rest of the family) started talking to me again was because my grandma died. Can I tell the other driver to call her insurance company and tell her it was my fault and have them sue me individually…then add the bill to my chapter 13 bankruptcy? Or should I just strip or something to make the 2300 dollars. Please help.

What do you do to fix your life when you’ve had to file bankruptcy, a teen turns to heroine and steals everything (but is 26 now-living away)– too little too late now – all gone, you lose your home after cancer, you’re working very hard, you owe a lot of money to a lot of people, your cars keep breaking down, you owe the IRS, you have no health insurance, you lose your job (lay-off) and can’t pay car insurance, car insurance lapses and then you can’t get new insurance because it costs MORE because you "let it" lapse, you can’t get ahead because bad bad things keep happening – for years and years and years (not a new thing), you are feeling helpless and hopeless. There’s no help out there because of course you "make too much money" for assistance. No family to help (you don’t want to take from anyone anyway) and you are afraid to wake up every morning? Plus you have a wonderful teen who deserves the WORLD and he’s gone without for many years himself because of everything?

First of all, I’ve been one to give my last dollar to a hungry man on a street. The answers I was looking for were some positive real answers from possibly someone with background in this type of thing. I’m looking for real answers – not for you to feel sorry for me. The praying part IS A GOOD ANSWER – and hearing others stories help too (thank you). But the rest of you, if you are going to answer the question, read the question.

It’s quite obvious why jobs go over seas besides the employees willing to work for low wages, it’s simply because the cost of employment is expensive. All the red tape, licensing, insurance, pay-roll costs like medicare, unemployment, workers comp, social-security, and other nonsense.

It eventually comes to a point to where starting a business becomes too bothersome.

If you want jobs to stay here you must be willing to be competitive. All these entitlements make it hard for companies to meet these ridiculous demands.

It’s Obvious the Chinese Company has less burdens and a cheaper product then the American one. Thus the American one isn’t competitive enough and faces bankruptcy. This happened with GM and all the entitlements it had to give to it’s Union. It’s going to keep happening until American’s decide to stop demanding more then what they earned. Otherwise jobs will continue to ship over seas.

Learn to be competitive. Not complain.
Matthew D: You forgot that GM was down 5,000 before the car’s raw materials were even ordered to pay for retired Union workers pensions. Check Mate.

I am claiming chapter 7. I started a new job 6 months ago after being out of work for a few months and don’t make enough money to live on. I did get ,000.00 from my dad’s life insurance policy that I had not cashed until recently. My sister had been paying some of my bill’s for me over the past 6 months and even before that because I was between jobs. So when I decided to claim bankruptcy I cashed in the account and gave it to my sister. After paying back what she has been paying for me there is only 4 or 5 thousand left. She has put it into her account. Do I need to tell attorney about this money? and if so will I be able to keep it? I have not had a bank account for months now, but the ,000.00 was in an account under my name with the life insurance company.

I was in a car accident in 05. It’s been five years now. Just yesterday I accepted a ,000 dollar settlement. My medical bills are several times that amount. There is no way I can pay them off. After five years of court date after court date.. depositions.. paper filing and two lawyers. I’m sick of it. And even though I will have to live with my injuries for the rest of my life.. I’m sick of fighting and want to put this behind me. So I accepted. My lawyers told me in the beginning to expect 0,000 or more due to my injuries and the nature of the accident. But the case got more and more twisted as time went on and now the insurance company just wants to take me to court.. where I could walk away with nothing.

This is my question. . I kind of asked my lawyer this. He said that the only bill that I HAD to pay from the settlement was to a hospital due to a lien? Then I would be down near ,000.

Anyways. I’m twenty-one years old. And don’t see how I am ever going to get these bills paid. My question is:

Can I spend the money and then file for bankruptcy? Or would that make me ineligible?

I want to use the money for schooling and to fix up my parents house. I don’t think it’s wrong of me to do such a thing. I have suffered for five years now with major back injuries and severe PTSD. I deserve to use that money how I please.. right?

Let me edit something. Before I ever looked into a lawyer the insurance company offered me ,000 dollars. I then began to look for a lawyer. When I found one and retained him. It was in the contract that his cut would not leave me with anything less than ,000 dollars. So he is actually only going to get ,000 dollars from the settlement. The lein from one of the hospitals is ,000 dollars. That leaves me with a check for ,000 dollars. My question is.. if I spend the money can I file for bankruptcy? I haven’t signed the papers yet. The problem with this whole case was that my lawyer hasn’t been able to prove that the farmer was negligent. His cows got out of their pasture and .. in a vehicle.. I hit one. It came through the windshield and smothered me. Most of my bills are for PTSD.. which i’ve been told is hard to sell to a jury.

My friend has inherited money from her Grandmothers life insurance policy. She wants to use the money to buy a house (she has a husband and a couple of kids) and that is what her Grandma wanted her to do with the money she left for her. She has a truck she wants to keep too, so she has transportation for work and taking care of her children. She and her husband both got laid off from work, so she’s been staying with a family member (yeah, she really needs her own roof over her kids heads). She almost died of an illness several years ago and she was in the hospital for a really long time. During that time she accumulated a ton of medical debt (over 0k from what I’m told) because she didn’t have insurance at the time. Should she file bankruptcy to get rid of the medical bills? If not, should she work out a payment plan with the hospital… or would they just go after her house and throw liens on it? I don’t think she has too much debt other than the medical bills. I didn’t know what to tell her to do, so I thought I throw it out to yall for suggestions. Your help is really appreciated.

I want to buy a 2008 Suzuki Burgman 400cc scooter, (can’t use a motorcycle, leg problems). The bike costs about k. My credit score is 640 right now, which isn’t half bad. But on the other hand, I filed for chapter 7 bankruptcy in april 2009, which will probably affect my interest rate. I got a low balance credit card 6 months ago to help me rebuild my credit and credit score. Seems to be working (old score used to be 560).

Money is a bit tight though right now because I’m also trying to get myself a college degree. Did the idiot thing and dropped out years ago. I’m paying cash right now, but once I get my gpa back up to par, I can get financial help from fafsa. When that happens, I’ll need a vehicle. I do distance education at the moment, but some of the courses will unfortunately be on-campus. Also I’ve heard that even with D.E., some instructors still like you to come in for labs, lectures, etc once in a while. So I need something more reliable than having to borrow a vehicle off my friends and family. I think I can afford a cheap vehicle if I plan it just right. But I need to factor in the monthly payments and insurance costs first to decide whether I can really afford it.

On rough average, How much do you think the bike payments and insurance payments would run me per month?

I’m in a sticky situation. My ex-husband and I (when were married) filed for Chapter 13. SInce the divorce, I pay half the bankruptcy payment and he the other half. At the time we filed, we included our car payments in the bankruptcy, so until our last bankruptcy payment(which will be in 2 years, the lien holder will still have the title to my car. Since I’m still paying in bankruptcy and the lien holder has my title, I have to pay full coverage insurance(state law-GA). Well my car is finally inoperable and I am paying cash for another. Well it is operable but I refuse to put MORE money into a piece of junk to get it fixed. How do I get out from under paying insurance and registration on the old one without a title? Can I turn the car back over to the lien holder with no further obligation? What are my options?

Question for people who really know. Prefferable a law student or lawyer…My sister gave me her car so that she could get one with cheaper payments and wouldent have to let it get repo’ed. I became unemployed and couldnt afford the insurance any longer. I had gotten into an accident. The accident was deemed my fault. There is a company that is now persuing medical and workers comp. from me. This company has already paid out to the other party but wants to get the money back from me. I have been told my only option is to either settle and pay or file bankruptcy. At this point in my life bankruptcy is my only option. Can this company legally then, after I file chapter 7, try to collect from my sister. Keep in mind that although she was the owner on paper I have been making car payments for several months. I was the one that was driving and got into the accident. My sister didnt know I was uninsured. Can they still take her to court and get a judgement or garnish her wages?
Thank you for your answers. I am not a terrible person, however, not responsible at that point in my life. Unfortunately even people who are down on their luck and cant afford insurance still have to drive. Other than that it is beyond excuses. The reason I asked if I could file bankruptcy without leaving my sister for the fall shows that I am not willing in any way to abandon my sister with a debt that is my responsibility. I would not even consider the Bankruptcy if I wasn’t sure she would be "immune" to collections. Thanks for all your know how.
