years ago I purchased a 2 BR mobile home. The interest rate of the loan was at 18%.The total amount borrowed was 32,000.00. After 2 years I had another child now making the home too small and after 4 years of making all my monthly payments in full and on time, I realized I was getting no where fast. So I decided to file for chapter 13 bankruptcy which would consolidated the amount of the loan down to only what the MH blue book value was which was 16,000.00. I then made 3 yrs of payments through a trustee and I now own the home, but with no land attached it’s worth the same as a car. I have a substantial amount of income and have been on the same job for 6 years, but due to the bankruptcy my credit sucks and I can not even get financed for a new bed. My bankruptcy was complete and discharged a little over 1 year ago. From what I understand I need to be discharged from bankruptcy at least 2 years before I can get approved for any loan. I am in desperate need of a real home.

"I am currently in a chapter 13 bankruptcy and need to find a place to rent. I am not a bad person but have had some really bad things happen and had to get on a repayment plan through the courts. Now I need a place to live. Will I be able to rent from someone in my situation? I am a single parent and I need a home for myself and my child. I’ve been on my job for a long time now but need to find a place that rents for less than what I was paying to make ends meet. I moved with my parents but can’t stay here for long because of the space. Will I get turned down if I try to find someplace to live? I am willing to pay extra deposit or rent if reasonable. Does anyone know a website that address this situation.

Ok, my husband and I are in about ,000 in debt, He lost his job so he gets unemployment which the amount doesn’t even cover all the bills, I don’t have an education (I do take classes to get my G.E.D.,they take up my entire day; literally. I will be finished with it on May. 31,2012),so I am currently unable to work. We don’t go out to eat at all(strict diets and we hate people to serve us).We don’t have any extra expenses because our families pay for mine and my husbands cell phone, house phone, cable, and my husbands car insurance bills. His check is gone as soon as we get it so we had to get food stamps and medicaid just to help keep food in the house for our son and ourselves. I can’t get a loan for school to go to college when I finish, I have been told that if I file for bankruptcy then I won’t be able to get a grant,by a friend. I hate being in debt, having to rely on family to pay our bills , and not ever having any money, even though I am grateful to have a family who is willing to help us out when we need it. I
have done a lot of research on this matter and even went to 2 different financial planners who have both said to file for bankruptcy is our best option. We own an ugly old trailer(only worth 00 and 1 automobile worth 00, with a initial property value of 00 so every thing we have is safe from the property liquidation process). Oh yeah did I mention we are expecting another child? So I have advised a plan:

Plan:( we usually receive 00-00 in income taxes FED and 7 State, Husbands pay check 00 monthly even)
1) File for bankruptcy after I get my income taxes.(Filing for bankruptcy can cost in between 0-00per person if filing separate or 0-00 if filed together and we have someone who owes us money who is going to pay for out credit counseling courses and test, still no where close to what he owe us).We are filing it together. We would be filing for Chapter 7 Bankruptcy.
2)My husband and I would then open up a secure loan at the amount of 00 each that has a 6.9% interest rate and fees.
3)Now that all of the numbers have been ran, it is going to cost 04.11 per person to pay off the secured loan ( I figure we just open up a savings account, each, with the loan and put in 4.11 per person to cover the cost) and make automatic payments from said savings account for 1 full year. As I am sure every one knows the longer the on time payment history is the better credit rating you will receive. ( I figure we will need to do this for 5 years)
4)Take my husbands pay check and open 2 secured credit cards per person for 0 each with an interest rate at 1.5% .(only so low because it is secured, We both have terrible credit)
5)Turn around and pay our monthly bills with the card( bills and monthly hygiene products equal up to 2 monthly without paying off debt,we won’t have any more.)
6)Turn around again and pay off the cards with his pay check (our parents each said that they will give us 0 to pay for our 1st months bills free and clear as long as I finish school , so 00 cash total.)
7)Do this for 5 years while putting the released funds from the secured loan in a separate saving account at the end of each year for a house down payment(,000 plus interest)
8)Now 1 year after we set this up we will have 2 children, 1 will be 6 the other will be almost a 1.I will be finished with my G.E.D. education, Already started college( I found out the you can still get grants if you file for bankruptcy, they even have grants for people and student who have filed for bankruptcy,so my friend was wrong.)So now I can start saving for my children college,I chose the Gerber Life College Plan, I can pay 06.12 annually from my income taxes so that they will have a fair amount to get them started(I am only getting ,000 per child).
9)Still 1 year after plan started, use the some of the money form my taxes to open up a life insurance policy for the family, I chose 1 for 0,000 and is 2.09 a year(,000 per person).
10)Still 1 year after plan started, put the rest of our income taxes (about 07.68) every year for 4 year in our saving account for the house down payment(a total of 030.72 plus interest)

Ok so about 6 years into the plan we will have about ,000 in savings for a home, a credit score of at least 700 FISO (each), a good size life insurance policy for the family, a college graduate, A working college fund for our children, and an eye out for a modest home.

So my question is, Will my plan work if we stick to it? Oh yeah take in affect my hubby isn’t going to be unemployed forever and neither will I.

I have a lot of debt and don’t make enough to pay medical bills off and such. Is chapter 7 the way to go?
Just so you know Jackdneverf, not everyone in this world has such a good life as you! When you have a job that has no insurance every time you go to the doctor it’s automatically 0. Don’t judge someone until you have walked in their shoes!

According to online sources, my income is too high to file for bankruptcy (which I don’t understand since stars and wall street people can file). My monthly bills are higher than my monthly income. For over a year, I have been supporting my adult sons who don’t live with me – one has been in college and one has been unemployed due to depression and not being able to find a job. Is there a way I can still file for bankruptcy? I don’t see any way out. (Yes, I have now stopped supporting my sons but I would guess the one will file for bankruptcy soon due to his mental health and job status.) HELP!

I am interviewing with the NC DOC and it is looking good as far as I can tell. I am a 10 Year military veteran and a EX Deputy Sheriff that worked corrections for 6 years in Virginia. I am excited about the opportunity if I am offered it. i think the only thing that might hold me back in the I had a chapter 13 bankruptcy 2 years ago but it will paid off this month. I had to file due to a job loss.

What is the academy like? Is there allot of Physical fitness, do you have to sleep there, how long is it etc…

Just bear with me..
We got behind on our mortgage, and credit cards about a year ago, i lost my job, and my husband had his hours cut back. But now i have a job, and he has all his hours back, we are going to file bankruptcy, and we were going to do chapter 7. But if we do we will lose our home, because our mortgage is not current. And then we thought about filing chapter 13, the repayment plan. would that allow us to keep it? But im so scared we wouldnt be able to afford it.
What should we do…Should we lose the home, clear the debt, and just rent for a couple of years. Or should we file chapter 13, and try our best to stay afloat. We have a six year old, and one on the way…. PLease give me some advice, i have no one to talk to too. Thank you sooooo much!

Im 19yrs old, i got two credit cards when i turned 18, one had a 2500 balance and the other had an 8000 dollar balance. and for the first few months i had 200 to 300 dollars in debt and i payed that off from month to month, i recently had my car take a shit, it would have coasted me 5000 dollars for the new engine, so i just bought a used car for 5000 on my credit card. then i was lost my job for a 2 months and i put on another 2000, between paying for rent, ex….. then other things started to come up where i didn’t have the money and needed to pay them. So now i have both cards maxed out. not sure what is best for me to do. I cant afford much over the minimum payments, im not sure if i should go with a debt help/consolidation thing, file a chapter 13 or 7 bankruptcy, i really don’t have many assets they can take. its just getting hard to pay the cards, and other expenses. If anyone has any information that might help me or any tips. it would be greatly appreciated. Thanks All.
i was making 2000 a month now because i lost my job and i found a new on im only making about 700 at a min. up to 1000.
Also i have have a credit score of 753. it was with the help of my mother. she had me on her credit cards sense i was 15. witch really busted my score once i got my own cards and started making payments.

We moved to a different state and right now we’re using every extra penny (we’re talking 00 being cheap) to be in the same state as his daughter 6 days a month to visit. Out of this time, he sees her for 20 hours. On the divorce decree it leaves it open other than she can’t be away with her mother for more than 24 until she’s 5 without written permission. She is 4 1/2 now

If we got a lawyer and were seen before a judge to change that:
1. How long would it take
2. Which state would we have to be seen in
3. What is most likely to be the visitation agreement and what should we ask for?

She does not want him to take her ANYWHERE and rather than fight her, he just does whatever so that there is less drama being seen by his daughter. We have a 14 month old who we take with us, and me and her are about to have to stop going.
We live 400 miles away from her.
Her mom lives with her grandma, grandpa, sister, nephew, and her "fiance" and 2 other ppl
They are about to go under bankruptcy and chapter 13
She doesn’t have a job

Thanks so much.

I just bought a house and am moving there this weekend. I’ve been living with my boyfriend of 3 years in his house for a year. His house payment is eating him alive, which is why I got the very cheap townhouse for us to move. He has an ARM and his house is 0,000 below what he paid for it 5 years ago. There was not any real plan per se, but either bankruptcy or renting it out were what we talked about. Now that the time has come, nothing has happened. He has just frozen the past several months. It is me who is consulting a realtor for him in case he wants to rent it out and I’ve contaced and paid for a lawyer that he consulted for a bankruptcy.

He doesn’t qualify for chapter 7 unless he leaves his job and he loves his job. And he doesn’t want to do bankruptcy anyway.
Chapter 13 is a mess and I thought it wasn’t worth it.

However, his best friend is losing his house and guess what? He wants to rent out his house. So basically, my boyfriend is telling me he won’t be able to help me with only 0 his share for my house (his payment is 00) because he wants to pay the difference of his own house!

I’m very frustrated! I know the house is sentimental but I’ve been talking about getting a house since last year. It has been MONTHS that he has known this was coming and he is still frozen. So I need to get a roommate (I could afford it on my own but I do have a lot of debt to payoff) and of course, he’s telling me this a few days before we move.

I even planned for my boyfriend to have the whole small basement to himself and his studio (he’s a musician) and now he is telling me its too small. Gee, a whole house to share with just you and your girlfriend plus your own basement to have to yourself for your studio for only 0? Am I being too nice? So it sounds like he wants to keep his studio at his current house. In that case, I shouldn’t feel bad about renting out the basement, right?

He says he wants to live in both houses! I just want to live in the new house. I also feel his friend is taking advantage of him.

Do you think a few months down the road he will see things differently?
When I questioned his ability to pay then he questioned if the only reason I want him to move in is to help pay the mortgage. That hurts. No, but I DO need to pay the mortgage. And I shouldn’t have to feel guilty for asking. I shouldn’t have to feel bad if he has no extra money because he’s helping out his friend. Perhaps renting out the basement, the one I was going to give to him for free, might not be a bad idea.

I live about 25 miles from my district court house. I don’t live in the county where the court house is located. I received a questionnaire for jury duty. I work full time as a QA manager and it would impact my job. I am also currently funding an open Chapter 13 bankruptcy. Should I include in the questionnaire that it would be a hardship that my case might be discharged if I don’t pay the Trustee payments? My employer does not compensate me for doing jury duty. The jury duty compensation of would not even come close to pay my Trustee payments. I pay 5 a week in chapter 13 Trustee payments. I am just 6 months away from my case being discharged. Thanks for any help.

To start, I am now pretty humbled. I was making 60k a year, driving a new sports car, and living life happily with minimal debt. My wife and I made some poor financial decisions and I was left with a bit debt after our divorce. It is now at a point where with the economy, working in the sales field, I am only making just under 40k. I have 22k left to pay on the car at 0 a month, paying about 0 a month in gas to travel to my job, about 20k in unsecured debt. I had to abandon my lease in the apartment that I was living in so i have no clue what I owe to them. I tried to trade the vehicle in for something different but trade in is only worth 15k, so about 7k in negative equity, and with a low to mid 500 credit score, nobody is willing to work with me. I have thought about filing a bankruptcy, but even at 40k a year, I am above my means for a chapter 7 bankruptcy according to lawers, and breaking too even per month on a chapter 13. Maybe someone has a idea of a solution. thanks.

I’m in California, and my 1st mortgage is much higher than the property value. Who can help me to get a settlement offer? What type of attorney, do I have to hire to get a settlement.? Is Bankruptcy (Chapter 13) the only option, to eliminate the debt? After loosing my job, I fall behind my mortgage payments. With current income I only can afford to pay my 1st mortgage. Pls. can someone advise me what I should do. I’m really struggling, and worried over this.

My HOA’s Attorney raked up excessive unjustified fees on me for their own personal gain. I was late paying my HOA fees initially and willing paid the stated late fees along with my HOA dues. However, the Attorney collecting these fees does not accept credit card payments over the phone or online, etc. Therefore, I mailed the amount owed. To my surprise, I later received another letter indicating I owed another 0 for late fees. I ignored this notice b/c I thought that they probably didn’t input my payment in their system prior to the letter going out. So I received another letter stating I owed the 0 plus additional fees, and so on. Basically, each time I paid the stated late fees via mail, the Attorney claimed my payment didn’t arrive on time to their Office, and therefore I owed additional late fees.

In addition, all of my payments were applied towards Attorney late fees rather than my HOA dues. My dues were only 0 per year, but within that year I paid over 0 in additional fees that were never applied towards the full amount owed to my HOA. The Attorney continued to take their money off the top and say that I still owed a balance towards my HOA dues. As a result, I stopped paying b/c I felt I was being ripped off and the fees continued to increase. They ended up suing me for the amount they claimed I owed along with more Attorney fees and court cost.

Since I mistakenly missed the initial court date, when I showed up for the second court date where they filed a judgment against me, they won simply b/c I missed the initial court date. Now they are garnishing my bank account for the amount owed from the judgment.

Currently, I’m unemployed and my home is in foreclosure. I recently filed chapter 7 bankruptcy to stop the sale of my home so I can have time to secure a job and work out a modification on my home loan and get it out of foreclosure. I have not had the meeting of creditor’s as of yet. Can I discharge the past due HOA fees from the judgment/garnishment? I am willing to pay the past due HOA fees I accumulated after the garnishment since I intend on keeping my property. Also, I live in Georgia. Thanks for your answers.

When I was 16 going on 17 my parents had lost their job and things were pretty hard. I didn’t know what to do I wasn’t making a lot from my job so I had decided to do one of the most craziest things and applied for credit card and personal loans using my SSN by pushing my age up by one year. I was able to keep the bills up but it cost me severely. I checked my credit today and at the age of 18 I am already ,000 in debt. I plan on going to a company here in Indiana called CCC were they talk about bankruptcy or consolidation. How long will it take to get out of debt and start rebuilding credit? What is the difference between bankruptcy and consolidation and which one is better? Please don’t lecture me I know what I did was wrong and I am already paying for it right now and don’t need criticized for it by people online. Just answer the question, thank you.

I live in San Diego, CA. I have absolutely horrific credit (not bragging). I had a rough patch which basically demolished my fair credit score about 2 years ago. I have been working at the same job for years and in the past have rented various luxury apartments in the past (when I had fair credit). I have never had a problem with a landlord as I have always paid my rent on time. My credit history tells a very different story however. I think my FICO is a whooping 500 which is terrible I know. I am now what they call cash rich, credit poor. I’m finally making really good money, but I have the worst credit rating. I don’t want to have a co-signer, but if I have to I can get one. I can also afford to pay double whatever the deposit may be. Will the fact that I’ve had the same job for four years, make over 3 times the rent amount, and have a good rental history save me from my terrible credit history? How tough are landlords about this sort of stuff? I want the apartment in my name only and I have a dependent.

I know that people experiencing worse situations…i.e. bankruptcies must be able to rent, so surely I can rent someplace?

Does anyone know of apartment complexes in San Diego that either don’t do credit checks or that will work with people with bad credit? I did find one place online that is a luxury apartment and works with people with bad credit, but I really want to save money and all their apartments are 00+.
