Can I Get a Mortgage after Bankruptcy?
I filed Chapter 7 Bankruptcy in 2002 due to a divorce – and then Chapter 13 Bankruptcy in 2007 due to medical bills and the mortgage payment on my house was on an ARM and I couldn’t afford it – I just completed the Chapter 13 – never missed a payment. What are my chances of getting mortgage in approximately a year or so. I’ve been employed for the same company for 26 years.
I’m having to file for bankruptcy due to exorbitant medical bills. Advice?
I’ve just found out today that I am likely to have to file for bankruptcy. I have a chronic medical condition that has required multiple hospitalizations in the past 15 years (cerebral vasculitis), and I’ve just been informed that I’ve hit my lifetime maximum (0K) with my particular private insurance policy, and they will no longer cover my healthcare expenses.
For the previous 5 years, I’ve paid a total of ,000 in premiums to my insurance company. My remaining medical bills total over 0K.
I make too much to qualify for Medicare. My principle professions are per diem nursing and exotic dancing. Neither of these jobs offer group health plans.
I’ve come to a point where I just do not know what to do. I am planning to file for bankruptcy to have my medical bills discharged, but it is not as if my medical condition will go away. I’ve been a per diem nurse, because this particular professional configuration allows me to work when I am well, and does not punish me for multiple absences when I am going through a particularly bad spell of seizures. The same is true with my particular exotic dancing job.
After this – bankruptcy, plus meeting my lifetime maximum in medical expenditures – I will never be eligible for private health insurance again, unless it is associated with a group plan.
So I’m in a quandry. I could potentially quit the dancing career that I love and try to find a full-time nursing job in order to get group health insurance… but this will be something that I find completely unfulfilling personally, and when my health gets particularly bad, I’ll probably be wearing the patience of my colleagues and bosses.
Or I could quit both of my jobs, file for disability and live off of the government and your tax dollars for the rest of my life. The second choice is, of course, easier… and probably the route I am going to go. But I’m wondering if any of you have any experience in this and have better advice?
Palin Power!: You’re right. I do make more than enough money to pay for my anti-seizure meds and steroids. What I don’t make enough money to pay for are the 6 brain surgeries and extended post surgical recovery periods I have had in the past 15 years.
FBH: Thanks. I do speak Spanish. And as a nurse, I can tell you that what you think illegal immigrants are getting away with in terms of healthcare is not true. Hospitals often dump their indigent and illegal immigrant patients, if they don’t have staff that call ICE on them while they’re in the hospital.
No2McCain!P: Don’t worry. I’m voting for Obama, and I registered 67 people to vote this week too. Every single one of them said they were voting for Obama. He may not get us closer to better healthcare, but I do trust his ability to get us in a better place financially and diplomatically as a country. Too bad things are so bad for so many people right now.
Hypochondria is ruining my life.?
I have bad hypochondria. I developed this 3 years ago and it’s pretty bad. I’m constantly fearing that I will catch some disease and die or that I will move my body or eat wrong and choke to death or break an internal organ. Most of my fear is of having a heart related problem. I don’t go out anymore and I stay inside so that nothing bad happens, like getting in a car accident. If someone mentions an accident or death of a loved one it makes me both sad and very scared and I have a panic attack. I spend hours looking up symptoms online and I now have to file bankruptcy because of medical bills for doctors visits for minor illnesses when I didn’t have any health insurance. I want to go teach english abroad for a year but I don’t know how I can when I can’t even barely leave the house outside of work. I’m afraid I’ll get ill and die in a foreign country.
If you have no other choice and need to file bankruptcy, which is better chapter 7 or chapter 13?
After trying to find ways to be able to take care of our responsibilities we have come to the last resort and that is to file bankruptcy. We don’t own any homes or any real property. what I am curious about is which is better chapter 7 or chapter 13. We want to be able to start saving a soon as it done and when feesible start rebuilding credit. Our credit card debt is only 00 which is a lot, but it could be worse. We just had two bad years with this one being the worse. I am looking for advice on the best way to go between the two. Chapter 7 or Chapter 13 and why.
We are not happy about doing this as we have tried everything. We don’t have anything of value and we have tried to pawn stuff but couldn’t get .00 for most. We live very modestly. So please do not answer this question if you are going to be negative.
Thank you so much. We want to do the right thing so we can start over and never have to do this again.
Thank you so much for all that has given advice so far. I guess I need to add just a few details to make the situation clearer.
As I stated it has been a bad 2 years, actually almost 3 years. I got real sick and had to leave my job and am now on disability. My husband took on a second job a year ago. He pays child support. Between the two of us we have 5 kids between the ages of 9-16. We have two vehicles, which one is in the shop. We also are surrendering this vehicle.
We have an attorney and he is recommending chapter 13. I (we) have a lot of medical bills. After I had to leave my job I couldn’t afford the cobra payments for continued health insurance. To maintain health insurance with my husbands employment (state worker) would have cost more than the cobra payments.
My ex- husband filed bankruptcy and I did not know that anything he had when we were together, came back to me.
I never thought I would get sick and have to quit work. I was not prepared.
I’m thinking filing for bankruptcy! do you think I should do it or not?
I am 33 years old single female.I have no children. I live alone. I pay rent in my small apt. I still owe my car. My debt is right now k and is increasing every month because of the interest. Debt its in credit cards and medical bills. I’m a licensed massage therapist and I’ve tried to work in lots of spas but all of them are terribly slow. The most of the days there are no clients. Now I work daytime in 2 spas and nighttime with private clients. But not everyday I have clients either daytime or nighttime.I don’t work with a doctor because I make less money than what I can make in spas and on my own. My income right now is around k annual with a debt of that’s its increasing each month. My lines of credit have been reduced, now I’m only paying the minimum amount and without enough credit available to spend. I am getting physically very sick (which affects my job) and mentally very depressed because of this. I have never being late in any credit card bill, but I will be very soon because the minimum payments will be higher and impossible to pay. I don’t care if I have to pay rent the rest of my life. I just want to be peaceful and pay my basic bills, live in an apt, keep my furniture, my tv and my car. I don’t have luxury and I don’t care about luxury. I have known a lot of people that in 3 years they have built a great credit after a bankruptcy. And I know I can build it up again well someday.I have a friend that 2 years after filing for BK, start receiving tons of credit cards offers. I know that the economy it’s too bad, that millions of people are filing for bankruptcy and the banks make money from interest so sooner or later will offer credit and loans because they won’t have any other choice. About consolidating debt, I have to cancel my credit cards but still paying monthly payments. It’s what almost I’m doing right now, paying but not be able to spend! so what’s the difference? that I’ll be in the newspaper, not being able to buy a house, not getting credit cards for the next couple of years? I don’t think that’s too bad.I can live with that. What I can’t live is with stress, being sick, being depressed, not sleeping well, not eating well because I have to work so hard to pay a huge debt!! So, what would you do in my case? Thanks for reading my thread! and happy holidays.
I would do it if I can pay off my debt in just one year!! but in the track I’m going, the debt will be almost doubled and will be impossible to pay it even in 3 years! And I can work my ass off, but is not only in my hands to do it, the economy is BAD, and in my job, everywhere I look is BAD, so it’s not only depending if I work my ass off or not! I prefer to be embarrased the rest of my life of filed for BK instead of being embarrased because I was sued from my creditors and having all my belongings (like car) repossesed, and being almost homeless! Credit cards are poison, I don’t care getting one again someday actually. I have friends that they don’t have a credit card for years and they are happy. I don’t know why it’s so important for some people to own a house. I can live paying rent, I prefer investing in something more valuable than that, like education and good health.
Yes.. all of you are right. I’m gonna do my research with lots of companies that helps to consolidate debt. I need at least my debt go down 50%!! and decrease for sure the interest rate!
Oh no, I don’t have anything in luxury!! I have a dodge!! you think that is luxury?? I have 60k in debt because has been accumulated by interest for the last 3 years! how I’ve said: my profession is slow everywhere, is not that easy like "finding second job"! there are no clients! don’t you get it?? and actually I’m working daytime in 2 spas and nightime with privates! I arrived at home at 12am sometimes later because my privates live 1 hour away! I DON’T HAVE ANY LUXURY!
I filed Chapter 13 in 2004 while I was in the military. Now I’m out and am about 0,000 in debt for medical bills. Will I be able to file for a Chapter 7 since I’ve already filed once before?
The lawyers that helped me file the first time never said anything about a Chapter 7. They told me that Chapter 13 was the only option available for filing bankruptcy.
I am thinking of filing for Chapter 13 bankruptcy. I already have one judgment against me and I am worried another collection agency will be taking further action. How do they calculate the amount that the Trustee will accept for repayment? I am already paying close to 00 for my unsecured debtors. I am concerned because I am going to have some large medical bills in the near future. Any help would be appreciated. Thanks.
Should I fear bankruptcy? Has anyone hear ever had to go through it before?
I am not teetering on the edge of bankruptcy at the moment, but with soaring energy prices and can start to feel my disposable income dwindling and credit card debt rising. Is it really that big of a deal over bankruptcy? Should I be giving myself a heart attack about it? I don’t view myself as a spend thrift, I feel I live fairly modestly. How does bankruptcy really affect your life? Right now, my wife and I rent, and we have had to pay about 00 in medical bills in the last year (although we are insured).
What is the best way to buy a pre-owned car 5 years after bankruptcy?
I declared bankruptcy 5 years ago due to medical bills. Since then I have had no positive marks on my credit report, but no negative ones either. I’ve been working a steady job for 4 years now, and make a decent amount of money, but due to having to pour it into repairing my car, I havn’t been able to save up more than 00. I just moved into a new apartment where I am now paying very little rent, and I am making decent money, but my car really needs to be replaced. What would my best bet be? I currently make 45 monthly, 0 goes to rent, to cell phone bill, 0 to utilities. I read about buy here pay here dealerships and would like that to be my last resort. Are those companies that offer bad credit loans online legit? Or am I just going to be bombarded with spam with no end results? Thanks for any help!
What does the judge look for in your bank statements in a bankruptcy?
I’ve had a hard time the past couple of years. From having an unexpected surgery that cost over 27K to temporary unemployment and then a low paying job. I am thinking of going for chapter 13 bankruptcy since I got a better paying job now and I know I can’t file for a chapter 7. However, I’m worried because the lawyers have asked me for 6 months of bank statements and for the past 5 months I have been living with my parents and not really paying for anything other than my living expenses. At that point it was useless to pay anything to my credit cards since by then they wanted me to pay all or half of my debt to them. Now I have a job and I finally got my own place. I guess my question is; if I take the bank statements and they see that out of the 6 months I’ve only had big living expenses in the past month, would this have a negative effect in my outcome? I’m not asking for a chapter 7. I do wanna pay my debtors, I just can’t pay all of it. By now its almost 50K with medical bills and credit cards. Thank you for your answers.
Should I file for bankruptcy?
First and foremost I want to say thank you for all answers I recieve. This is obvisously not an easy time in life and all answers are carefully read, as I hope that you take into consideration all that my situation entails.
When I was 19 I set out to get myself a great credit score, something both of my parents could never do. And I did, I went through my credit report took off somthing that my dad had put in my name as a kid and got my first credit card, making on time payments and just having a balance of on the 0 limit. Well, then I, after my dad moved and other bad things happened in life (theres a long story there) I kept getting more and more cards I think trying to distract myself from my situation at the time. So I eventually realized that crap I was in a lot debt (00) which on my Starbucks paycheck of 0 bi weekly and rent in Detroit and car repairs, I was already making minumium payments so I moved to Charlotte NC to stay with my mother and pay this off. I got into debt counseling (which I feel was a mistake) I reduced all my payments from 0+ a month to 200. Well now I live in TN where the taxes and cost of living is lower. I sold my piece of crap car for a whooping 0 after it broke down and my gf and I have been sharing her car for the last 4 months and the budern as been great on us both.
Now I find myself so stressed. I let my dad use my eBay account after he lost his job so he could start making money to help himself live, but he sold stuff he didnt really have and now my paypal accoutn is at -00 and he hasnt paid on our cell phone plan (which is under my name) going for a total of new debt thanks to my dad (this is all dad related) to 00.
Well My credit card debt hasnt moved too much. And heres roughly where I lay now:
-00 in credit cards being paid off through credit counselling
-00 in medical bills I havent even touched (oh and I dont have health insurance either I took another job that promised more money but turned out I dont get medical for another 6 months)
-00 because of my dad and my sere stupidity
-00 in student loans (which I know cant go away with bankruptcy)
————–
Total = 800
I make 12000 a year and I cant just get another job because I dont have a car and my gf and I share one. I never thought I would consider this move but Ive tried for years now to do it the honest and hard working way and its gotten me nothing.
If you have a question go to my profile and click email me! Thanks!
I know that filing that would mean I couldnt get a car loan and some places wouldnt hire me but trust me that doesnt seem like a bad sacrifice even though Ch 7 would be on my record for 10 years. And once again thank you!
Hi, my husband & I filed Bankruptcy 11/20/2006 due to a local attorney coming after us for ,500 in medical bills from 1998-2001. We had our hearing on 1/9/2007 and our bankruptcy is due to be discharged anyday if it has not already.
Now, we are looking to move into a new apartment, but they would like you to have a credit score of 500 or better. So I am wondering what a persons credit score is after discharge of chapter 7? I also have a Target Store card of which I have had for several months, made one purchase & paid it off, and it is still revolving.
Thank you to anyone who replies ![]()
How can I borrow $2,000 online?
My spouse & I finalized bankruptcy and it was discharged in July, 2007. We owe very little, but do need to consolidate some medical bills and a high-interest loan we want to pay off. All our bills are current and paid on time. We do have adequate income to make monthly payments on a ,000 loan.
Is it possible to sue a mobile home manufacturer after you have filed chapter 7 bankruptcy for unsafe housing
We had to file chapter 7 bankruptcy because of high medical bills from myself sliding off the roof which was supposed to be covered for 30 years. We reaffirmed the mortgage debt and are still paying it but the house has become a health hazard. Can anyone please help?
I have been in Chapter 13 Bankruptcy for 2 years and it will be discharged in 1 more year. Is it possible to get a ,000 – ,000 home loan? If so how and with which lenders?
Actually the court can approve that you can get a loan. The only reason it was filed is bc we had an enormous amount of medical bills. That was it.
New help please. Serious answers only. My sister is facing forclocure. She is working with a attorney in her?
city to help save her house. Her and her husband are filing a Chapter 13 bankruptcy and their attorney said this save the house and help clean up their credit. All I want to know is , is this true? Will a Chapter 13 bankruptcy save their house? Serious help only please. ty
She is behind because she went into the hospital for over a month. H
They are behind because she went into the hospital for almost a month. Her husband tried to make the paymts but with medical bills hitting them and their living bills it was too much. Plus she was off work for 60 days then it took another month to get her hours back at her job. They are great now. Her health is good and he’s bringing in a steady paycheck. There attorney said he can save their house with a Chapter 13 bankrupcy. So they are filing for tomorrow.
Can someone tell me the difference between chapter 7 and chapter 13 bankruptcy?
Unfortunately my husband and I are thinking about filing bankruptcy, well my husband actually. He’s lost his job, just found our he has cancer. So we’re surving on unemployment income and the medical bills are mounting. I’m trying to find a job, but I haven’t had any luck yet.
We dont know if it would be better to let our home foreclose and not file bankruptcy or just file bankrupcy.
Can anyone give me any info
