I did talk with my attorney about this but he gave me no kind of answers, so I will not use him again, for help. I am currently in a Chapter 13 Bankruptcy, and what I wanted to know could I stop paying on this one and let them discharge it, and then turn back around and file either a 7 or a 13 which ever one will be best for me. The problem is this: I have alot of medical problems and at the present have 00.00 in medical bills I just cannot pay. I have tried to pay on them, but just do not have enough of money to pay them, for I don’t make much at all.I do want to keep my house, and I do have a 2nd mortage on it for about 4000.00. Could I do a 7 and keep my house, or would it be best to do another 13. And can I do one after this one would be discharged? I am so mad at this attornery for everything I asked him, he would say, I don’t know, but yet he was telling me to quit paying on this one and let them discharge it and then come and see him, but he could not give me specific answers as to these questions I am asking above. I know I will have to retain a different attornery for I will not use an idiot like him. Can you please give me some answers for I am in a mess, for I have no medical ins. at all, and I am all alone with no one to help me with this. I have been told if you file a 7 that a 2nd mortage can be terminated also, is this true? Any help will be so deeply apprecitated and please no smart answers for I am under so much stress about this, What can I do?

my chapter 13 is 100% pay can the trustee go into my bank account if i leave money in there every week to live on can he take it out. the I.R.S. is included in my payment

My grandmother and grandfather have accumulated lots of credit card debt mostly because of my mother (she stole their credit cards in the past and ran em up). I believe the debt is over ,000

Grandpas retired. Grandma still works but will be retiring soon. My mom can’t pay their debt all the people in my family work low wage jobs. They simply don’t care about credit anymore. They pretty much don’t need it. They have a place in their home country that they want to retire to.

I guess I’m the problem. The house, they want to leave to me. They almost did the reverse mortgage thing but realized that as soon as they leave it gets taken away. They also are uninterested in bankruptcy since it costs money. Theyve stopped paying a lot of the cards because they just can’t afford it. What should be done?
By the way, we live in Texas. No liens on property & no wage garnishment. More to add to their indifference haha.
They plan on retiring to a different country. No need for American credit there
@the kid: When did I say I would lose money? I’m concerned because they have worked hard all their lives and have helped me a lot, and deserve a break and to finally go back to their true homes outside the US

I worry because they’re my family and I have watched them suffer because of debt all my life. I want to free them of that burden.

I’m 38, husband 41. We’ve been married for 11 years and have a ten y.o daughter. After he lost his business due to a irreconcilable dispute with his partner (this is not the first, losing and disputing I mean) and fell into a terrible bankruptcy, we had to move back to my father’s house early this year. I had to let go of my own business, but thank God my old workplace is willing to take me back, but my husband is still jobless. He only stays at home, but claims to be looking for work/business through the internet and his network (by phone/text-messaging). He spends most of his time in front of TV and computer, and gets angry when I ask about his plans. He said he had been the breadwinner for ten years, so I should give him a break now. I don’t think this is true because I had my own business, and my father gave him a lot of money so he could start his business.

I just can’t communicate with him cos he just walks away or says something nasty if he doesn’t like the topic. He only helps with our kid and the chores when he is in the mood, which is rare. I wish we could see and talk to someone about this, but I don’t think there are any marriage counselors in my area – I live in a small town in Indonesia – but if there were any, my husband wouldn’t go. I asked him once to come with me to see our pastor, but he only told me to take a look at myself in the mirror before judging others, and not to hang our dirty laundry in public.

I want to make sure that this is only a stage that I have to go through, that I just have to brace myself till it’s over, that I’m not being weak and lame, and making myself everyone’s door mat. I feel so limited now and that makes me really angry. Maybe if there were just me and my daughter, life would be less complicated? Maybe we should plan to move away together, just me and my daughter? Or maybe my husband is just afraid of facing life after the loss? How can I make him want to get out there and start over? I hate having to support a healthy man all the time. And I don’t think he’s being a good role model for our daughter. What should I do?

Due to having cancer twice I cannot get life insurance. I am the father of three children under the age of five. With my student loan in excess of 0,000, any money that I would be able to save for my children instead goes to paying off my monthly student loans. I have taken all the forbearances I can and cannot consolidate to any lower monthly payments. I filed for bankruptcy in 1999 after my second bout with cancer as I was unable to work during my treatments and was told student loans could no be filed under bankruptcy.

If there are any grants, organizations or philanthropists that could help a two time cancer survivor pay off his student loan, I would then be able to start saving for my children’s future since I am unable to get a life insurance policy due to my cancer history. I would be eternally thankful for any resources that I can work with to help me with this hardship. Thank you.

I sold my car last year to someone for 00. He gave me 0 up front and we drew up a contract stating that the rest would be due no later than December 6th, 2010. When the time came, after many missed emails and calls he told me the car was in the shop and that he couldn’t pay it right then. After a great amount of emails and calls that went unanswered, I showed up at his house and asked his mom if he was there. He told me he had to file for bankruptcy and his lawyer told him not to say anything to anyone. He told me the car "had been taken" and told me to talk to his lawyer about it. After trying to leave a message at his office three times, the secretary got fed up and told me that there probably wasn’t anything that they could do for me and that I was named in the papers but they didn’t have the car and they have no idea who has the car. After this, I decided to do a bit of snooping online and have enough evidence to show that he still has the car and is even in fact trying to sell it online. He won’t respond to calls and keeps redirecting me to his lawyer. His lawyer answered the phone today surprisingly and told me that I was named as an unsecured creditor and that my pitfall was in not declaring a lien on the car when I drew up the contract. I asked him
‘If I were to go to his house and ask for the car back, would he have to give it to me?’
‘Bear in mind that he is my client and everything I say will be in his argument, but no, he has a right to the car because you gave him the title after signing the contract.’

I tried to contact a lawyer but he said he’d charge me 0 for a consultation.

I told the kid I’d need the money by the end of December so I knew I was going to be able to afford taking summer classes this year. Now I’m broke and can’t afford summer classes and might even
have to graduate late..this guy is ruining my life.

What should I do?

I just paid off a chapter 13 bankruptcy about a year ago, so I am trying to help boost my score as much as possible.

I had to find a place that would work with me and the trustee for a car loan while I was in my chapter 13 repayment plan. I found a place, but of course the interest was high (19%). I have about a year left till it is paid off, and I have the money to pay it off now (a year early). The difference between the pay off and balance is only about 0.00.

I thought about paying it off, but would it help my score increase more by making my payments for the remainder of the loan?

Someone owes me a lot of money and they have filed for bankruptcy(chapter 13) here in Pennsylvania. I am part of the proceedings and will get about 30 cents on the dollar of what is owed to me for 5 years. The couple filing made a verbal commitment to me (that was witnessed by at least 3 people) that they would continue to pay on the loan after the 5 years until it’s paid in full. The law of course says the debt is satisfied after the 5 years. Is their verbal commitment to me enforceable if it would come to that? At least 3 people will testify for me that they heard and were witness to the conversation. Will I win if it goes to court on this basis? Thanks for all answers.

We bought a house by land contract 2 years ago. We have never missed a payment and the mortgage is, as of now, paid up to date. The guy we purchased from (the guy who still holds a mortgage on the property) was a small business owner and his business went under. Now, he is filing Chapter 13 bankruptcy because of his business losses, but this only allows him to protect the house he personally lives in, despite the fact the mortgage on this property is good. His lawyer is telling us to just keep making the mortgage payments (directly to the mortgage company rather than thru him) and well be good because it’s not in default. The mortgage is thru GMAC, who we hear are not fun to work with. Are we going lose the house? Should we stop making payments? Scared sh*tless right now, we have three children, have invested a lot of money into the house on renovations (roughly K), and we recieved the K Home Buyers Tax Credit when we signed the contract. Feel like we’re in deep. HELP!!!

I understood why we invaded Afghanistan to get rid of the Taliban. Our troops were very successful in this venture. From Alexander The Great until now has shown how futile it is to keep troops there indefinitely! The British could not and the Russians went bankrupt over it. The United States is on the brink of bankruptcy, but still keeps pouring more money and the precious lives of our soldiers into that debacle!

I would appreciate if somebody can give me good solid reasons why we are not out of there?

So you’re struggling to pay your bills and still have money to feed the children. You go visit a lawyer and he suggests filing chapter 13 which would be a monthly payment to a trustee for an amount that is very close to what you’re already paying out each month…. Granted the time is shorter, but if you’re struggling now, how does this benefit you? Any polite answers are very appreciated!! Thank you!

My grandparents are retired, they get their SSA checks every month, and food stamps. Currently what they receive is enough to pay for bills, mortgage, credit cards, and other expenditures; in other words, the income they receive is enough to get them by. Over the last couple of months they’ve been thinking about leaving their house for good. They refinanced the two mortgages they had on the home mid-2010 and were able to avoid doing this for a while. As I’ve mentioned before, they are not running short on money. Eventually they made up their minds and decided to leave the house once and for all to live with their son who offered them a place to live. There are several reasons for this decision and I feel that they are not relevant to what I’m asking.

My questions are these:

- What will happen to the house once they are gone and stop paying the mortgage? I will assume that foreclosure will inevitably happen, but what concerns me is that they are not physically there to answer any questions or to meet with anyone or reply to any letters/phone calls. I want to know if there is a special kind of foreclosure that deals with cases like these.

- Can it affect them legally in any way?

- Who will take possession of the property?

- From some research I did online on bankruptcy it became obvious that they were not suited to receive the discharge since their financial situation is relatively stable, but I want to know if this could be an option to relieve them of their home and other debts without having to just quit living in their home.

By the way, the property is in Clayton County, GA.

Im 19yrs old, i got two credit cards when i turned 18, one had a 2500 balance and the other had an 8000 dollar balance. and for the first few months i had 200 to 300 dollars in debt and i payed that off from month to month, i recently had my car take a shit, it would have coasted me 5000 dollars for the new engine, so i just bought a used car for 5000 on my credit card. then i was lost my job for a 2 months and i put on another 2000, between paying for rent, ex….. then other things started to come up where i didn’t have the money and needed to pay them. So now i have both cards maxed out. not sure what is best for me to do. I cant afford much over the minimum payments, im not sure if i should go with a debt help/consolidation thing, file a chapter 13 or 7 bankruptcy, i really don’t have many assets they can take. its just getting hard to pay the cards, and other expenses. If anyone has any information that might help me or any tips. it would be greatly appreciated. Thanks All.
i was making 2000 a month now because i lost my job and i found a new on im only making about 700 at a min. up to 1000.
Also i have have a credit score of 753. it was with the help of my mother. she had me on her credit cards sense i was 15. witch really busted my score once i got my own cards and started making payments.

I would like to hear from people who filed and experience chapter 7 bankruptcy. I want to know to if it actually stays on your credit report for 10 years. Is it also possible to get an apartment and a checking account from credit unions or banks?

Yesterday, my family wanted to buy a new car.
We spotted a Camry 2011 Sports Edition at k.
Saleperson was really nice but we asked for k but the saleperson said that he couldn’t do it and need to ask his "manager" if it was ok to to sell it for k.
10 mins later, saleperson was like, ok, the manager said it was ok to sell it for k.
Then manager comes out and asked the saleperson what the hell was he doing. He then suddenly said that we can’t buy that car cause he’ll be losing money if he sell that car to us.
The manager was like… hell no to us. But he did make a deal with us.
He said we can buy that car at 175% interest with ,000 downpayment but he will need to take away those racing wheels away from the car. The final price was ,000 at 50/month.
Then my dad was like, are you joking me?
Then the manager was like, there’s no way that I can sell this car to you for that cheap because your credit score doesn’t even reach 750 and is only at 715 right now, plus you are a bankruptcy person, chapter 13. So it is either you take this deal or no.
(Manager yelled back at my dad so loud that everyone heard that we used to be bankruptcy and also told them our credit score in the entire building. Isn’t those things usually kept private?)
We were bankruptcy in 1991, that was almost over 20 years ago and we paid it all back.

So… what the hell is his problem?
And seriously… do you think they will lose any $$ if they sell a k car for k?
I doubt it unless they bought the car at k.

Anyway, I kinda felt bad for the saleperson, we wasted over 2 hours trying to find a car.
But, do you think the manager sounds racist?
We’re planning on talking to the boss tomorrow.
My bad… the manager is Philippians and we’re Chinese.
I guess I missed this part, he also told us that since We are Chinese, we can’t afford this car and that once you buy it, in 1 month, we’ll throw it back to them. He also told us that we should go back to China and buy a car there.

Should I just charge it all on my credit card and then declare bankruptcy because I know I can’t pay them off.

Or should I just be like everyone else and take tons of loans I also couldn’t pay off.
I’m at the end of my rope here, I don’t make enough from my full time job to even pay for half a year of college, let alone two or possibly four.

I want to go into communications–media production, creative writing.

I’ve exhausted all colleges. Community colleges, online, etc. I’m in Michigan, and I wanted to go to GVSU, but there’s no way I can afford it. I don’t care which school I go to, a community college is fine with me.

I graduated two years ago and have been working since then, saving practically all of my money. But I don’t have enough saved up at all.
I don’t know how to look for scholarships and grants. All I’ve done is the FAFSA. Please, any advice would help.

Unemployment is not enough to live out of and finish my bankruptcy. I have come so close where is my bail out money for me and my house. I tried to do he right thing and filed a Chapter 13 to pay what i owed. Not knowing i would have no job in least than 3 years.
