Dear president Bush, I am30 years old been in serving in a little church that had lots of rules since I was 16 I have worked since I was 15 and have tried everything like college for 5 years or more and food industry along with sales fetting no where financially I admit I am a little slow with comprehending paperwork things Ifinally found nails to be the career I want to keep but for 7 yrs pursuing it things came up I started in a salon ,no walkins,1and a half yrs later filed bankruptcy after having a level credit got another job before filing to avoid banckruptcy.then tried again then my brother won full custody of his kid and wanted my help so I quit dong nails went back into teaching which i dislike and for my church under min.wage across town 6 days a week and raised her for 6 months got credit cards to pay gas,her toys and clothes food etc cause she came with none, found out my brother was doing drugs gave her back went back into nails in which the owners sold the salon to a new boss who fired me when I dislocated my kneecap and tore ligaments in which i am awaiting surgery,and cant get unemployment cause it was cash pay and ssi says i didnt put into it wheres the $i have worked for since i was 15 before i did nails.I cant get medical cause Im 30 without kids.My dad has helped me here and there I lived in a trailor by myself I have never depended on men to treat me cause of the raising in that church I wish I did have a kid so I could get help but Im always last on the list or not on the list at all .Ido have a major gift to sing and thats sbout it could you please help me Im still trying to build a clientelle doing nails unmarried with no insurance and in debt bad please respond.Aside from the drama in my life Bush I think you are doing an awsome job and you continue to stand your ground stay with your godly morals and reject any foolishness the media saysthat is not of God i pray for u oftenthankyou anyway

in 2005 my parents bought a house in Palmdale, CA.; Assuming that since the real estate company we went to was owned by a cousin of ours and since my sister was working with the company at the time, I have little knowledge of the transaction that was made to buy the house. From what I have understood, however, was that the mortgage that my parents bought into was a fraud, as many were at the time because they were pressured to finance the house without knowing the fine print of the contract; this resulted in them paying high prices for a house that depreciated in value over time. In any case, the damage was done and they resolved to put the first house in short sale while they bought another house for a low price, which is a house that we live in now.

About 3 months later, the first house they owned never sold and they found out at the time that there were squatters in the house. I don’t know how these scammers did it, but someone found a way to list the first house in a different website, forged the documents to the first house (I can’t say how they did it, since we shred any papers that have our personal information), and they might have found a key that they duplicated and "rented" this house, online, to a family that is on welfare.

My sister confronted these squatters, the police came to our place of residence and took copies of the fraudulent paperwork. The squatters had the nerve to ask my parents for electricity and water, but my parents never complied with their requests. When it came time for my parents to file the report at the police station, all of a sudden the police say we have to get a lawyer and to pay money to file the paperwork so that we can take these squatters to court (who still seemed to live in the first house we bought). These squatters, as a result, refused to let anyone see the house and the short sale never happened.

Because we dont have enough money ourselves due to high medical bills, the resigned on the pursuit to evict these people from our first house, but I can’t accept this (My parents are practically receiving calls everyday from a collection agency, but they decided to let the bank take the house and go to foreclosure, which will leave them in bankruptcy and ruin their credit).

I would have assumed that the police would have evicted these people, given they have the evidence right in front of them, but is there any low cost community resources that we can refer to get this nightmare taken care of or do my parents have a reason in just letting go letting the bank take the house?

I am being sued by business I have never heard of. I was not served with the papers because I have moved from the address they think they served me at. I only found out about it because I started receiving advertisements in the mail from local attorneys that apparently read the public files at the courthouse. I looked online and there was a lawsuit filed and it shows they served me with the papers. I went to my old address and talked to the new owner and she said a constable came by while she was at work and gave her 84 mother the papers. The new owner called the business suing me and left a voice mail telling them I did not live there anymore, did not receive the papers and then shredded the paperwork. I changed my drivers license, voter registration, social security card, had a change of address filed and was receiving my mail, etc. within a day or so after my move. I was not avoiding anyone. The attorney’s ads said that a default judgment against me could be filed if I did not answer this lawsuit so I went to the District Clerks office and filed an "answer" to the judgment saying I was never served and do not know why I am being sued. The default judgment date was stopped and now it is going to mediation. I have to pay 0 for this mediation and still do not know why I am being sued. I sure can’t afford an attorney and have filed ch. 13 bankruptcy twice in two years, both times I could not keep up with the payments so it was dismissed.

The District Clerks office said that now that I answered the lawsuit, I am a part of the lawsuit and must go to mediation, ETC.

My questions is: Am I legally obligated to continue cooperating with this lawsuit even though I have not been served the papers telling me what it is about? My answer was that I do not know and have had no contact with the business suing me.
No reasonable effort was made to serve me because they handed the papers to someone and assumed it was me or maybe they asked her and she did not hear them and said yes.

It may be dropped now, the mediator, a law student, called me and I told her that I did not have the 0 and that I can’t understand why anyone would try to sue me – I don’t own a home or have any assetts. I realize I may have assetts later in life but how costly for them to wait and find out. It appears they may be dropping the case.

My problem with this is that if I had not found out about it, I would have a judgement against me now by default and I never would have known.

My ex lives in Minnesota, where we bought a house. When we divorced, the papers awarded him the house and mortgage. We had a good faith agreement that he would refinance to take my name off the loan. He did not and things have gotten pretty bad for him and he is filing for bankruptcy.

My name is still on the lien although the paperwork specifies that it is his responsibility to pay and refinance the loan. My concern is that the mortgage company will try to collect money from me even though I don’t live in the house and can’t make the payments. I also live in California now, so I’m not sure how (or if) that affects anything.

Any help or advice on how to protect myself and what to expect would be greatly appreciated!

Hi, I was in the process of modifying my mortgage with Taylor Bean Whitacker…(investor is Wells Fargo so not a Fannie Mae, Freddie mac loan) My paperwork was submitted to Wells Fargo for a loan mod…I’m self employed and business has taken a big hit this past year) Anyway I’m told now that Taylor Bean still has my loan but it will be transferred to someone at some point soon. I am 60 days behind but have been putting money in an account on the side for my mort. payment. Everywhere I read online says do not send TBW your mort. payment as it will get held up in bankruptcy. It makes me VERY nervous to not be sending a payment. They are making no attempt to collect, I receive no calls, no mail. Is this ok? until the new company takes over and gets my mod going again? Any advice please!! Thanks
I have contacted Wells Fargo and the person I spoke with said that there is no way anyone at Wellfargo would discuss a loan that is serviced by another company..I made several calls and finally got this last person that told me it’s not possible..does that sound right???

My son needs to file bankruptcy. He is trying to straighten out his life and he needs to get his credit in order after bad relationship and some not so smart moves when he was younger. He is 27 and of course he doesn’t have hardly any money, and I told him I had heard that one can file it basically themselves and not pay an attorney. I used to have a ton of paperwork on this subject but that has been long ago and thngs have changed. I know I could do it for him if I had a reputible place to help me through it. Anyone know of a free or cheap place for us to start? This is not a complicated one either because he has nothing, just all of the bills. I have most of them. Ok so this is what happened. Back in July of last year my home was to be foreclosed, however I decided to file Chapter 13 bankruptcy and kept my home. I got behind on my mortgage payments again due to medical reasons, and now my home is scheduled for auction on Feb. 10 of this year. I called my attorney today and he stated that we can do a loan modification to keep the home. He stated that I would have to come and fill out the paperwork for the modification. My question is what is a loan modification? How does the process work? Will my payments remain or lower? I know this is a lot of information however I am really confused as to how all this works. Will I be able to keep my home?

Apparently it started out as a bankruptcy chapter 13 however the final paperwork is a chapter 7. Any difference? on the credit report it states dismissed. What is the difference between discharged and dismissed?
** As some answers have suggested that it was bad that I don’t know my own court stuff… first of all, it isn’t mine. LOL… so No i do not know all the specifics with the case. Thanks for everyones help though.

My bankruptcy was discharged 2 years ago and my car loan was included. It was supposed to be reaffermed but the lawyer never sent the paperwork. I have been making my payment, but the company I have the loan through sold my loan to another company that refuses to send me any paperwork or loan info. I looked at this company online and found thousands of complaints. I am worried if I continue to make payment they will still come and take the car. I owe way more on the car than it’s worth, but cannot afford to get another car right now. Any advice?

I had a John Deere garden tractor I bought a couple years ago. I just recently had my Chapter 13 bankruptcy approved. Nobody showed up at the meeting of the creditors.

Now a month after my bankruptcy was approved, John Deere filed a secured proof of cliam on for my tractor.

What will happen now? The tractor was sold already a long time ago.

What are my options? The paperwork they submitted has no signatures from me, and I never remember signing anything that said it was secured.

Please advise.
They filed a secured proof of claim through the bankruptcy court. I don’t know how it could be filed a month after the meeting of the creditors and the case being approved.

for chapter 7? I see them advertised for like 200 and they do all the paperwork for you, and instruct you through the whole process. Attorneys are charging like 700 to 1300!

Here it is, I was considering filing for bankruptcy and found a firm online that offered a free initial consultation. Half way through my initial consultation I was asked to pay a 0 down payment for a retainer fee for this firm to file bankruptcy papers for me. The phone call lasted about 1 hour. After hanging up I read some info that the bk attorney emailed me and decided that I was not ready to file for bankruptcy. I called the firm back asking for a refund as I had changed my mind, it was less than an hour since I hung up from my initial consultation, so I didn’t really expect it to be a problem. The attorney told me they would not give me a refund & if I tried to stop payment they would sue. Well, I hung up, called my bank and stopped payment and now 2 weeks later they are calling me and threatening "legal action". My question is should I really have to pay them? They didn’t do anything other than the initial consult which was supposed to be free.
I live in California and I did not sign anything. I was not even sent anything to sign. The reason I say he did not do anything is because I did not sign anything that would allow him to start paperwork on my behalf. And as he did not set up any future appointments with me I fail to see how he could have turned down any other clients due to my "retainer"

if you filed chapter 13 in 1982 and it was "Dismissed" in 1988 what does it mean in layman language,my friend looked for info on the internet,but I can’t really explain it to her,because I’m not to sure myself, shes financed 3 cars(one in progress over the years) and has credit cards for many years again and she has good credit score she says,but she was clearing out her paperwork and found a letter that it was dismissed,is it finished ? if it’s not considered discharged ,is the case closed? so now what is the status of her case?

Ok I keep getting conflicting information. One chatter told me my GPA was too low to apply to OTS but another said they did away with the GPA requirement. Then one tonight told me that a bankruptcy on your record is pretty much a DQ but another guy who is a TI (but for the army) said that that’s no problem as long as you’re not delinquent and don’t owe a large sum of undeferrable debt. He also said that allergies are a possible DQ but I talked to a navy recruiter and he said that as long as it doesn’t cause breathing problems then you’re fine.

I don’t want to go to the recruiting office because I spoke to my local one already and I’m still in the process of getting down to the proper weight and I don’t want to go into the office until I’m at the proper weight level. I’m really disheartened right now and not sure what to do.

Can I please get someone with AIRFORCE experience to contact me so I can talk to them?!

Nevermind I talked to an actual AF recruiter and he said I should be fine. The reason the chatters are like that is because the economy is as such that some recruiters don’t want to do the extra paperwork when they can just get ‘perfect’ people to join right now

My husband filed a chapter 13 in 2002, confirmed in July 2002. He got his statement the end of June and it shows he still owes 00, meaning his bankruptcy will be running 7 months past the 5 year limit. Is this possible? What happens if his 5 years expires with this balance? He did miss 5 payments when he moved up here after we got married, because the trustee and his lawyer failed to file new payroll orders even after being asked several times. He mailed several payments when it was obvious they hadn’t put in the order. The payroll with holding amount was supposed to be increased slightly to make up the missed payments, but again the trustee and his lawyer didn;t file the paperwork and we finally stopped calling and bugging after several months. Are we now going to become responsible for that unpaid balance or will his bk be extended past 5 years???

I filed a chapter 13 bankruptcy and it was confirmed in March 2008. I opted to turn my car back to the bank. They still have not come to pick it up, nor has any paperwork been sent to me regarding the vehicle. After reviewing my case online, it shows that 100% has been paid to the bank; but it shows {content} paid and {content} owed. Is it possible that the bank forgot about me? It is a VERY small bank.

I filed for Bankruptcy in California in 2004. I have just found out when trying to refinance that there is an abstract judgment filed in 2001 in Orange County. 2 part question, Should/Can I file a motion to re-open the chapter 7 and try to include the judgment and have removed? approx cost? The judgement was for ,500. I need the lowest cost option to remove the abstract judgment/lien.
Do I have any recourse on my title insurance because I wasn’t aware when I purchased my home in 2008 there was an outstanding judgment and was under impression the BK included everything? (The BK was due to medical emergency at the time, orginal BK attorney no longer has paperwork)

After a long period of disability and a financially devastating divorce I have no realistic option but to file chapt 7. I’ve put this off for ages as I tried to save for legal fees. One creditor has begun court proceedings which I have thus far ignored. I need to end this asap and begin anew. My credit was perfect for decades before this disaster. I do not take this lightly at all, but now that it has happened to me, I just want to fix it and start over. Any advice on how to begin filing the paperwork, online resources to help guide me, etc. would be most helpful and greatly appreciated.
