So my hubby and I joined a debt settlement company to help with our k debt. It was originally for 48 months, we have completed 18 months and payed off some debts already. So now I have been served with 2 summons from 2 of the debts. the debt settlement company tried to settle with them, but they want way more than we can afford) Has anyone been thru this? My options are go to the court date and see what judge decides I have to pay, pay the huge amount they want(which we can do for a couple months but then just default again) or do Chapter 13 bankruptcy. This is just awful because I feel we were on the right track paying off the debts and learning how tomdeal with credit. I live in Texas so they cannot garnish wages or have a lien on my home. They can only put a levy on our bank accounts, which we no longer have direct deposit and have minimum cash in there in order to avoid them taking everything by surprise. Any opinions?

okay, i need advice. im nearly 21 years old, and working at a fast food joint. i made a stupid decision when i was 18-19..got in a car accident with no insurance, and hit two different cars. each car insurance company was wanting 4500 from me, i had been paying 100 bucks a month to each company since this all happened. a medical injury bill came in from one of the companies, so instead of 4500, i owed 17,000. along with this accident, i have criminal fines i have to pay (did stupid things when i was younger) that total out to about 3-4500. i realize bankruptcy wont relieve me of my fines.

my mother also put me in debt with my debit card, making me owe 2000 dollars. so, im paying 300 bucks a month in the accident/credit card alone. plus 100 to one fine. and my wages are going to be garnished (25 percent) for a bit for another fine (i didnt know i had other fines that still needed to be paid..ive had a rough start in my life, i want nothing more than to pay these things off)

if i add all that up, thats 700 bucks a month total in debt. or aroud 400-500 after my wages arent garnished anymore. i make about 1,000 a month. im renting out a room in a house. i own nothing.

i saw a lawyer, he said it’d be a good idea to file because its better to do it while you’re young than older..because i dont have anything to lose, and i dont plan on buying a house anytime soon, or a brand new car (i prefer buying from craigslist)..so im thinking it might be a good idea to file. i know its a last resort, so im seeking advice from the more mature and wise. 100 bucks a month to a 17k debt..thats about 15-16 years of paying that. every month i call, they say if i miss a payment, then our agreement is over and ill owe it all. in 15 years, thats a lot of chance to miss a payment, or slip. also, the lawyer told me that having this unpaid debt over my head, for so long looks awful. and my credit may never be decent, until its actually paid off and clear.

the sooner i have this debt clear, the sooner i can put more money into my criminal debt, so i can wash my hands from that. i mean, i realize that 20-21k in debt isnt that much. but, in my situation..and given how much i can actually afford right now.. ill be stuck in the same puddle for a very long time, BARELY squeezing by..for years. atleast 2-3 maybe 4, which is when i’d expect to get most of my other debt off besides the 17k collection.

what do you think? i live in washington if it matters. also, i am thnking about going to a trade school and getting into the medical field..like being an xray tech or some sort.. i know bankruptcy would disable me from getting a job at a bank (well more than likely) for example..

Hi.. I recently was served with a summons and complaint that states I have twenty days to respond to it in writing to the court or I will be faced with a default judgement. I have looked up alot about this online and found out that in my state (indiana) I can file a "Motion to dismiss fo failure to comply with rules" if the plaintiff did not have a contract written instrument not attached to the complaint and summons, and it did not. I still need to call my court here in my county to be sure that it is the rule before I can try this though. I need to know how to word my answer if I would go with this route and if even if I dont I still have to answer to avoid the default judgement. I know that I need to go through and deny each complaint that is numbered on the sheet but I do not know how to word it exactly. The reason that I am being sued in the first place is because my b/f and I had a couple credit cards that I was a joint on with him. He was always the one responsible for making the payments. He ended up having to file bankruptcy, and once the case was discharged it automatically made me the one responsible for the amount. I have no way of making any kind of payment on it at this time. I have been out of work since 2007 when i found out I was preg with my daughter and i have been a stay at home mom since. So i know that the judge can not order for any kind of wages to be garnished and I do not have any assets for them to take, so most likely its just going to be on my record and if I would get a job or any money withen the next ten yrs or so id have to pay it then. Do I need to deny the complaint in my answer even though I know its true .. or will the judge just order me to pay it then because he wouldnt have been able to hear my story or i guess situation? The complaint states that 1. The defendant is indebted to the plaintiff int he amount of ***** plues accured interest of **** as of jan 2010.
2. Venue is proper with this court and based on the defendant residing in **** County.
3. The plaintiff owns and is the holder of an acocunt due and oweing by the defendant, and is the asignee of Elan/ Mainsource bank.
Wherefore the plaintiff respectfully requests the following relief.
1 Judgement against the defendant in the sum of ******* plus accured intesest of **** as of jan 2010
2 Interest thereon at the rate of 8 percent per annum from jan 2010 , and 8 percent per annum from the date of judgement , until the judgement is satidfied.

this is from a consumer loan company I filed bankruptcy on..now they are trying to put a lien on real estate I do not own…my ex wife does..i never received a summons or notification…just saw it online when looking something else up
the court action is against me in this case…she had already been notified that the loan co was going to garnish her wages for the loan (joint)..the divorce decree states I have to pay the loan..I couldn’t and filed BK …how can the loan co come after me? I have been told by attorneys to pay her the wages back she is having garnished…because of the ruling in the divorce

My W2(from Employer 2) for 2009 reflects data for 8 months .. for the first four months, however, I do not have a W2(from Employer 1, although i have paystubs) from Employer 1 that filed for Bankruptcy and is now defunct. Can I, then, make changes to W2 amounts from Employer 2(add wages and taxes of the four months missing) and file my taxes online? Is this legit? Or do i HAVE TO file a 4852 in situations like these?

I’ve been filing thru TaxAct.com for a long time now – and I’m not sure they can handle special situation like this one.

Any help will be a lotta help!

My husband and I are into our 3rd year of a Chapter 13 bankruptcy. Our payments are deducted from my husband’s check each week and we have always made our payments on time. They also have intercepted our income tax refunds for 3 years but because of our good history of making our bankruptcy payments, the trustee sent us our intercepted stimulus check last year.

My husband is getting a bonus in 2 weeks from his work for more than 00. They are offering to wire transfer it into our bank account. Is there any possibility that the trustee can intercept a wire transfer such as this if we are making all of our scheduled payments?
My husband’s wages are already being garnished. This is the way we had it set up. Our agreements if for 07 per month in payments over a 5 year term with the trustee taking our income tax returns for 5 years as well. I wasn’t informed that we needed to also report any additional income so I never had. I thought we only had to meet our monthly payment obligation and forfeit our yearly tax refunds… They did intercept our stimilus check though because it is a form of tax credit…However, like I said, we called and inquired about it and they sent it to us…Isn’t that how it works?

In Chapter 13, does your monthly obligation increase just because your income increases?
I must say that I do like the idea of paying the bankruptcy off quicker…

But would the trustee use the money in the same way as if we were making monthly payments?

I do know that when they take the income tax refunds they use that money to pay more on the unsecured debt. Would they use this bonus money in the same way? If so, it wouldn’t necessarily pay us up 6.5 months sooner, would it? Rather than unsecured getting 10% they would give them more.

I’m actually very worried right now. My husband works on a weekly "draw on commission" rate. The payments are taken from his draw on commission. Our attorney told us that the trustee would never touch my husband’s monthly commission checks and to date nothing has been taken from his commission checks.

Are you guys saying that the trustee is supposed to know about every dime we make and they have a right to take it all? If that were the case, why would anyone file Chapter 13? A person has to have money to live on…

I asked this question last week, and I would like more answers if you could answer them. I am a few months into a 60 month plan chapter 13 BK. I owe the creditors about 7,700+,700 lawyer fee. I pay .00 every two weeks. And it is set at 70%. I dont have my home included in this, because I make sure I pay this every month and on time. My question is – what are my chances of calling these credit card companies (or the collection agencies that took over these accounts) and asking them to set up payment plan that I can afford with no interest? I want to hear all advise. Let me just add, that I do not have my home included in this. Can the credit card companies sue me and have my wages garnished or put a lien on my house If I dont send them what they want every month?

It’s quite obvious why jobs go over seas besides the employees willing to work for low wages, it’s simply because the cost of employment is expensive. All the red tape, licensing, insurance, pay-roll costs like medicare, unemployment, workers comp, social-security, and other nonsense.

It eventually comes to a point to where starting a business becomes too bothersome.

If you want jobs to stay here you must be willing to be competitive. All these entitlements make it hard for companies to meet these ridiculous demands.

It’s Obvious the Chinese Company has less burdens and a cheaper product then the American one. Thus the American one isn’t competitive enough and faces bankruptcy. This happened with GM and all the entitlements it had to give to it’s Union. It’s going to keep happening until American’s decide to stop demanding more then what they earned. Otherwise jobs will continue to ship over seas.

Learn to be competitive. Not complain.

My credit is terrible I have quite a few accounts in collections, charged off and delinquent and wage garnishment. Some of the accounts are not mine but the process of filing a dispute with the credit bureau has proven unhelpful because they would not remove the accounts. So I am trying to move forward in my life and get my finances and everything together but I am not sure if I should file bankruptcy because I feel like I can not obtain new credit anyway and either way it would take at least 6 months to a year to show that I am being more responsible but my main concern is my garnishment that will stay on for about 20 more months and I really need that extra money due to the fact that I am a single parent trying to get on my feet after leaving an abusive relationship and I just don’t know what to do. Morally I think the right thing to do is to pay off my bills but I don’t have any extra money to do so the money they are taking from my wages could be used to pay off my debt but the only way I can get it off is to file bankruptcy so what to do I am very confused and defeated right now please any advice on finances that could help!!
when I say the accounts are not mine that means I did not sign anything I did not ok anything and I was unaware of the accounts until I looked at my credit report. I have had my personal information stolen on 2 seperate occasions so while yes my name may be on the account I did not sign for them. I am woman enough to admit the accounts I opened I neglected but I do not want to pay back money for accounts or loans that I had no part of and I do understand that bankruptcy will effect my credit for years to come but I have 2 kids a job and school so yes finding another job sounds logical but physically and mentally I am not capable right now of taking on that extra stress and losing the 4 hours of sleep i get each night now. After being laid off a few months ago… and having lots of debt for having to keep a roof over my family’s head, the **** hit the fan. So… long story short:

I’ve got 4 credit cards with accumulated debt of ,000 (pretty much due to expensive but normal life events that happen, NOT excessive spending), and I’m gonna man-up and take the frigging negative hits, I want to get this over with, start the clock ticking, and start fresh in either 7 or 10 years.

I’m could file for bankruptcy, which will show up on my credit report for 10 years. OR, I could just let the credit cards sue me and have default judgments against me, which will fall off my credit report and disappear in 7 years.

No guesses please. If one is favored over the other, please explain. Don’t assume there are any extenuating circumstances, this is just general for now. Check back for my updates to your answers.

Also, I’m judgment proof/insolvent. {content} to my name, no savings, no assets, 0 car, no furniture, no property, no house.

Because of certain family members requiring full time assistance, they will be needing my care for a while. So basically, I’m not worried about having my wages garnished because I most like will not even have anything for the cards to grab for a long while.

Bonus question: Does anyone know for sure, once all the judgments fall OFF my credit report down the road, do the credit cards purge me from their system at some point, and can I get a credit card with them again with a normal credit limit? OR do they keep me in their system forever, and refuse to let me have a credit card with them again? I could see them going either way. I know what they would favor!

Question for people who really know. Prefferable a law student or lawyer…My sister gave me her car so that she could get one with cheaper payments and wouldent have to let it get repo’ed. I became unemployed and couldnt afford the insurance any longer. I had gotten into an accident. The accident was deemed my fault. There is a company that is now persuing medical and workers comp. from me. This company has already paid out to the other party but wants to get the money back from me. I have been told my only option is to either settle and pay or file bankruptcy. At this point in my life bankruptcy is my only option. Can this company legally then, after I file chapter 7, try to collect from my sister. Keep in mind that although she was the owner on paper I have been making car payments for several months. I was the one that was driving and got into the accident. My sister didnt know I was uninsured. Can they still take her to court and get a judgement or garnish her wages?
Thank you for your answers. I am not a terrible person, however, not responsible at that point in my life. Unfortunately even people who are down on their luck and cant afford insurance still have to drive. Other than that it is beyond excuses. The reason I asked if I could file bankruptcy without leaving my sister for the fall shows that I am not willing in any way to abandon my sister with a debt that is my responsibility. I would not even consider the Bankruptcy if I wasn’t sure she would be "immune" to collections. Thanks for all your know how.

My exwife has purchased a home for 6 years at 130k her mortgage is so excessive she had to take a second mortgage. She filed a second chapter 13 bankruptcy to save the house and her car but my child support pays what she is garnished. I work two jobs at 8.00hr with wages garnished for child support at 0 monthly for two children. I need to seek modification and should I disclose to the courts that she lived in a home outside her means or just worry about my own needs and source of income? and why?

My husband filed chapter 13 bankruptcy last year and I did not. I am attempting to settle with my creditors as my debt was only a fraction of his. In the event I can not settle or make adequate payment arrangements with my creditors and they sue me and get a judgement can they garnish my husbands wages or seize our joint bank accounts. In other words…what can they do to try and get the money? Btw I am currently unemployed and in the state of California.

I wont be eligable to file bankruptcy under chapter 11 until 2010 because of a previous bankruptcy , my husband also did one about two years after me. We did great after that with alot of money in savings until one day our business went under in the blink of an eye from low life criminals. In the end we lost our lively hood and are now struggling to survive, but all of these places want to garnish wages….. Can we still file for a chapter 13 bankruptcy? Im at a loss i dont know what our options are for financial salvation, but if we dont do something we will be even worse off because they will start to garnish wages!

I received a wage garnishment last Monday and I went online for help on what to do? I can not file bankruptcy because I filed in 01 and I spoke to lawyer that said I have to wait 8 years. (he was no help) SO I filed the Affadavit of Exemption because I do not make enough money now to pay all of my bills for me and my 2 boys as a single parent. I barely have a week left for groceries and gas now. I go to court on Monday and today I received a letter in the mail from the lawyer Opposing my motion and they noted an NRS 21.090 and that my wages were not exempt. I cannot afford a lawyer. DOes anyone know if I have any rights because my wages are not enough. I can not get a second job either because then I would have to find a babysitter and pay them! After filing Chapter 13 and making court assigned amonthly payments to this ‘trustee." for over 10 months(90.00 per month =over 900.00)From very start, boyh my lawyers and mine intentions, were to refile from 13 to 7. Almost 1 year later,refiled to Chapter 7, Now another second,differnt trustee demands any tax refunds collected since file date and other tax forms filed for previous years stating these funds are part of bankruptcy estate. These are tax refunds for wages earned prior to the Bid.B date.< if the IRS or State Reveue had not already nabbed them. How is each of these trustee’s making and how many estates are they assigned or given?

How much more money would people have if the top corporations shared their profits with the workers that created it?

How much money would be injected into the economy, into the average middle class American’s pocket books, if the top 100 corporations only shared 50% of their profits, ONLY with the workers at the corporations who helped to create that profit?

Investors would still get a 3.1% dividend yield, which is still better than any bank savings or CD account and 401K’s would still rise!

I received a notification in the mail that my wages are being garnished by a credit card company, for an outstanding debt. I cannot afford for this to happen because I am a single mother of my daughter. How much or what percentage can be garnished? I live in Maryland. I read on a website that they can take all but 0 of my check a month. Is this true? I am currently unemployed but I have had numerous job interviews. I assume that once I become employed my wages would be garnished immediately. I am thinking of filing bankruptcy because I have other credit card companies that will be coming after me for money that I do not have. I heard bankruptcy can be filed online to save money for a lawyer. I do not have money to pay a lawyer. PLEASE HELP!
Yes, I did have a court date but I did not go because I knew I owed the money and I did not have the money for a lawyer.
